Review: Hansen Wholesale claimed to ship me merchandises from a CANCELLED order, and then unlawfully demanded payment and sent me to debt collection agency!

Amount: $674.05

Problems:

Hansen Wholesale claimed to have shipped items from a CANCELLED order that was originally placed with [redacted] (in this order Hansen Wholesale was only the third-party market seller and all payment information was processed through [redacted]). After failing to collect money from [redacted] because the order was cancelled, Hansen Wholesale sent me to AWA collection using shipping address and held me responsible for the full amount of the merchandize ($674.05) plus interest. I am filing this complaint to request that this debt account be removed from my credit reports because I do not have any responsibility for this debt for the following reasons.

First, Hansen Wholesale does not have the right to collect any payment directly from me because I never placed an order directly with Hansen Wholesale. I placed an order (order #[redacted]) on [redacted]) on June 5th, 2013 and paid $674.05 in full using my PayPal account. (The itemized receipt from Hansen Wholesale provided by AWA Collection shows that the order #[redacted] from Hansen Wholesale is actually order # [redacted] from [redacted]). In this order, Hansen Wholesale is the market place seller of [redacted]. According to [redacted], "since all customer payment information is processed through [redacted] solely, the sellers are not able to refer this matter to collections." You can contact [redacted] directly at [redacted] and mention order number #[redacted] to confirm this information.

More importantly, according to Federal Trade Commission's Mail or Telephone Order Merchandise Trade Regulation Rule [redacted]), Federal laws prohibit mailing unordered merchandise to consumers and then demanding payment. The order was in fact CANCELLED even though Hansen Wholesale totally denied it. I received an order cancellation email from [redacted] on July 5th, 2013 that the order was cancelled and $674.05 was refunded to my PayPal account. In an email that [redacted] later sent to me, [redacted] further verifies that "This order remained in Fulfillment status for 30 days with no shipment confirmation being received by [redacted] Shopping from the marketplace seller Hansen Wholesale. This order was auto-canceled on 7/5/13 by [redacted] Shopping because of the extended time in Fulfillment status." As a result, I should not be held responsible for the payment for a CANCELLED order.

Hansen Wholesale claimed that they shipped out the products to my address using Fedex tracking ([redacted] and[redacted]). First of all, it is unlawful to do that in the first place because the order was cancelled. Second, I do not assume any responsibility for receiving their products - I never signed for any of these two packages! Finally, the tracking numbers are not the proof that I received the products. Hansen Wholesale should have requested the "Direct Signature Required" service as the proof. According to Fedex, "All pieces with a declared value of $500USD or $500CAD or greater require a signature." Regardless, according to the federal law, I should not be held responsibility for paying for the order that was cancelled although Hansen Wholesale claimed that they shipped the products.

I had contacted Hansen Wholesale regarding this matter, but their representative ([redacted]) claimed on January 16, 2014 that "the order was never cancelled" (but in fact it was cancelled). I had also contacted [redacted] and was informed that they had "made several attempts to contacted the marketplace seller, Hansen Wholesale, regarding this matter, but have been unsuccessful in getting a response." AWA Collection has reported this to credit bureaus and simply refusedDesired Settlement: I would like to request Hansen Wholesale to (1) stop trying to collect payment from me; (2) instruct the collection agency (AWA Collection) to remove this debt account from my credit reports and discontinue any future correspondence with me regarding this debt within 30 days, and (3)provide me written notice that this debt has been settled. Otherwise I would reserve my rights to seek further legal assistance regarding this matter.

Review: Ordered an Old Havana Fan costing $637.00 & charged my credit card.

I called the company to inform them of their error. I was told this was human error and I would have to pay an additonal $169.00 for the part they did not send me. Would not honor the price quoted and charged even though it was their error. Customer service was no help either. Totally fraudulent and unethical.Desired Settlement: need to honor their quote and make good on what was ordered and paid for
