speaking with the customer and diagnosing the problem, we offered to send a replacement fan which is standard if the fan is not working when it arrives to the customer (damage during shipment). The customer did not want that option and requested a full refund for the vent + shipping instead ($361.28). The [redacted] vent was powder-coated which is a custom order and is final sale (stated on customer order confirmation). We are willing to offer the customer $180.00, which is half of the disputed amount ($361.28). The customer is able to keep the vent (which works passively and is valued at $57.00).

I am disappointed that Active Ventilation does not share that view . However I believe at a minimum, the spirt of the laws of New York State do share my view. This a conflict that needs resolution and I believe it is the vendor who should provide the remedy. $ 360 represents one half of my purchase, $ 57 represents the (in vendors view) usable powder coated vent and $ 37represents 1/2 of shipping for a refund of $ 266 which would represent a reasonable portion of the price paid.
