Dear Ms***, We are in receipt of your notice regarding a complaint made to your office on January 19, (ID #11945706; copy attached) by *** *** *** in which Mr*** alleges that Club One Casino withheld $in winnings from him and committed fraud by reviewing his cards
without his consent. Based on our review of relevant surveillance footage and interviews with Club One employees involved in the incident, Mr***’s recollection of the facts and circumstances of the incident appear to be in error. The results of our investigation are as follows: Incident Mr*** was involved in a poker game (4/limit Texas Hold’em; Table 6) on Tuesday, January 10, (not January as he claimed) at approximately 6:00p. At the completion of a hand in play, the dealer instructed the active players to table (i.eexpose) their respective hands to establish which player won the hand. The player to Mr***’s left exposed his hand and the dealer indicated the winning hand based on the cards shown. Mr*** did not expose his cards as instructed and instead surrendered his hand (folded), by pushing it facedown beyond the betting line shown on the table and releasing it from his control. In accordance with dealer protocol, the dealer then drew Mr***’s cards into the discard pile (muck) killing the hand. Mr*** then claimed that he had in fact won the hand, not intended to fold and tried to retrieve his cards from the dealer Upon being told that his hand was dead, Mr*** repeatedly tried to retrieve his hand from the dealer and became agitated when the dealer blocked him from doing so. Mr*** then became more disruptive resulting in a poker floor supervisor being called to the table. In the course of the situation, Mr*** forcibly retrieved two cards from the discard pile and insisted he was the actual winner of the hand. Upon review of the situation, the floor supervisor declared Mr***’s hand dead and awarded the pot to the player who had revealed his cards properly. Mr*** refused to accept the supervisor’s decision and became more vocal and disruptive, resulting in security being called to the table. Mr*** was then escorted from Club One Casino by a security supervisor. The value of Mr***’s wagered funds was less than $(not $as claimed) Discussion Our house rules (based on Robert’s Rules of Poker and Tournament Director Association rules, both of which are industry standards) state that a player must expose his/her hand when instructed to do so by the dealer and that once a player’s hand is released face down in the direction of the dealer or discarded cards (the muck) and included in the muck, that hand is considered no longer active (dead). Note: all Club One Casino game rules (including Texas Hold’em) are approved by the California Department of Justice Bureau of Gambling Control and City of Fresno Police Department Our posted Code of Conduct also state that all players must expose their cards promptly at showdown and avoid threatening or disruptive behavior to Club One Casino employees or patrons In short, Mr*** failed to follow our industry standard/approved game rules and instruction from our dealer resulting in the loss of his wagered funds. When he became disruptive and further violated our Code of Conduct, he was escorted from our facility. Mr***’s loss of wagered funds was due to his own actions and, in any event, was substantially lower than the amount he claimed in his complaint As for Mr***’s complaint of being defrauded by our review of his cards, we are within our rights to review any hand held by any player at any time. That said, Mr*** folded his cards face down, and his cards were only displayed to the dealer when he forcibly retrieved them from the discard pile Past Behavior Please note that Mr*** has a history of questionable behavior at Club One Casino. In 2008, he was placed on our “Deny Entry” list for capping bets (a violation of the California Penal Code 337u, the section which deals with cheating in a gambling establishment). He attempted to circumvent that facility ban in and 2012. In 2014, he was allowed re-entry into our facility but was then involved in two separate incidents in which he walked out on a bar or restaurant tab. After his claim to your firm on January 11, he was involved in another incident (January 29) outside of our facility in which he was observed panhandling from employees and patrons. He is now considered a permanent Deny Entry from our facility Conclusion In closing, we disagree with Mr***’s assertion of the circumstances related to the incident, any claim or fraud or our responsibility for his loss.
