Thank you for providing Harbour Homes the opportunity to respond to this complaint Every Harbour Home is sold under a Real Estate Purchase Agreement which defines and stipulates what the warranty relationship will be after our customers take possession of their home That relationship is further described in a specific and detailed Warranty document provided to our customers before submitting an offer for the home so all parties are very clear prior to entering into Agreement as to the term and nature of the Warranty coverage provided therein Our customer correctly points out that their home was purchased in the summer of and describes the occurrence date of the problem as 11/26/(in excess of years later) As the referenced Harbour Homes warranty administrator is quoted, plumbing related claims are covered under the Warranty for years post possession Either or year coverage terms for mechanical system claims such as plumbing are very typical of most such warranties offered by builders in this area Given that the issue described occurred in excess of years after the customer’s taking possession of the home, it does fall well outside of our agreed upon coverage termWe feel very badly that this customer is unhappy with the performance of their home but must accordingly decline coverage on their claim Again, thank you for allowing Harbour Homes the opportunity to provide a response to this complaint

Dear Revdex.com,
Thank you for allowing Harbour Homes to review and respond to this complaint. While Harbour Homes certainly has its own position in this matter as well as counter points to the arguments presented in the complaint, this person has retained legal counsel (as she
references) who is actively engaged with Harbour Homes’ attorney in this matter.
While Harbour Homes appreciates the function the Revdex.com serves and places a high value on our long standing good rating with the Revdex.com, our attorney has advised us to not engage in parallel communications/dialogue with this party outside of the current and on-going process taking place with her attorney
We hope that the Revdex.com understands that once this person engaged legal representation it puts Harbour Homes in a position where we have little choice but to defer to our attorney’s recommendation and allow the on-going dialogue between our respective attorneys run its course

Thank you for providing Harbour Homes the opportunity to respond to this complaint.  Every Harbour Home is sold under a Real Estate Purchase Agreement which defines and stipulates what the warranty relationship will be after our customers take possession of their home.  That relationship...

is further described in a specific and detailed Warranty document provided to our customers before submitting an offer for the home so all parties are very clear prior to entering into Agreement as to the term and nature of the Warranty coverage provided therein.  Our customer correctly points out that their home was purchased in the summer of 2008 and describes the occurrence date of the problem as 11/26/16 (in excess of 8 years later).  As the referenced Harbour Homes warranty administrator is quoted, plumbing related claims are covered under the Warranty for 2 years post possession.  Either 1 or 2 year coverage terms for mechanical system claims such as plumbing are very typical of most such warranties offered by builders in this area.  Given that the issue described occurred in excess of 8 years after the customer’s taking possession of the home, it does fall well outside of our agreed upon coverage term. We feel very badly that this customer is unhappy with the performance of their home but must accordingly decline coverage on their claim.  Again, thank you for allowing Harbour Homes the opportunity to provide a response to this complaint.

Dear Revdex.com, Thank you for giving Harbour Homes the opportunity to respond to this customer’s complaint.  Harbour Homes has always placed a high value on our long standing good rating with the Revdex.com and appreciates the function the Revdex.com serves for both consumers and businesses....

Harbour Homes strives to communicate early and clearly with our customers regarding what they can expect when purchasing a new home from us.  In specific response to this customer’s complaint(s), several of the items referenced are described in the Real Estate Purchase Agreement (“REPA”) that was executed by both parties to memorialize our understanding/agreement.  The Optional Items Addendum (“OIA”), which is part of the REPA, identified the exterior color scheme that had already been selected for the home.  Additional detail for that color scheme was subsequently provided upon the customer’s request.  The OIA also described the model/type of range (gas) included in this home’s specification.  The REPA language speaks to the topic of site grades, decks and landscaping in that it states no two homes are built exactly alike and that Harbour Homes will be utilizing its best and sole discretion in establishing final site grades, the installation of decks and the use of landscaping material most appropriate for the lot conditions. Harbour Homes also understands that there needs to be a protocol for our customers to request answers to any questions they might have during the construction of the home.  The REPA specifically details how to submit such questions (in writing) and who is (and is not) authorized to make representations on Harbour’s behalf.  We have reviewed the written requests for information/clarification submitted by this customer (via their real estate agent) and find that the responses given by Harbour Homes were timely, clear and consistent with the home being delivered to the customer.  While Harbour Homes does not believe that we misled this customer, we agree that it extremely unfortunate and regrettable that their expectations appear to have not been met and appreciate being given the opportunity to hear about their experience so we can use that feedback to try and improve our processes.   That said, Harbour Homes remains committed to meeting it’s agreed upon obligations as memorialized in the REPA and will work towards improving the lines of communication in the hopes that this customer’s experience improves moving forward.

I would interested in arbitration ,mediation and settlement options. is the a fee associated with that and if so what would it be.
