I am rejecting this response because: I am rejecting this response because: This is exactly how I figured *** would respond since he refuses to take responsibility for his actionsHis statement that we paid him in full is a claim since we only wrote a check for $4,withholding $1,until the repairs to the concrete and job were finished. However what *** failed to tell us at the time we made a partial payment was that our neighbor had already paid him directly $for their share of the tree removal. My wife felt bad for *** and wanted to pay him a portion but told him she would withhold $until the concrete could be repairedHe went along with this and wasn't truthful about already receiving payment from our neighbor. Had we know he already received payment from our neighbor we never would have given him $4000. *** did return after many calls unannounced to supposedly repair our concrete which at this time was very cold and in the dead of winter but after talking to many concrete professionals this was not the best time to pour concrete and on top of that *** never had ordered any materialsWhen *** arrived out of the blue I had a nice talk with him about waiting until winter was over and possibly having him do additional work so his losses were not significant which he strongly agreed was the best way to goAfter many text messages and phone calls in the summer of he said he would only repair a small area which was not acceptable to me since he caused all the damage doneAt this time after going back and fourth he said he was not going to repair my concrete since it was not up to codeSo now I guess he is a concrete inspector alsoThe concrete was done up to code when it was poured many years agoI have driven my RV and many other trailers across this and never have had any issuesI have attached pictures along with checks that were written to ***I also have four different neighbors that also were at my house when this guy dropped the tree across my concrete padI at no time agreed this was OK and assumed he would take care of all damagesOriginally I only wanted my concrete fixed but since he has been a very unprofessional contractor once things did not go his way I decided to go after the stump grinder cost and the money I paid him for my unfinished tree in my front yardI can provide testimonials from my neighbors if necessary
In regards to the complaint, [redacted] the complainant was in fact there the entire time we performed the project. We performed the jobs to his expectations and and were paid when the job was completed and they were satisfied. We accepted no money up front. In regards to the concrete damage,...
[redacted] approved our method falling the remaining section of the tree, and stated they would be replacing the concrete anyway. The grinding he mentioned in the complaint were in fact roots below the surface that were not visible to us at time of grinding, also stump grinding is the act of removing the stump which we did and does not include roots underground which would be impossible to grind away all roots to trees of that size. Noting the trimming to camphor tree, again he was there the entire time, and had no issues with what we had done, was happy and paid for the service. I was aware of fixing part of the concrete pad mentioned (damages at 500 dollars) and showed up twice to repair to have him turn us away so they could save money to replace the entire slab due to the severe cracking and instability it had prior to our work. With that being said, I am not at his disposal forever or whenever he desires, we made 2 attempts that has taken away my time and has cost me in excess the amount of 500.00. I will not be paying for him to get a new driveway when the existing one was not done by code, was not rated to be a driveway and had no rebar or reinforced mesh in it in the first place. Again he was there (outside with us the entire time, and his kids helped and played around) , everything we did was done in front of him and with his consent, and he payed when we were finished and obviously satisfied. Not entirely sure what the financial motivation is for this complaint, but I won't be the guy paying his bills, habits, or whatever he wants this money for.
