I understand your desire to have warranty paperwork for the new compressor. We would certainly provide this, if we receive full payment for the outstanding invoice. $1,611.18. I have read the 8/10/response from Mr*** Regrettable, we are in agreement with Mr***, wish to close this claim We feel have done everything asked of us. We also have dropped off on 8/14/a brand new compressor for that particular unit and taken the old one out of the Rooftop unit to return to *** for credit As discussed and agreed upon with ***, we did not and are not going to charge the labor to remove the compressor from that unit or the freight cost that we are going to incur to send it back to *** Warranty parts are for the equipment that has had the failure *** has this new compressor in her closet to use for any future failures for an exact model rooftop unit that is in working order for the first floor The failed rooftop unit for the second floor is already being replaced, so we truly shouldn't be entering a warranty for a piece of equipment that this part is not going to be installed in by another companyFrom the very date of diagnosis for the rooftop unit needing a compressor replaced, it was explained to the client, only the compressor would be under warranty within the one year period from installation to failure dateThe labor, refrigerant, filter drier, freight cost and any other materials necessary to replace the compressor is the responsibility of the client; it is Not covered under warranty The manufacturer will provide us with a new part but they will not provide cost to cover labor, refrigerant, filter drier, freight cost This is to be paid by the owner Each time there was a failure, it was explained to *** that warranty does not cover anything but the failed part; all other costs are to be the responsibility of the client. At no point were we told that anyone was using the area upstairs, veterans, or otherwiseWe were told when they went upstairs for something they realized it was not working and called We were also told, get to it when ever, it wasn't in usePlease make sure we can enter warrantyNever have we ever stated "too busy", "running reports" to a client We try to take care of all our clients as quickly as possible, but while it isn't always same day service as we like, we tell the client that we will get them taken care of as quickly as possible *** has always been the person to contact our office concerning any HVAC issues for the unit that takes care of the upstairs area as well as, when our technician arrives on site to check any HVAC system, *** is our point of contact As for the $1,invoice that is still unpaid, the invoice amount stands We feel that we have been completely fair with this charge This invoice is strictly for the labor, refrigerant and materials necessary to replace the warranty compressorThank you for you time, consideration of this claim Please feel free to contact our office for any questions you may have concerning this claim.Sincerely, Mark ***PresidentMarston & Michael, Inc

I have reviewed the response offer made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
We have respectfully noted points made within the response from Marston $ Michael.The dates so noted by the company are limited to only their response datesMarston $ Michael have been called repeatedly with only their patchwork remedy and less then professional action.We have not been able to lease the office space because we still do not have a working unit.Mr *** refuses to remove the existing compressor, of which is still under warranty, and ship back to *** for replacement as promised.While we have been without a continual working unit since May 2017, Marston $ Michael, has shown total disregard for us or the Veterans that been meeting there, stating " too busy to come"', "running reports", "or " I'll try to get you on the schedule", "we're really busy".....When Mr*** was ask to reduce his recent bill of $1611.18, knowing that we still have no working unit,he said no.I submit that in April we paid Marston $ Michael $2569.00, August 2016, $2554.00, September $1598.50.We ask for a compromise on the latest billing because we felt it fair after all that has been paid out and the unit is still down.We too are a small business and support our local businesses in the surrounding area even if they don't support us. We regret that this business relationship has been altered and desire to have closure.***

This is in response to a complaint filed by one of our client's concerning a failed compressor for their rooftop system for which was replaced under warranty on 322/.We have been working on these two rooftop units since 4/The rooftop system that is in question is a unitThe
HVAC system is years oldIt has been conveyed to the client, it needs to be replaced.The client did contact us concerning this failed partOn 6/12/the client called stating the unit was not working and had not been working for a while, she was unsure of exactly how longshe was told we would take care of it as soon as we could get our technician thereHe went on 6/13/to check the system over, found a starting contactor control wire was loose from the contactor, which he repaired and started the system up.On 7/6/17, the client called again stating the unit was out again and they had a showing at 1pm that dayShe was told we could not guarantee we could have someone there before they showed the properlyWe went on 7/7/and found that the newest compressor (3/22/Install) was in fact not working and needed to be replacedOur technician spoke to someone in their office explaining that the system needed another compressor but it was time to replace the equipment and not do anymore repairs.On 7/10/the client called wanting the technician to call herHe was unavailable that day, but did go by the site on 7/11/to speak with them about the unit in need of repairsMarston & Michael, Incexplained to the client, the system is a 1993 unit and is need of replacement The client, said that she did not want anymore repairs done to the unitWe did offer to get them another compressor, under warranty, and that we would come and take out the existing bad compressorThis we would do for no charge to the clientThe bad compressor is needed for the warranty entryThe client has another rooftop unit exactly like the one needing replaced and is working for another part of the building This compressor would be held by the client for future repairs to the working unit.In July, when the compressor failed a 2nd time, the client was suggested to, that they really need to replace the system instead of repairingThe reply was that they have a water line that needed to be replaced firstThey could not afford both at this timeThey opted to repair the rooftop unit.Marston & Michael, Incresponses the client stated: "too hot", "someone call" or "I'll try to work in the schedule"We are a small business, we work hard daily to get everyone taken care of as quickly as possible.For the Disputed Amount: $1,611.18This is for the 3/22/compressor that was replaced under warrantyWarranty terms for replacement parts do not cover the following: Laborfreight, refrigerant, filter driers, cabinet partsThe total cost of $1,is for the labor, refrigerant and the filter drier necessary to replace the compressorThe client was explained this each time it needed replacement of the compressor.Purchase Price: $6,721.50The above cost includes work done to the 2nd floor system in question, but it also includes necessary work completed to another rooftop unit for the first floorBoth rooftop units were in need of repair parts to bring them back to a correct manfstate Fan motors and fan blades were not to the manfspecs for the systems and needed to be replaced with ManfpartsThose parts were on these systems prior to Marston & Michael,Incworking on the equipment These repairs were completed 8/2016.Thank you for your timeIf there are any further questions, please feel free to contact me.Sincerely,*** ** ***

I have reviewed the response offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below.I would like to have the documents supporting that the "closet"  compressor has a current warranty with [redacted] for the older existing unit that feeds the office on the ground floor. At which time this case will be closed . Please note that I have replaced the failed unit with a new heat pump, installed by another contractor.
