Review: On May **, 2014, my wife and I made a check out for $500.00 for the purpose of holding a Lot at the [redacted] This was for the tentative purchase of the model home "Cambridge" which was currently and still being used as their Sales Office for the last nine years. The check only was supposed to be deposited if we enter into a contract after the hired Attorney's of both parties reached an agreement. There were many adjustments required after home was inspected to return the home to a single family dwelling from a Sale Office. Prior to the [redacted]) agreeing to sell this home, plans were already in place to update this particular home and relocate their Sale office to another model home. The counters, appliances, and faucets had already been removed prior to our offer. This also included the removal of all large showcase boxes, pictures, and display from walls, and the removal of many large nails and hooks. The offer went to both Attorney's and an agreement was never reached because the [redacted] no longer wanted to fix the roof that had leaked/damaged the ceiling in the Living Room. The [redacted] wanted us to pay all additional charges for a survey, Water Meter and tap, and the transfer tax ($4 per $1000.00 based on purchase price) which had never been discussed when price was being negotiated. The [redacted] also failed to have the Court Tax Records updated to reflect a CO on the finished basement which had never been reported during the nine years use as a Sale Office. We never reached an agreement and the deal went dead. However the Builder/Seller ([redacted]) cashed our $500.00 check on June *, 2014 at 10:09 AM. When we asked the [redacted] for our deposit back and why the check had been cashed. The Seller/[redacted] responded with NO, because work had already started on this home. However no contract was every entered or signed. This is unfair to any buyer and we want our $500.00 refunded.Desired Settlement: Since the [redacted]/Seller erroneously cashed our check which is unfair to any buyer, we want our $500.00 refunded as soon as possible.
