Breach of contract, and failure to resolve repair.Upon purchasing the vehicle I got there were a number of issues with it. Being disabled, and poor credit rating I was required to take a substandard loan. When complaints were filed against the company, they breeched their service contract under the Direction of [redacted]. Their business was hostile after learning of the complaints, and argumentative on correcting all of the issues. Once the issues were reportedly corrected they began showing up again within 60 days, and under 4000 mi. Also per [redacted] the service depart was deliberately directed to violate the terms of the contract for service signed based on complaints filed, with no real recourse to correct the issue. Instead of this company honoring their contract, they pawned it back to the consumer, myself, and gave no real resolution to the issue. I cannot get the vehicle properly serviced as provided by their contracts, which cost $2000, and the money has not been refunded, nor will they assume obligation to take the vehicle to another certified Jeep dealer.Desired SettlementI seek full recovery of the amounts paid for the service contracts, and or the vehicle. Continuation of the service per another dealer at HARR's expense, the full cost of gas for transportation to the other dealer, the cost of any and all rentals required to do such. The main dealership HARR to be put on noticed of the deceptive practices they are engaging in, as the Service Manager refused to book the appointments for FREE oil changes for one year; as required by the contract they set forth. Also a reduction of their rating with the Revdex.com.Business Response This customer continues to make false statements about the dealership. He can use his service contract at any Toyota dealership. Consumer Response Within the complaint of breech of contract. I was issued Value added Coupons for maintenance service specifically to be used at the HARR location containing agreement numbers, and no expiration date. Are these transferable to another deal? and if not should the savings and cost of these should be back charged to HARR. Also on the road side assistance program, it does state that they may choose to terminate the contract in writing within ten days of cancelation of said agreement, which was never followed through on. No documentation was sent, stating such. This would be an indicator of breech of contract. This service was to provided at no charge to me as the consumer. Failure to cancel the contract by their state terms, and being issues a prorated cost violates their said agreement. While the cost is built into the purchase of the vehicle, there is a cost associated with the maintenance offered with the contracted based on Free Oil Changes, and multipoint inspections. While I am happy to go to another dealership for all warranty services, and understand that the warranty is accepted at ANY jeep dealership. Programs specific to the HARR dealership would not be without prior without written authorization from them. This being the primary mode of transportation to medically necessary treatment in Boston, this cost would potential interfere in the maintenance of loan repayment, which when the vehicle was sold, it was stated that this service was offered to give reasonable comfort to the bank that being a high risk loan this would limit the possible liability of any late or defaulted payments. Currently the vehicle is in need of service, and to do so would apply a financial strain as they refuse to honor this part of the agreement. The request therefore is to allow for these services to be done at another location, and that they are to be held liable for the cost of said maintenance, and the cost of a third party roadside assistance program such as AAA for the one year or the 65,094 miles. This would conclude any and all business with this dealership.Business Response Mr. [redacted]'s "free maintenance" plan is a contract through Auto Care good at any Toyota dealership and his extended service contract that he purchased is also good at any dealership who takes credit cards. If Mr. [redacted] would like to cancel the contract he paid for he can by simply filling out a cancelation form and provide an odometer statement for a pro-rated refund. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Per HARR vechile purchase you are given oil changes for one year, and free car washes for life. I am well aware of the individual plan purchased in the amount of approximately $2000. A follow up complaint has been filed with the warrrenty company. They were requested by the Massachusettes state moderators office to fix the senors for the tire pressure, and passenger [redacted] heated seat. Both repairs have failed and I have the work orders saying they failed to actually to correct the issue properly, and this falls under the dealer as ordered. I also have a signed writen agreement by said company that the issue would be resolved. The brakes are failing after 5000 miles which could result in catastrophic failure. I am disabled and required to commute to boston (45 mi) away, and if failure occurs it may result in serious bodily harm. The vehicle is stated under the warranty as a 5 star used vehicle and this is not covered under said warranty, and is the sole liability of the dealership. The 5 star rating would indicate that all systems are road safe and could legally pass inspection, which this vehicle would not. With these facts in mind with all signed and agreed to contracts, which I can provide, they have breeched their contract and have failed to provide the level of 5 star as stated on the warranty. While they maintain that this is the responsibility of the warranty company the warranty company will not repIr these items as they are responsibilities of the dealer. Due to limited income these items can not be addressed properly, and a refusal to service the vehicle by HARR shows a failure to correct these issues which they openly admit too. They also fail to honor the discounts provided at the time of purchase for scheduled maintenance which coupons issued are required to be honored by law with no experation. I seek thT HARR pay for the services not properly completed under the contract they agreed to at the time of purchase, honor all discounts promised at the time of purchase, cost of all car washes for life, repairs to failing equipment on the vehicle at a separate dealership as they refuse to service or honor their contracts in anyway. These contracts are separate from the warranty purchase, which they should reimburse the cost of and cover all deductibles due to the items are not covered by said company. Durring these repairs they should be held to all costs of a rental vehicle to ensure that all medical and surgical procedures can be met. HARR has shown negligence in preperation of a road safe vehicle, honoring of signed contracts with their personal dealership while violating the terms of the warranty coverage. A complaint is also to be filed with the US Department of Justice for violating the ADA act of 1978. Business Response This will be the last correspondence in regards to this issue. Mr. [redacted]'s abusive nature towards the Harr employees has caused Harr to cease doing business with Mr. [redacted]. All coverage's are still valid with the underwriters of the policy and can be used at other authorized facilities.
