Revdex.com: I have reviewed the offer made by the business in reference to complaint ID [redacted] , and have determined that this proposed action would not resolve my complaint For your reference, details of the offer I reviewed appear below. The reason that I do not accept the offer is because [redacted] *** has failed to state the entire truth of the second contract In her response she has stated that if she used the figures from the contract that was dismissed by Credit Acceptance due to dealer negligence and deduct all fees and the total down payment of $I would still have a financing of 15, When calculating the figures I have in the contract I find this to not be true Also at the time of the 2nd contract [redacted] never mentioned that the price adjustment was due to securing of the second loan My first loan was not dismissed due to my credit It was due to failure of the dealership to produce the title I feel that the dealership is attempting to benefit from the fact that my second loan was signed at a lower rate As stated to me by a supervisor for CIG Financial the percentage rate that I was offered was based on my credit scorei The continuation of various reasons for non compliance of business ethics and customer service excellence is very disappointing and unacceptable When the first loan was rejected the proper actions that [redacted] *** should have taken as a dealer was refund the original deposit of $along with the $totaling $ This amount should have then been applied as a deduction the the 2nd sale amount of $16,The dealership also failed to honor my receiving of gas cards for customer referralsThere is also a falsification of odometer reading at the time of the 2nd sale which was bought to my attention by a family memberRegards, [redacted]

Mr. [redacted]In response to your complaint to the Revdex.com.First, after seven months and 18,200 miles, your engine was replaced. Harriet Salley Auto Sales paid $[redacted] on your total bill of $[redacted]. Please understand the courtesy was extended because you were a repeat customer as you were outside of the...

parameters of our company warranty which is 6 months/ 7,500 miles. Second, Harriet Salley Auto Sales does not have a mechanic however, we do use several mechanic shops in the area for repairs and you called us to get that information. We We usually recommend [redacted] or [redacted] located on [redacted] in [redacted] and [redacted] on [redacted].  Your warranty allows you to use any licensed shop. You chose to use [redacted]. If there is a problem, please contact them. Their number is [redacted]. Third, we spoke with the [redacted] Dealership regarding the additional repairs on the car when it was at their facility and again, we assisted with those repairs. Mr. [redacted], we try our best to assist with all our customers in ever aspect of car ownership. We are honest and we are fair and I feel you believe this or you would not have purchased three vehicles from us. Also, it would be helpful if you would complete the necessary maintenance on your vehicles when they are due. It's apparent that you do not and with that, I am unable to entertain helping you any further with any additional repairs.

I highly recommend Harriet Salley's Auto Sales to all who is interested in purchasing a vehicle. In all of my years in purchasing vehicles, Ms. Salley is rated number 1. It was a smooth transition all the way. Very professional and courteous; I will be back to purchase another vehicle from her establishment.

Firstly, [redacted] is correct: the original loan was cancelledbecause credit acceptance did not receive the title in a timely manner. Wesometimes purchase vehicles (from auction or other dealerships) without a titlewith the understanding the selling dealer will forward us a title as soon aspossible In this particular case, it took over 90 days for us to receive thetitle to this vehicle; through not the norm, it does happen.Secondly, we originally tried to secure a loan for [redacted]with [redacted] and because of her credit, she was denied. The only reason theygranted the loan on our second request was because we were sending two otherdeals from A+ credit customers. Simply put, the bank was told either take the[redacted] deal or we were sending the other two deals to [redacted].Thirdly, the vehicle odometer reading is the same on bothcontracts. In an effort to get [redacted] in and out in a timely manner and the factshe would be coming from work, I preprinted her paper work and failed to changethe odometer reading. That was simply an oversight on my party. Also, theadditional miles would have had no effect on the selling price of the vehiclefor [redacted] especially since she was the cause of the additional mileage. Finally, [redacted] stated we never sent a gas car for the twocustomers she sent to us. We usually mail out 2-3 cards per month for customerreferrals. Unfortunately, I have no way of confirming whether or not any cardswere ever mailed to her [redacted] can give me a call at [redacted] within five (5) business days of this memo to schedulea time to collect her gas cards for the two referrals.

DEAR MS. [redacted] : THIS IS IN RESPONSE TO YOUR COMPLAINT TO THE Revdex.com. ON JANUARY 31sr OF THIS YEAR, YOU SIGNED PAPERWORK FOR THE PURCHASE OF A [redacted]  font-size: 11px;">[redacted]. AFTER NOT RECEIVING THE ITEMS WITHIN THE TIME ALLOTED, WE ATTEMPTED TO CONTACT YOU BY LEAVING MESSAGES AT YOUR WORK, HOME AND WITH YOUR MOTHER. WE WERE LATER CONTACTED BY [redacted] (YOUR UENHOLDER) THAT YOU HAD NOT RETURNED ANY OF THEIR CALLS AS WELL AFTER SEVERAL ATTEMPTS, I WAS FINALLY ABLE TO SPEAK WITH YOU ON FEBRUARY 6TH AND YOU STATED YOU WOULD BE DELIVERING TO US THE ADDITIONAL ITEMS THE NEXT DAY. I ALSO STATED TO YOU, [redacted] WOULD NEED THOSE ITEMS FAXED TO THEM NO LATER THAN MONDAY MORNING, SO IT WAS EXTREMELY IMPORTANT WE HAVE THOSE ITEMS ASAP! YOU NEVER SHOWED UP, NOR DID YOU CALL. MONDAY, WE WERE CONTACTED BY NICHOLAS FINANCIAL TO LET US KNOW THEY WERE RESCINDING THEIR APPROVAL. WE THEN TRIED TO CONTACT YOU REGARDING THE RETURN OF OUR VEHICLE. THERE WAS NO RESPONSE FROM YOU; AND AT THIS POINT, WE ONLY WANTED THE VEHICLE RETURNED TO US IMMEDIATELY AND UNHARMED. IF YOU'D RETURNED THE VEHICLE, YOU WOULD HAVE BEEN ENTITLED TO A FULL REFUND OF YOUR DOWN PAYMENT MINUS ANY DAMAGES. THIS ENTIRE ORDEAL WAS VERY UNFORTUNATE AND WE FEEL WE DID EVERYTHING POSSIBLE TO ACCOMMODATE YOU AS WELL AS YOUR WORK SCHEDULE. Revdex.com:
I have reviewed the offer made by the business in reference to complaint ID [redacted], and have determined that this proposed action would not resolve my complaint.  For your reference, details of the offer I reviewed appear below. The reason that I do not accept the offer is because [redacted] has failed to state the entire truth of the second contract.   In her response she has stated that if she used the figures from the contract that was dismissed by Credit Acceptance due to dealer negligence and deduct all fees and the total down payment of $4437.32 I would still have a financing of 15,378.56.  When calculating the figures I have in the contract I find this to not be true.  Also  at the time of the 2nd contract [redacted] never mentioned that the price adjustment was due to securing of the second loan.  My first loan was not dismissed due to my credit.  It was due to failure of the dealership to produce the title.  I feel that the dealership is attempting to benefit from the fact that my second loan was signed at a lower rate.  As stated to me by a supervisor for CIG Financial the percentage rate that I was offered was based on my credit score. i
The continuation of various reasons for non compliance of business ethics and customer service excellence is very disappointing and unacceptable.  When the first loan was rejected the proper actions that [redacted] should have taken as a dealer was refund the original deposit of $2500.00 along with the $1937.32 totaling $4437.32.  This amount should have then been applied as a deduction the the 2nd sale amount of $16,180.64.
The dealership also failed to honor my receiving of gas cards for customer referrals.
There is also a falsification of odometer reading at the time of the 2nd sale which was bought to my attention by a family member.

DEAR MRS. [redacted]: I APOLOGIZE FOR NOT GITTING BACK WITH YOUSOONER, HOWEVER, IN AN EFFORT NOT TO HAND OUT ANYMORE INCORRECT INFORMATION TOYOU, I NEEDED TO MAKE SURE THE INFORMATION GIVEN WAS BOTH ACCURATE AND CORRECT.ACCORDING TO YOUR ORIGINAL PAPERWORK DATED NOVEMBER 09, 2013, THE FIRST...

LOAN ONTHE [redacted] HAD A SALES PRICE OF $17,995. AFTER ALL DMV FEES,PROCESSING FEE, GAP INSURANCE AND YOUR DOWN PAYMENT OF $2,500 YOU WEREFINANCING $17,290.11 (THIS FIGURE IS ACTUALLY INCORRECT. THE CORRECT FIGURE IS$17,315.88, WHICH Reflects BOTH THE AMOUNT SHOWING ON YOUR BUYERS ORDER AND THEAMOUNT WE PAID TO DMV ON YOUR BEHALF). THIS LOAN RESULTED IN A MONTHLY PAYMENTAMOUNT OF $484.33 FOR SIXTY-SIX (66) MONTHS. WHILE IN THIS LOAN, YOU MADE FOUR(4) PAYMENTS WHICH RESULTED IN A TOTAL AMOUNT PAID OF $1,937.32 $17,315.88 -$1,937.32 = $15,378.56 BECAUSE OF YOUR CREDIT, THE BANK THAT HELD THE ORIGINALLOAN WAS NOT OFFERING THE SAME TERMS AS THEY HAD IN THE BEGINNING; AND AS YOUHAVE STATED, NONE OF THIS WAS YOUR FAULT. HOWEVER, ANOTHER LOAN HAD TO BESECURED FOR YOU. ON APRIL 7, 2014, THE NEW LOAN PAPERWORK FROM A NEW BANK WASSIGNED WITH AN AMOUNT TO FINANCE OF $15,379 . THE PRICE OF THE CAR WASDISCOUNTED TO ALLOW FOR THE AMOUNT TO FINANCE. IF WE WERE TO USE THE ORIGINALNUMBERS THAT WERE USED IN THE ORIGINAL LOAN, $17,995.00, ADDED ALL THE FEESTHEN SUBTRACTED $4,437.32 (YOUR ORIGINAL DOWNPAYMENT OF $2500 PLUS THE$1,937.32 WHICH IS THE AMOUNT YOU PAID FOR THE FOUR MONTHS) THE AMOUNT TOFINANCE WOULD HAVE BEEN THE SAME, $15,378.56. COUPLE THIS WITH A LOWER RATE OF18.99% (OPPOSE TO THE 24.99% RATE ON THE ORIGINAL LOAN), BETTER TERMS OF 48MONTHS (OPPOSE TO 66 MONTHS ON THE ORIGINAL LOAN), LOWER PAYMENTS OF $459.78 (OPPOSETO $484.33 ON THE ORIGINAL LOAN) AND FINANCE CHARGES OF $6,690.44 (OPPOSE TO$14,675.67 ON THE ORIGINAL LOAN) AND IT FELT LIKE A WINNING SITUATION FOR THECONSUMER. MRS. [redacted], THE GOAL WAS TO PUT YOU IN THE SAME OR A BETTER POSITIONTHAN YOU WERE ORIGINALLY IN. AGAIN, WE FELT WE DID THAT. BY NO MEANS WOULD WEJEOPARDIZE OUR REPUTATION OR THE REPUTATION OF THIS COMPANY FOR ANY AMOUNT OFMONEY LET ALONE, $2500; HOWEVER, IF YOU HAVE ANY ADDITIONAL QUESTIONS ORCONCERNS YOU CAN GIVE ME A CALL OR YOU CAN COME BY, l'D LOVE THE OPPORTUNITY.

The customer contacted Revdex.com to state a settlement was reached with the business and it has been accepted as a resolution.

Review: In February of 2015, I filled out the paper work, gave Ms. [redacted] the documents that she requested at that time and a deposit of $750; which was half of the deposit to purchase a [redacted]. The agreement was to pay the remaining of the deposit in 30 days. Ms. [redacted] let me drive the vehicle off the lot stating that it was mine. Ms. [redacted] called and stated that she needed more verification documents, I stated to her based on my schedule I would not be able to give her the document until 2 days later. After having the vehicle for less the 5 days Ms. [redacted] came to my home and took the vehicle back. The vehicle was taken back to her car lot which is less then 5 minutes away from my home. I was very irate and asked for my deposit back. She said I had to return the key, I told her that I would return the key after I received my deposit, and my belonging from the vehicle. I received a letter in March from Ms. [redacted] stating that I would not receive any of my deposit with unfounded charges for the reason. I did not have the car for a week and it was not my fault that she did not follow protocol in finalizing this deal. I Think this is very unfair to me and outrageous practice for someone to take advantage of someone else. Seven hundred and fifty dollars may not be a lot of money for some people, but I worked very hard to save that money for a down payment on a car and she just stole it from me. I hope your office will be able to help me to receive my full refund from dealership. Thank you for your assistance in this matter.Desired Settlement: I would like to receive my full refund from this dealership.

Review: I leased a [redacted] from Harriet Salley April 27, 2013. The transmission is not working and I am not able to drive the van. A week after I got the van the check engine light came on and the brakes squeaked. I came back to her shop within my 30 day warranty to let her know that. She referred me to her mechanic who told me the check engine light had to do with the type of gas I was using and the brakes squeaked because they were rusty. I took his word for it and unfortunately didn't get anything in writing. The van started jumping into gear December 6, 2013 but it was still driving. By December 20, 2013, for fear of the van stopping and me and my child being stuck in the middle of highway, I stopped driving it and have been in a rental car since December 22, 2013. I was finally able to get it to a mechanic on January 3, 2014. A family friend who referred me to this dealer called [redacted] and told her the trouble I was having. I didn't contact [redacted] because I knew she wasn't going to do anything and she would give me the run around. The cost to repair the transmission is over $2500.00 and I feel as an act of good faith the dealers should pay for the repairs. I understand the car was Used. I was told due to my credit that was the only vehicle she could sell me; however, after driving it for only 8 months, I shouldn't have to pay for this type of repair and make monthly payments on the vehicle. My last phone communication with [redacted] was on Wed. 01/22/13. She knew my van was at an auto repair shop and wanted to put me in another vehicle. She wanted me to give her a down payment or get a cosigner. When I told her that I would not have a down payment because my money was going into the rental car and that I was not going to get a co-signer, I asked her what could she do to help me. [redacted] gave me a number to the same mechanic who looked at it months earlier and told me at my expense to have the van towed there and she would see if she could help me. I told her that my car was already at a mechanic's shop. She proceeded to tell me that she works with people she trust and she didn’t' know the mechanic that I had my van at. I then thanked her for her time, said good bye and hung up. That let me know that she didn't want to help me and had no intentions in doing so.Desired Settlement: [redacted] pay for the transmission my [redacted].

[redacted]:

I have read the complaint you submitted to the Revdex.com and would first like to clear a few things with you before I go any further.

An apology is in order I should have persisted you purchase the extended warranty. I sell used vehicles and though we use licensed technicians to fully check all vehicles before they are placed on the lot for sate, we have no way to predict a custome(s driving habits as well as the care they give to the vehicle once it is sold. A warranty could have helped in this situation.

I am unable to help if I don't know Earlier this year, you came in to trade your [redacted] and never mentioned a problem. In fact, I specifically asked if there were any issues with your trade and you said there were none. In addition, it was your friend who called regarding the transmission problem weeks after you left the dealership. All of the vehicles have a 30 day/l,OOO mile warranty on the engine, transmission and the rear end. Su rely, had I been informed of a transmission problem within that time, it would have been repaired or replaced. I have enclosed a copy of the warranty for your perusal. Also, [redacted], I don't understand why you would have continued to drive the van knowing there was a problem and then contact me after the van is no longer running.

A down payment or a co-signor could help As I have explained to you before, whenever anyone is tradlng a vehicle and there is negative equity coupled with less than perfect credit, it is beneficial for that person to have some sort of down payment and/or a favorable co-signor. The down payment can help "pay down" the amount you are financing and the cosignor can sometimes allow the banks to offer a lower interest rate. Either of these would have helped in your situation offering a lower monthly payment. The selli ng price of your [redacted] was $5995, which allowed you a $221 per month payment. Without a down payment or co-signor I am unable to keep your monthly payments at $221. I agree, the month Iy payments are affordable and it's much more convenient to leave the vehicle for repairs where you are familiar. I will offer you $500 against the completed transmission repairs on your [redacted].
