by law, dealers are given up to days to file the fees to DMV and then we go based on first appointment given to us based on the number of files we turn in to DMVduring High volume seasons, getting appointments is not as easy because all the dealers in our area must only turn in their registration paperwork to one place which there is only one and one office available for thatsoon as DMV received the paperwork, then they are allowed up to days to finish the process and that is under condition which meaning on a truck like that, we must have California title, in California prior registration and California smogonce in a while we run in to vehicles who are holding out of state titles, whether the bank they were using was out of state or maybe the vehicle was brought in from out of state as dealers inventory or sometimes even shipped out to out of state and registered and titled thereunder that condition, us as the selling dealer of a vehicle is very well aware of the situation therefore we go ahead and have all the proper paperwork ready for filling after the salepaperwork could be such as , DMV vin verification, California scale weight certificate, smog depending on the gross vehicle weight and such and suchin this very particular case, vehicle had California title and license plate but at some point it was taken out of state during it previous owners ownership and gotten registered in an state outside of Californiawell, DMV caught that very late after us filling the paperwork with them at very last minute and this is when later after we dropped off the paperwork and washed our hands thinking that is all we need to dolater on, almost to the dead line, we received the paperwork back saying we require all the items above mentioned for vehicles coming from out of state such as Weight Cert and Vin verificationat this point, customer has the position of the vehicle, time is ticking, and DMV is asking for more paperworkat this point since customer had the position of the vehicle, we would have to call the customer for these additional paperworkwe have made multiple attempts trying to have customer get those paperwork for usin an attempt to provide a faster customer service, we even offered to go there, pickup the vehicle have all of the above done and then bring it back to them but they refused to do such a thingwaiting patiently for the client to send us the paperwork, we find out too late that those paper were accidentally handed over to the customers local DMV by the client, instead of it being mailed to uswhy? because customer in his mind thinks, whats the purpose of me giving this to the dealership if it is going to jeopardize the integrity of the signature at the bottom of the VIN verification but he didn't realize that all the paperwork must be filed together(customer at this point insisting insisting of you do your thing and I do my thingnot to mention that in his conversations he believed just because he bought so many vehicles in the past now everything must be same way)this whole entire time, desperately waiting for the paperwork keep trying to file our own paperwork not getting anywhere, we finally got a call from the head quarters saying that finally they received those two pieces of letter from customers local DMV and now its in a created file at the headquarters and now we can go to our dealer portal office and file it againwe made several attempts after that but our local office refused to take the paperwork from us simply because they believed we should have everything in dealers position to turn it in and somehow their system wouldn't accept it from uswe finally after 4-months found a Lupe hole and took it in and was able to get the paperwork to the headquarterat this point, as of 09/07/a DMV technician have processed the paperwork and now its gone to pre screening to clear hoping that it will clear by the end the week of Sept 11th half of these issues were created because customer chose to hand in those two pieces of paperwork to their own DMV which was not the place for them to get turned in towe hope we were clear enoughThe other half is blamed on the state of California for requiring additional paperwork on a vehicle that had existing California titleThanks

we don't really know the exact reason why there is even a complain in this caselast we spoke to the shop, there is no balance due and customer did not pay for the repair and wasn't charged for itwe have also found out that the shop ate the cost because they haven't perform an accurate diagnostic of the vehiclethis is [redacted] we are speaking ofas a rule of thumb and in accordance with the automotive repair act of 1971, a customer is entitled of 1) a written estimate for repair work2) a detailed invoice of work done and parts supplied3) return of replaced parts, if requested at the time a work order is placedwe believe [redacted] has failed providing any of the above items if any money was paid at the time of repair to [redacted] *** which is indicated in customers demand, we would like a copy of the receipt of that transaction dated that day plus a copy of either a cancelled check or transaction report so that we can reimburse the clientpayments paid in cash will not be acceptedfurther necessary verification will take place

lets not use the phrase lie directlythe registration should be all done by now according to Mr *** ***d at the Headquarters of DMVwhether if it's something you are looking for or not, in this case the paperwork had already been completed and it is out of our handyou can go directly to DMV and complain to them because that is what they are telling us

I am rejecting this response because: First of all, the trade in I brought had the spark plugs replaced at a *** dealership one week prior to trade inAt this time I was advised of a knocking sound and informed by *** that it is possibly the cam phasersThe truck ran with no problems for a week with "a blown engine" as Zoom statesI do not claim to be an expert in autos and simply relayed information I was givenZoom states "knowing it had a blown engine" and I "swear to God" that it was a timing issueI don't swear to anyone and never didAgain, I'm not a mechanic and was only relaying informationZoom claims "failed inspection" with a "blown motor" prior to the trade in offerThe truck never left the parking space I parked in on arrival at ZoomThe alleged inspection consisted of running the engine and listening for approxminutesNever driven and no hands on the motorThe trade in is not my issue with Zoom however. Zoom also stats the price of the purchased truck was marked down to meet my satisfactionThe list price was $17,and they sold it for just over $19,Not sure how that is a significant mark downAdditionally, Zoom should re-read the complaint before making completely unproffessional and insulting statements such as "the power steering repair does not cost 4-thousand dollars in repairs even a year old kid will know that…" I calculate life saving medication doses in split seconds for a living and am confident in my math skills thank youI was referring to the oil leak you sold me the truck with coming from between the engine block and oil panAgain, re-read the complaintI have the estimate of four to five thousand dollars, JUST IN LABOR, to repair thisI also have the invoice from Folsom *** where you declined repair of the power steering leakAs for warranty, I asked for one and *** stated "we don't offer ANY warranties, but you can pay to bring it back in two days." Yes, you offered to "look at the truck" with no guarentee to fix anything and no, that was not a satisfactory offer. Lastly, when dealing with *** and asking questions about the truck he was stating "it's a solid great truck with only one ownerYou will not have problems after our inspectionIt is diesel and wil last a long time." Now you just gave evidence of your dishonesty by contradicting yourself in your Revdex.com response when you stated "one must know not to buy a ***" and "Fords are sold super as is." I don't recall seeing a "super as is" signYour unproffessionalism is demonstrated even further when you state "this customer did not pass the attitude test." Why? Because I am standing up for my consumer rights? Since the purchase I have found numerous sites full of complaints against Zoom and I am not the first one with the Revdex.com in the short time Zoom has been in businessMy regret is not researching them prior to my purchaseI am left with a $19,000+ truck in need of $5,in repairI will continue to pursue Zoom Motors with legal representationThe diagnosis of a blown engine by listening and dishonesty during the sale of the Fleaves me no reason to trust them. -*** ***

I am rejecting this response because: The response is mostly liesZoom motors let the paperwork sit on their desk for over months until I called them because my temporary was expiringAt thus point they told me of the bin verification form requiredI took the truck to my local DMV to file thus formAt that time DMV told me of the required weight tagSo we got that done as wellBoth papers where completed and entered into the DMV database in Reedley CANever did zoom motors offer to do any of the paperworkI am now approaching months and still do not have paperwork or plates

Zoom Motors denies any wrongdoing in the sale of the 2005 [redacted] F 250 Super Duty pickup truck (“Vehicle”) to Mr. [redacted].Your clients allege that; 1) the vehicle was misrepresented as having been mechanically inspected and that it was not, 2) the vehicle had a blown cylinder head 3) the vehicle had an oil leak. The Buyer’s Guide also advised your clients that they were entitled to conduct a pre-sale inspection of the Vehicle either on the lot or off but they chose not to.Pursuant to California Civil Code Section 1792 et. seq., a vehicle may be sold without warranty if the consumer is notified that no warranty is available. We have purchased a [redacted] report of the vehicle.   The report shows that the Vehicle was a one-owner truck and that on December 18th, 2015, it was inspected and serviced at [redacted], CA.  The service record indicates that the cooling system was checked, the fuel injection system was serviced, and at the end, dealer suggested the power steering hoses to be checked.  I personally confirmed this information with Future [redacted].  Total miles on the Vehicle at the time of service was 146,945. at this time vehicle was taken in to a local shop for further repair at the dealerships desire. no one can tell anyone where to repair their own vehicle and at this point, dealer "Zoom Motors" chose to have [redacted] look in to the power steering issue. at this point vehicle got checked, inspected, issue was taken care of and at the end vehicle passed smog and safety with the flying color. There was no breach of contract.  ZOOM sold the [redacted]s a 2005 F250 6.0L diesel truck.  The price and terms were freely negotiated and agreed to by the parties. There was No Blown Engine at the time of the purchase since Zoom Had the vehicle inspected by Future [redacted] of Sacramento, CA prior to selling of 2005 [redacted] F-250.The Existence of the Sign in the office of Zoom Motors Saying "everything sold as is [redacted] sold Extremely as is" is a fact and pictures been taken by previous customers as well. we do have live cameras to prove that the sign existed at the time of the purchase. The suspected damage to the Vehicle is unfortunate.  However, a buyer is charged with properly inspecting a vehicle prior to purchasing a motor vehicle, especially one driven more than 146,000 miles.  Buyers are also charged with reading their contracts and Buyers guide.Zoom at this point is not trying to blame the customer for the bad condition of the trade but instead strongly believes that it was a fair deal overall for Mr. [redacted] since customer definitely knew the existing condition of his daily driver. At Zoom motors vehicles get inspected by a third party mechanic such as Cooks auto repair, then they get to be taken to franchise dealers for any specialty diagnoses. in this case this was one of the vehicles that was taken to [redacted] dealership for work and there was no sign of a blown engine prior to the sale of the vehicle.Summary:Buyers are also charged with reading their contracts and buyers guide, both of which in this case are As Is.Your client have been highly advised to have the vehicle brought in so that we can have [redacted] inspect it and for one reason or another Mr [redacted] have denied our request. Zoom Motors can only do so much as to in order for providing a better customer service and the rest depends on the client itself. in this case Zoom Motors believes that our employees have done what they could in order to help out this client and the client just refused to co-operate at the point of the first complaint.  Thanks. Zoom Motors.Sales Team

of the vehicle. this is [redacted] we are speaking of. as a rule of thumb and in accordance with the automotive repair act of 1971, a customer is entitled of 1) a written estimate for repair work. 2) a detailed invoice of work done and parts supplied. 3) return of replaced parts, if requested at the time a work order is placed. we believe [redacted] has failed providing any of the above items.  if any money was paid at the time of repair to [redacted] which is indicated in customers demand, we would like a copy of the receipt of that transaction dated that day plus a copy of either a cancelled check or transaction report so that we can reimburse the client. payments paid in cash will not be accepted. further necessary verification will take place.

We really don't understand what this customer is trying to establish here although the vehicle was sold to him as Is and he had signed additional forms and statement of facts regarding the condition of the truck and the way it was sold to him at the time of purchase however there are always two side...

to every story and it is good to hear both side. this customer brought in a trade on the day of purchase in it's most poor condition knowing it has a blown engine and it also failed our inspection at the time however we agreed to take his word for it and take the vehicle in and paid him above and beyond of what the vehicle was worth with blown engine not to mention that he swears to god that there is only a 500.00 dollars repair issue with the timing system on the vehicle that causes the knocking noise turned out it had blown lower unit of the engine later on that week. this is the condition of his trade in. at this point zoom motors offered him 2 more thousands of dollars on the trade above what we usually offer for any other car within that condition at the time of trade just to keep him happy.  the vehicle he purchased was discounted significantly to gain his satisfaction although it could potentially sell at a lot higher price on a different day with more profit. at the time of the sale, he asked for any work that may have been done while the vehicle is in dealers hand prior to the sale of the selling vehicle which in this case we are referring to the 2005 ford f250. on our wall we have a sign saying, "Everything is sold As Is and fords are sold super As Is." one must know not to buy ford after this must negative talk about the brand. we offered him warranty and he had declined the warranty at the time of the sale signed by him at the bottom of California legal form of " California vehicle product sales disclosure" . the vehicle had no issue with any leak because during the process of the sale, we clearly as we have it on the wall of our office, also state that customers more than welcome to have the vehicle inspected by the third party company as they wish for. obviously he bought the vehicle because he felt that the vehicle passed his inspection otherwise why would you buy it. we sale everything "AS IS." even our [redacted] is being sold AS IS. not because there is anything wrong with them, only simply because we want our customers to have the choice of making their own decision by really getting the vehicle checked out.  his trade was a ford which was problematic, he bought a ford that he thinks might have problems.  with all of that being said, soon as we heard the complaint all all the criticism of how wrong of a practice we do and how much of a fraud business we do, we still offered him help. we even said to take the vehicle to Cooks Auto Repair and have them check it in under his name because after the sale, legally we cannot touch customers vehicle as the BAR recommends.   the last email that was sent to this client clearly indicate how much effort we were willing to put in it in order to make this good. we have clearly offered to help but customers response was " No I Don't Trust You Guys" also, we have noticed in pictures that were taken by the customer, those electrical tapes refereed to as are for a different component on the vehicle. we have clearly indicated in our email to our client that it is not to late still. please let us know if you want us to have cooks auto repair to schedule a time for you to stop by. we did not refuse giving our client service after the sale however, in fact he simply  denied to accept our service and jumped the gun instead and filed a complaint with Revdex.com.  -this customer did not pass the attitude test to begin with therefore one would say not to offer him any service since the vehicle was sold AS IS.   -the was no power steering issue with the vehicle at the time of the purchase otherwise he wouldn't be able to get out of the lot or even test drive it. -no power steering pump high pressure line can be fixed by electrical tape which customer have mentioned in his emails demonstrated with pictures. we have explained to the client that hole in power steering pump or line, due to the high pressure will not be cured with an electrical tape therefore it would have leaked all over.  -the power steering repair does not cost 4-5 thousand dollars in repair even a 5 year old kid will know that so lets not make a bid deal out of it.  -we don't belong to Revdex.com however we are making any effort to respond to you guises request.  -in the future we will make sure this whole as is process explained to customers in more advanced way to help customers better understand what AS IS means.  - we also have copies of all emails and offers submitted to this customer for review. please fell free to email anytime. Thanks, [redacted].

registration paperwork to one place which there is only one and one office available for that. soon as DMV received the paperwork, then they are allowed up to 60 days to finish the process and that is under normal condition which meaning on a truck like that, we must have California title, in California prior registration and California smog. once in a while we run in to vehicles who are holding out of state titles, whether the bank they were using was out of state or maybe the vehicle was brought in from out of state as dealers inventory or sometimes even shipped out to out of state and registered and titled there. under that condition, us as the selling dealer of a vehicle is very well aware of the situation therefore we go ahead and have all the proper paperwork ready for filling after the sale. paperwork could be such as , DMV vin verification, California scale weight certificate, smog depending on the gross vehicle weight and such and such. in this very particular case, vehicle had California title and license plate but at some point it was taken out of state during it previous owners ownership and gotten registered in an state outside of California. well, DMV caught that very late after us filling the paperwork with them at very last minute and this is when later after we dropped off the paperwork and washed our hands thinking that is all we need to do. later on, almost to the dead line, we received the paperwork back saying we require all the items above mentioned for vehicles coming from out of state such as Weight Cert and Vin verification. at this point, customer has the position of the vehicle, time is ticking, and DMV is asking for more paperwork. at this point since customer had the position of the vehicle, we would have to call the customer for these additional paperwork. we have made multiple attempts trying to have customer get those paperwork for us. in an attempt to provide a faster customer service, we even offered to go there, pickup the vehicle have all of the above done and then bring it back to them but they refused to do such a thing. waiting patiently for the client to send us the paperwork, we find out too late that those paper were accidentally handed over to the customers local DMV by the client, instead of it being mailed to us. why? because customer in his mind thinks, whats the purpose of me giving this to the dealership if it is going to jeopardize the integrity of the signature at the bottom of the VIN verification but he didn't realize that all the paperwork must be filed together. (customer at this point insisting insisting of you do your thing and I do my thing. not to mention that in his conversations he believed just because he bought so many vehicles in the past now everything must be same way). this whole entire time, desperately waiting for the paperwork keep trying to file our own paperwork not getting anywhere, we finally got a call from the head quarters saying that finally they received those two pieces of letter from customers local DMV and now its in a created file at the headquarters and now we can go to our dealer portal office and file it again. we made several attempts after that but our local office refused to take the paperwork from us simply because they believed we should have everything in dealers position to turn it in and somehow their system wouldn't accept it from us. we finally after 4-5 months found a Lupe hole and took it in and was able to get the paperwork to the headquarter. at this point, as of 09/07/2017 a DMV technician have processed the paperwork and now its gone to pre screening to clear hoping that it will clear by the end the week of Sept 11th 2017. half of these issues were created because customer chose to hand in those two pieces of paperwork to their own DMV which was not the place for them to get turned in to. we hope we were clear enough. The other half is blamed on the state of California for requiring additional paperwork on a vehicle that had existing California title. Thanks.

I am rejecting this response because: Issues at hand as described by Zoom Motors are inaccurate. Zoom did not get motivated about paperwork until I called asking to get me paperwork or allow me to return the truck. At this point Zoom finally started working on it after patiently waiting more than 12 weeks. Zoom then took the paper work to DMV and at that time told us WE needed to provide a vin verification. We did this within 3 days of being told this and our local DMV called the sacramento office and told my local DMV how to handle the paperwork and after completing the vin verification form entered the form in the dmv database and printed us a receipt that vin verification had been completed. At that time DMV told us we needed a weight tag. We then completed and turned the paperwork as requested by DMV. I scanned and emailed this information to Zoom Motors as I was told when DMV kept and filed the original documents as they were told from the sacramento office. The scanned document then sat in the email INBOX for two week when I called Zoom Motors to confirm that they had gotten the email. After several minutes the Zoom Mtrs rep found the email in his inbox. Zoom has drug this process along only moving on the issue when I call and get mad. We have now had almost 4 weeks after my last confrontation with zoom. Four weeks since Zoom had DMV call me to verify that everything was in order. (I have no way of verifying that I was called by the Head of DMV as I was told). But four weeks after that call I still sit here today now over 6 months after the purchase with no registration, title or plates. They deposited my cashiers check for the total amount due almost immediately. Zoom can blame DMV and me all they want. Our deal was that I give them money, they sell me a vehicle and do the paperwork giving me a clean title registration smog and license plates. They have not kept their end of the sales transaction and are in breach of contract. The customer service rep at Zoom told be I should file a complaint and maybe that would speed thing up. Under no circumstances should I be sitting here at 6 months without registration documents.
