This complaint has already been handled. Our contract does state "if any wood is rotten it will be replaced at an additional cost to the owner of $X (depending on size)  per lin ft". It must state this as we can not tell if the wood is rotten until we get the  gutters down. Harry met with...

[redacted]. [redacted] on the 20th of February and showed her by hitting the wood with a hammer that is was not rotten that some paint chipped had chipped off. Harry agreed to have her fascia boards covered with .019 vinyl coated coil stock for aesthetics look and it was done that day at no additional charge. She paid the balance of the job the next day and we provided her with a warranty on her receipt. We believe everything is good on both sides of this job.

Review: The contractor has given me a written estimate/proposal to furnish/install new 5" K style gutter, furnish/install 20" of new 2"x3" downspout, replace rotten fascia wood at $5.75 per lin ft using #1 lumbered 1"x6" for a cost of $750.00. I signed the contract and gave a down payment of $300.00 as deposit to get the job done. The job was completed last week. The contractor sent me a bill for $450.00 as payment for furnishing/installing new 5" K style gutter, 20' of 2"x3" downspout and cleaning and tightening gutters on rear of the home. The other part of the job of replacing rotten fascia wood was not done as per written statement from the contractor. I called the company and spoke to [redacted] (contractor) who stated that "we completed the job as stated in the contract and we did not replace the fascia because it was not rotten. It just needs painting. If I have to replace the fascia, I will charge you $5.75/lin ft which will be about $175.00 extra". I told him that the contract did not state 1) that the fascia will only be replaced if found rotten, 2) extra charges apply if the fascia is replaced. I was deceived by them because I was under the impression that the fascia was rotten and it will be replaced with the cost of installation included in the price stated in the contract. Apparently, [redacted] told me that he did not use a ladder to look at the problem when he did the estimate, he just wrote that statement which he said is generic to all the contracts that he has written. I now feel uncomfortable that the gutter that they placed will fall off because of the rotten fascia that was not replaced. I had three contractors to look at the gutters and chose them because of the proximity to my home, the description of the job that they are going to do, and the cost. They did not even have any warranty for this job because I was told that the company does not provide for one. The contractor FAILED to deliver and fulfill the job that was written in the contract.Desired Settlement: I would like the company to honor the written contract and to provide me a warranty of 1 year for the job done.

Review: While working on the building I live in, Harry and Sons contractors have hit and seriously damaged my car. I have reported this to the management company who contracted Harry and Sons and one of their employees came out to take a look at the damage, but wouldn't do anything about it.

I am a 100% sure Harry and Sons white truck had hit my car. There was no damage on my car the night before, but it was there in the morning, when Harry and Sons truck was parked in front on the building, very close to my car. They have been seen by two neighbors that morning parked in our driveway from which direction my car was hit by a white vehicle since there are white markings- white paint on my red car. My car was legally parked directly at the exit of the driveway. There were no other white painted vehicles at that time parked in the driveway or parking spots behind it. When asked if they parked in the driveway the morning of the damage, the workers lied, saying they parked on the street, even though two neighbors saw them parked in the driveway. They probably had to move their truck out of the driveway for a car behind the building to get out, hit my car, then parked on the street and pretended they didn't hit it. The fact that they lied where they parked, that their truck was the same color as the markings on the damaged car, and the position of my parked car versus the driveway makes it a 99% that they hit and damaged my car. Two neighbors are willing to give a statement that Harry and Sons lied that morning about where they parked their truck. If they didn't damage my car, why would they lie?Desired Settlement: Harry and Sons should repair the damage they caused at a contractor of their choosing or pay me for the estimate on the damage I have received from the body shop in the neighborhood of roughly $800.

Response:

This claim has been investigated and found to hold absolutely no legitimacy. We were contracted by [redacted] management to replace a small balcony roof. Our truck had driven into the back parking area to unload into the back parking area. Neither employee on the job site is very good at speaking English although very intelligent and very trustworthy having come to us with legitimate accidents before. We were notified about this damage and sent our vice president to inspect. We were aware there was another white much smaller work truck in that same driveway that very morning. Our vice president went to the job with the two employees and the the vehicle they were driving that day. Upon inspection We pulled the vehicles next to each other and it would have been impossible for our vehicle to have made that damage. It was obvious our vehicle could not have stuck this car as our vehicle was a good 6" higher then the damage on this car and the complainant acknowledged this. We have no problem covering damage when it has been done by us. But this was obviously not done by our vehicle (which was clear of any damage, scratches or paint). We would be more than happy to let them take this to court simply out of principle. This matter was put to bed a while ago and for this to now be falsely reported to Revdex.com is foolishness.

I am rejecting this response because:

The statement I read from Harry and Sons is simply false.
