I am writing in response to the complaint filed by *** ***. I have carefully reviewed our file and offer the following in response to your inquiry: On May 4, 2016, I spoke with *** *** and fully resolved all issues presented. I sincerely apologized for the service he
had been provided which included a delayed coverage determination. During our phone call, I provided accurate and detailed information regarding the policy and endorsements carried by *** *** *** ***. Following our additional research and communication with *** ***, The Hartford has declared it will restore the building damages to their condition as was prior to this loss. The policy for *** *** *** *** includes the following endorsement, ** ** ** ** ** *** *** ***. This endorsement revises the language included within the standard policy form. Further, the intent of this form is to identify the insurance responsibilities of the *** Association and those of the specific Unit Owner(s). Without By-Laws or Declarations that outline each party’s responsibilities, we were unable to make a prompt and accurate coverage decision. After reviewing additional resources found under *** *** *** *** ** *** *** *** *** ***, we were able to conclude our investigation and declared full coverage for the building damage presented herein During my phone communication with *** ***, I also reviewed the claim process. The Hartford will provide *** *** a complete estimate for the necessary repairs. We have also agreed to engage a preferred contractor to provide him a secondary bid for the scope of repair. *** *** desires additional bids to make a fair selection and we support that action. *** *** is free to select the contractor of his choosingIn regards to the business income portion of the loss, we regret that inaccurate direction was provided to *** *** which led to unnecessary confusion and delay. *** *** confirmed that his business is insured through another carrier, separate from the *** Association. With this information, we have determined that the business income portion of the loss should be processed by that carrier and advised *** *** of the sameWe are glad to have resolved the issues presented and look forward to providing continued assistance to *** *** and *** *** *** ***
