Dr. Gary Hartman's staff took XRays of our eight-year old child without parental consent even after we explicitly said no to any testing for this consult visit.

The patient's mom only refused a CT scan, and then stepped out of the room to take a phone call. Our dental assistant took a single tooth x-ray, otherwise the consultation would not have been continue without knowing the tooth position. We have apologized for the miscommunication, reversed all charges for the appointment, and provided all information (including our dental assistant's certifications) to the patient's mother. Again, we are very sorry about the mix-up but no one in our office treated this patient (or her mother) poorly or with harmful intent.

I disagree on any miscommunication between my self the mother and the dental assistant. I clearly refused the CT Scan and told her no testing done, they can get a copy of the XRays from either the referring dentist, *** and or *** which they had agree to do so prior to me scheduling this appointment. The X-rays from the referring doctor were taken less than a week prior to this visit and Dr. Hartman's office was made aware of this, further, I had signed a release form so they can obtain a copy. The dental assistant did not ask for permission to take X-rays at all, I strongly stand on this position. Further her certificate came from a for profit school that has gone out of business and did not have the credentials to meet the standards for this assistant to obtain limited X-ray technician license. I do accept their apology but I completely disagree that the consultation could not take place because they agreed to obtain a copy of the X-rays already taken prior to this appointment from *** office. Again I affirm without getting consent from the parent no testing should be done, because its negligent and malpractice actions on their part.
Again, we apologize for the miscommunication, we have reversed all charges for this appointment, and provided *** with proof of my assistance radiation certification, there is noting more we can do. Unfortunately, we can not go back & not take the x-ray. Again, this was not done with malice or harmful intent.
We stand by the fact that our dental assistant, ***, a 12 year veteran with our office, is "certified" to take dental x-rays. As previously explained to *** dental assistance are not licensed providers, they are certified. Therefore will not come up in the Limited X-ray Technician Database available online.
From the Virginia Board of Dentistry's website:
"8. How do I obtain Radiation Certification?
You may place or expose dental x-rays after completing one of the following three training options:
1. Satisfactorily completing a course or examination recognized by the Commission on Dental Accreditation of the American Dental Association,
3. Becoming certified by the American Registry of Radiologic Technologists, or
4. Satisfactorily completing a radiation course and passing an examination given by the Dental Assisting National Board."
*** met this standard in 2005, and has been working with my practice since.
Again, we are sorry for this incident, we have done everything we can to correct this issue with ***. At this time, I do not know what else can be done or said to satisfy ***'s compliant. In 15 years of practice, I have never had a claim against my practice with the *** or any other organization before.
