concise I have bullet pointed the issues: 1. The contract for the construction of the home for the [redacted] family was executed on June 30, 2017. We average 30 days from time of contract to time of start of construction of the home, depending on the urgency of the customer. In this case things were delayed as the [redacted] were looking for HOA approval for an improvement (a building) they were planning to install after closing on our home. This delayed the start of the home by one month. 2. We never promise closing dates. It is very clear in our contract, which the [redacted] signed, that due to weather and a lot of other factors outside of our control that we never promise closing dates. I have attached that page of our contract, which has the [redacted] signature at the bottom of the page. 3. Like everyone else in the greater Houston area we have been dealing, and continue to deal, with labor and material shortages due to the incredible natural disaster (Hurricane Harvey) which devastated a lot of homes in our city. We have seen our build times, as has every other builder in town, extend out quite a bit. Understand that we borrow the money to build our homes, as does every builder, and as such time is money for us (delays cost us) and we work diligently to get the homes completed in a timely manner. It is clear in reading the contract, which the [redacted] signed, that we have invested a sizable amount of money to build a home just for them, and their decision to not move forward means that they are forfeiting any and all earnest money and option deposits put up. That being said, we are sympathetic to their situation and are willing to work to what we feel is a fair middle ground on this deal. We are willing to refund the option deposits put forth for any of the options which were not yet installed or ordered at the time when the [redacted] decided to cancel the contract and walk away. I have pulled the numbers and this would mean a refund to the [redacted] of $7,354. Again, to be clear we are well within our contractual rights to retain the entire $18,210. We understand the customer’s situation and we want to offer this olive branch to the [redacted]. If they are agreeable to this please let me know and I will process the refund in the amount of $7,354 and will have that mailed to the [redacted]. Thank you, Dave [redacted] Division President
