Mr. [redacted] called the nursery in July of 2015 to tell us that his persimmon tree was not growing as well as his neighbors and he wanted his 12" tree replaced with a 30" tree. According to him, his neighbor's tree was flourishing while his was not growing as well. Persimmons take the longest... to break dormancy, sometimes remaining dormant well into late July, so our employee recommended he wait a while longer to see if it would break dormancy. Mr. [redacted] did not want to wait and was quite rude to our employee. He insisted that he wanted to dig up the tree in the middle of a drought and get a much larger and more expensive replacement. Digging it up in the middle of a drought would have guaranteed that the tree would be killed. We requested a picture of the tree and when we finally received it, the tree was clearly not dead. This was not a bareroot plant, it was a potted plant that was dormant. It was a healthy plant when he bought it, despite being dormant. While we do have a limited return policy on our bareroot plants because occasionally one will not survive the bareroot/transplant process, our policy on potted plants (dormant or otherwise) is that all sales are final. When those plants leave the nursery, they are healthy and alive. Plants are living things and we do not guarantee the customer's success of keeping the tree alive or having the tree bear fruit as there are too many variables beyond our control to be able to do so. We cannot and will not accept any responsibility for the many growing and climatic conditions (soil preparation, planting, fertilization, weed and pest control adequate irrigation and/or drainage, etc.) that must be met to ensure the success of the tree. This was explained to Mr. [redacted] , however, he still insisted that it was customary to replace or refund. As we explained to the customer, plants are living things and must be cared for, they do not come with a money back guarantee like a computer and any experienced gardener knows whether a plant is alive or dead (even when dormant) and would not buy a dead plant. While there are some nurseries that do offer such a guarantee, those nurseries would have sold the customer the same plant for $100 and would have a profit margin large enough to be able to provide that money back guarantee. There is no nursery that I know of that will replace a 12" tree with a 30" tree, no matter what the circumstances. As far as the neighbor's tree, this is the first that we have heard that his tree was not happy and healthy, he has not contacted us. At this point, we would be willing to give Mr. [redacted] and his neighbor a refund, as long as they both bring back the "dead" trees in question. As a condition of the refund, we would request that neither of them shops at Harvest Nursery again.

However, I have the following comments on Harvest Nursery's response:
Beyond July of the saplings failed to develop
Considering the high yield of the orchard, where the trees were planted, the drought was of little consequence. We irrigate and take very good care of our fruit trees
Harvest Nursery's allegation that we were rude is without merit
At the time of purchase, Harvest Nursery was advertising 30" trees for $30. Consequently, we asked for 30" replacement trees thinking that they may do better
Harvest Nursery insisted that we wait until the trees were dormant before returning. So we waited until the winter of to contact the business again to make arrangements to return the trees. During our telephone conversation, the business refused to honor their promise of issuing a refund for the trees. Consequently, we filed a complaint with the Revdex.com

The image provided by the vendor does not list the current prices. The Non-Ethanol price listed on the image is $2.999 per gallon and the E-10 price is shown as $1.859. Still very deceptive advertising.[redacted]
