failure to clean gutter per contract which caused ice dam and result the damage in interior wall and ceiling and exterior wall.We contracted Harvey to work on roof repair in 2013. The contract was signed by Harvey project manager [redacted] and us on [redacted] The work is supposed to complete in 2013 and it was fully paid for in 2013. In March 2014, we noticed water damage in interior ceiling and wall. We contacted Harvey for repair. Harvey sent carpenters to inspect but concluded by project manager [redacted] that the damage was caused by ice dam resulting from poorly draining gutter. Harvey had refused to perform remedial repair. Our contract with Harvey under clause #20 clearly states Harvey needs to clean rear gutter. Harvey's failure to clean gutter has caused ice dam and resulted the water damages in exterior siding and interior wall and ceiling.Desired Settlementclean gutter system. repair the interior wall and ceiling damages caused by ice dam. repair the exterior siding caused by ice dam. Business Response Re: Complaint XXXXXXDear [redacted],Below is Harvey Remodeling LLC** response to complaint XXXXXX.1. Cleaning of the gutters. We did clean the gutters back in May of 2013 as per the contract. The [redacted] live on a heavily wooded lot. The house in encased in pine trees especially on the right rear side where the ice dam occurred and where the [redacted] are stating we did not clean the gutters. The amount of pine needles that fall in that area is excessive. The rear gutters should be cleaned twice a year. In March 2014, we went to the home to trouble shoot the ice dam issue. The carpenter who climbed on the roof noticed that the entire valley above that gutter was filled with pine needles. It stands to reason that in time, the gutter would also fill to the top with pine needles. The fall is when tree** shed most of their leaves and needles. There is still pine needles in the valley.2. Proper vents. Per our Contract, we did remove their old proper vents and replaced them with new ones.3. Blown in insulation. Per our Contract, we did install the blown in insulation. Our subcontractor, [redacted] completed the job in July of 2013. (Attachment 1)Harvey Remodeling completed the work required per the contract. We made several visits to assess their concerns. Please find the attached correspondence where we previously addressed the [redacted] concerns, along with observations and recommendations. (Attachment 2). Also, please find the attached article from the University of Minnesota regarding ice dams. (Attachment 3). I have also attached the CertainTeed Shingle Applications Manual Eleventh Edition which explains attic ventilation and ice dams. (Attachment 4)This winter was unusually harsh it was a very snowy winter followed by long cold spells. There was limited thawing which made for perfect ice dam conditions. Homes that never had ice dam issues in the past were affected. [redacted] Remodeling prides itself on customer satisfaction and repeat business. It is our practice to always complete a job according to the signed contract and to follow up on all complaints to assure that something was not missed. [redacted]

Harvey installed a new roof on our home. Part of new roof had moisture & mold problems. They installed vents and now leaking on ceiling below.Harvey installed a new roof on our home. Part of new roof had moisture & mold problems on a small dormer that had built in drawers. To prevent the mold and mildew, the painted the drawers and sprayed mold spray and they installed 3 roof vents. Now one of those vents is cracked and is leaking on ceiling below in our bathroom. We had to repair the bathroom ceiling and called Harvey last October, they said to wait until weather I warmer. They didn't even offer to help seal up the leaking vent. We crawled out on the 40ft dormer to cover with plastic and bricks to get us thru the winter. Not an easy winter!!!! Harvey asked us to call in April (which we did). We had an apt 5/13 scheduled to consult with the Harvey roof expert... and the first time he just didn't show up, and Harvey did not know where he was, when we called.. We rescheduled for 5/27, and got a call that his truck was broken down at [redacted] and we would have to reschedule again.Desired SettlementWe really just want them to repair our roof, from the leaky vent. I do not feel comfortable with the roof vents at all. If the other 2 start leaking we will have more ceilings to repair. I want them to take out the vents and fix the roof so we don't have more issues... there has to be another way to vent the roof without these leaky vents... They created this problem and I feel that they should make good on them.Business Response We completed a roof installation for the homeowners in 2005. In June of 2010, we were contacted by the homeowner that there was moisture in drawers in a dormered roof and they were concerned about mold. We investigated and suggested installing static vents (not a standard part of roof replacement) to provide more airflow to the area. Five years later, on January 21, 2015 we received a call that their static vent had been crushed and was leaking and they had already covered it with tarp and bricks. We came out to investigate the next day (1/22/15) and agreed to look at it again in the spring. Up to this point, we feel we have done everything correctly. As agreed, the homeowners called us April 30th to come back out; we scheduled an appointment for May 13th and we missed that appointment. This is where we regretted our actions. This record-breaking winter had our employees stretched very thin. The employee we scheduled to visit the home and had been there in the winter, missed the appointment. He obviously should not have, that is something we do not consider acceptable and strive to never have happen. We rescheduled, and on his way to the appointment, his truck broke down. It really did. It was unfortunate and perhaps Murphy's law, but it happened. The homeowners were understandably not happy. They filed the complaint that day. We immediately reached out to the homeowner to send someone else out to their home and they indicated that they no longer wanted our help. We understand they were disappointed and inconvenienced. We regret that and respect their decision. We stand by our work and go above and beyond contractual obligations to satisfy our clients, as evidenced by our attempt to investigate an issue on a roof we installed properly ten years ago. Although frustrating, this is an administrative scheduling error not a quality of work issue. We truly do regret and have apologized for the unfortunate scheduling mishap. We stand by our work and strive to treat all homeowners honestly and with respect. Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)The information that they provided regard dates for requesting repairs are not accurate. Additionally the vent did not get crushed... It was a bad idea to begin with, as stated above in that it is unusual. We had been waiting since October for the repair. They state correctly that they have extremely poor customer service...which we experienced for this repair. In light of this they lost our business on a kitchen remodel. Their loss, and this is a case of buyer beware... All of this is water under the bridge, as our roof was repaired last week and kitchen was redone with another service provider...
