Purchased a 2014 [redacted] with clean CarFax provided by the dealer. A body shop confirms repair and repaint to sides, hood, and trunk. Misrepresentation10-6-14 I purchased a 2014 [redacted] (2G1FB1E30E9146496)with 11,623 miles from Hatcher Chevrolet, [redacted], TN. The dealer provided a clear (no accident or damage)CarFax document prior to the sale.1-8-15[redacted] body shop, Jackson, confirmed that the car had been repaired and repainted on both sides, hood, and trunk.1-9-15 I spoke with [redacted] Hatcher, the owner's wife and Sec./Treas. She stated that the auto auction where the car was purchased was bonded and they would have to go back on them. She asked for documentation from the body shop. I agreed to provide her with that documentation. I obtained documentation from[redacted] body shop and delivered it in person to Hatcher Chevrolet.1-13 I called [redacted] Hatcher - she refused to take my call. [redacted] called later. He quoted [redacted] Hatcher as saying that they did not misrepresent the condition of the car and "he did not owe me anything."My position is that the dealership did misrepresent the condition of the car by providing me with a CarFax document stating no accidents or damage had occurred. I also believe they were aware that the car had experienced extensive repair and repainting. They told me that they examined the car before showing it to me and discovered a scratch on the front bumper which prompted them to have the bumper repainted before offering it for sale. During such an examination I believe they, being automobile professionals, would have noted that major body work and repainting had been performed on the car. To date I have had no further response from the dealership. As a result of Hatcher Chevrolet's misrepresentation of the condition of this automobile, I paid for a vehicle whose value was based on having sustained no accidents or repair. The price exceeds the fair market value of a vehicle which had sustained significant damage and repair. In addition, when the vehicle is sold or traded at some time in the future, the attractiveness of the car as well as the sale or trade-in value will be severely diminished. Desired SettlementHatcher Chevrolet will take possession of the [redacted] in exchange for reimbursing me for the full amount I paid for the car including trade-in value of my[redacted] truck ($7,593.45), processing fee ($349.99), Sales Tax ($1,334.69), Business Tax ($53.27), License and Title ($5.50), and Trade Difference ($17,406.55). Total amount is $26,743.45.Business Response To Whom It May Concern:We are responding to case # 40102374, on [redacted]. Mr. [redacted] was at our Dealership on October 5, 2014. He drove the care asked for a Car Fax, which we gave him. A copy of the Car Fax is Enclosed.Mr.[redacted] Drove the vehicle overnight to have someone look at it. Mr.[redacted] brought the car back and agreed on a price, wrote the check and drove it home on October 6, 2014. He signed a Form (we owe/you owe) also a copy is enclosed.We purchased the car at an auction in good faith. Also after reviewing a clean car fax, we have done everything by the Book and feel we owe Mr.[redacted] nothing!Thank you,[redacted],General ManagerConsumer Response (The consumer indicated he/she DID NOT accept the response from the business.)[redacted] has no direct knowledge of the transaction. His contention that I drove the vehicle overnight, an obvious fabrication on his part, is blatantly false. It is still my belief that the dealership knowingly represented the car with serious damage as having none. It is also my understanding that the salesperson who showed me the car has left the dealership because of this and other conduct demonstrating a lack of integrity.

I bought a car. Three days after I purchased it, the car wouldn't start . Desired SettlementI want my money back $1,600.00. My paycheck was garnished. Therefore I can't afford this vehicle or the final down payment amount $400.00 -total down payment $2,000.00Business Response In response to oringinal complaint, we do not dispute that the vehicle would not start on her third day of ownership. Ms[redacted] contacted our dealership on the day her 2004 [redacted] would not start. Despite that this vehicle does not have manufacturer's warranty (154,420 miles) and Ms[redacted] signing a buyers guide (As-Is), we elected to send a Roll Back wrecker to bring this vehicle back to our dealership to determine problem. We immediately provided Ms[redacted] a loaner car until her vehicle was repaired and returned to her. All of this was done at OUR expense with no obligation to do so. Other than inconveinence to Ms[redacted], we feel we have gone above and beyond to correct issue.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.) IN review of[redacted] response, Before MY vehicle was return the (loaner car) I keep It for a week!!!!!( loaner car ) WED-WED......!!! BUT THEY WOULD NOT EXCEPT MY CAR BACK WITHIN 3DAYS!! ( ONLY HAD FOR 3DAYS) WOULD NOT START THE FIRST DAY AFTER I RETURN HOME,ALSO WHEN THE EMPLOYEE FROM[redacted] COME TO PICK UP THE CAR HE CALL MY CELL PHONE STATING IT WOULDN'T START?? (I'M thinking " Really ?? ) I replyd "Mr. THAT'S WHY YOU ARE PICKING IT UP BECAUSE IT will not start( LEMON!!!) I discuss that I honestly did not feel the vehicle would be reliable enough for the future ask would they consider me selecting another vehicle (was told by the finanical dept "that was not an option)my downpayment was $2000 the day I sign the loan 6/17/14 I paid $1,200 then I issued 2 more checks in amount $400 for each.. well first of day break 6/27/14 I contact the dealership advising that I have been garnish unable to afford the continuing of the downpayment well the deposit the check ("anyway") I resulted from 3 NSF BANK TRANSACTIONS @ $36.00 X 3= $108.00 !!!! next check date 7/1/14----- I ASK THEM AGAIN TO ALLOW ME TO SELECT A CHEAPER VEHICLE _WAS TOLD "I WILL CHECK ON THAT( AS OF TODAY NO RESPONSE 7/11/14!!!!)DISCLAIMER: [redacted] WILL ALLOW A 72 HOUR TEST DRIVE on there vehicle's........ BY word of mouth from previous employees he do not have the vehicle(s) service before parking on the lot to be purchase.. my drive out tag expire 7/14/14 Final Business Response We will try to address these concerns one by one.1.) "IN review of[redacted] response, Before MY vehicle was return the (loaner car) I keep It for a week!!!!!( loaner car ) WED-WED......!!! BUT THEY WOULD NOT EXCEPT MY CAR BACK WITHIN 3DAYS!! ( ONLY HAD FOR 3DAYS) WOULD NOT START THE FIRST DAY AFTER I RETURN HOME"We do not have a 72 hour test drive or return policy. We went above and beyond in the name of customer satisfaction to take care of her concerns. When she told us about her intermittent "no-start" concern, we gave her a car to drive while we brought her car in to our service dept. We were told this problem only occured after sitting a while, so we brought the car in and let it sit. It always cranked every time we tried, so after a few days we decided to send it back to the customer. That day it did not crank, so our service dept concluded it was an issue unique to [redacted]/Honda, so we called the local[redacted] dealer's service advisor and ended up sending it to them for repair. They were able to find the issue and repair it. We did this at our expense. During this time, she called saying she found out her wages were going to be garnished so she wanted a cheaper car, or less down payment, or return the car and refund her down payment. When we explained she had purchased the least expensive car in inventory, and our finance options were limited, she then insisted that we keep the car and return her down payment. When we explained that was not an option, she said she was going to stop payment on the remainder of the down payment that was due us.2.) The customer volunteered information to us stating that she had purchased two vehicles from two different dealers before purchasing from us. She stated she had to return them because the dealers were unable to secure financing.3.)"DISCLAIMER:[redacted] WILL ALLOW A 72 HOUR TEST DRIVE on there vehicle's........ BY word of mouth from previous employees he do not have the vehicle(s) service before parking on the lot to be purchase.."Please see the attached file that shows where the Used Vehicle Inspection was performed on this vehicle before it was offered for sale.4.) "I want my money back $1,600.00. My paycheck was garnished. Therefore I can't afford this vehicle or the final down payment amount $400.00 -total down payment $2,000.00" This is the customers Desired Resolution. We feel we have gone "the extra mile" in resolving our customers complaints and concerns. Unfortunately if she does not fulfill her financial obligations, we will be forced to pursue legal action regarding her down payment owed to us.
