On June 25 2018 I purchased a pair of *** jeans six 36 R x 34 for $330.78 from Havik in Regina SK. The jeans didn't make wearing 4 times.

I called the store on July 16 2018 to report the issue and see if I could exchange them. The sales girl *** told me that the lady I needed to speak with us away until next week and to come then.

I arrived writhe store on July 24 2018 at 9:05 and explained why I was there. She said the lady I ne see to speak to is still not there. ***, she then called the owners of the store and gave her version of my concerns me he hung up and said there is nothing they could do. I said I wore them 3 times and spent a lot of money for nothing and I would like to speak to the owners. She *** dialed them, said, he wants to speak to you and handed me the phone. I explained everything and he did there is nothing he can do. I did I am a customer and spent a lot of money and this isn't fair. He *** said he will be there in 10 minutes and we can "talk" more and told me he will not do anything for the inferior product issue and hung up. The sales girl then *** said they are jeans nd they stretch. The product fits like a size 38 to 40 now. They never explained this is n issue when I tried them on in the store and prior to purchasing. No I'm out the money and need to get a pair of jeans. The return police is simple and does not say any of what their excuses are which is on each receipt.

I would like a refund now as due to this issue

Mr. came into Havik on July 24th to voice his concern about his *** jeans that he had previously bought from our store. He explained to me that he had called a week prior to ask to speak to the owner in regards to his concerns, but the owner was not there and he was advised that it would be best to come into the store the following week when both owners would be back in Regina. He told me that he had worn his jeans about 3 to 5 times, and washed them about 3 times as well and that he could, "now fit his entire hand in the side of his pants". I asked him questions in regards to whether he had worn or washed them and his answer was yes. He did not have his receipt with him and the tags were no longer attached to the jeans. There was no manufacturing flaw or defect. Which completely ruled out any possibility of the company *** being able to take back the jeans to fix them. Yet, he continued to pursue the claim that he felt as if the fact that his denim had stretched was a "manufacturing flaw". I explained to him that it isn't uncommon for denim to stretch out especially after a few wears. As Mr. started to raise his voice and complain about the lack of cooperation with his request to be reimbursed I suggested that we call the owners and get a second opinion since he did not think that I, as just an employee of the business could do anything for him. Although I am the daughter of the two owners and have grown up in the business. I then proceeded to call *** and *** to ask them whether there was anything that could be done, but at the point they said that there wasn't. Our exchange policy states that the buyer has 45 days for either in store credit or exchange, but no cash refund. We've had this policy in place for the past 20 years and have never had someone demand a refund even though tags were not on, the jeans had been worn and washed due to him purchasing that size. It is understood by any retail business that clothes that are warn are not returnable as they can not be re-sold by the business and lose their value. He then repeatedly kept questioning me in a very demanding tone saying that he can not see the policy anywhere in the store and I said that it is on the receipt of purchase and verbally stated by each employee to ensure the customer understands prior to purchase. I gave him a copy of one of our receipts and he proceeded to raise his voice at me saying he can't see it anywhere, although no cash refund is bolded at the bottom. He then tossed the copy in anger and said that we have very bad staff here and that I wasn't helping him. I asked him if he himself would like to talk to the owner since he still seemed to not understand that nothing could be done. I called *** and gave the phone to Mr. so they could speak. He continued to raise his voice and say that we have terrible costumer service. He told *** that he would wait for him to arrive at the store since he was now on his way to deal with the situation. Instead he got angry and hung up the phone before yelling that it would be the last time he shopped in our store. He then stormed out of Havik, right before he aggressively grabbed his jeans from the counter. I told him once more, sorry but there is nothing that we as a business can do for you at this point. When he left the store I had resumed that he was waiting for *** and *** to arrive, but then he was no where to be found once they had arrived.
