Have been trying to get new driveway repaired but contractor is to busy.On May 7th 2015 [redacted] completed the paving of my driveway which was an extension of one I previously had done by another contractor. After a couple days of curing we noticed that the asphalt was still soft and seemed to not be drying.. Since we noticed this we didn't drive on it until May 20th after driving my truck on it I noticed that my tires actually left indention's in the Asphalt. I contacted [redacted] and he told me that the heat was keeping it from getting hard, but it was ok to drive on. I know this was not the way the asphalt was suppose to be, because I never had these issues with my previous driveway. On May 25th I sent [redacted] the following text message.."[redacted] I can't help but be a little concerned with this driveway. Today I park a 600 pound four wheeler beside the barn where I wanted to park my trailer. It sat there about 20 minutes and the tires have left tread impressions. I have not parked my trailer back on it because I'm scared the truck tires will tear it up while maneuvering and backing in. Do you have any logical explanation as to why this is happening? Again this is [redacted] in Wilson."His RESPONSE "it was a soft area I'll have a look at it give me 2 to 3 days" On May 31st I contacted him again as I had not seen him yet, hesaid he was sending his guys over.. They came by on June 1st, neither of them I could communicate with as they spoke very little English. After they looked it over they said [redacted] would come by. On June 12th I sent him a video of more damage to the driveway from driving on it, June 18th I sent a photo, still I had not seen [redacted]. June 18th he sent me a message to give him a couple weeks and he would fix all of it. July 26th I sent him another photo and video, I asked him had he forgotten about me his RESPONSE " No I haven't been a little backed up please give me a little more time I will come out and repair your drive thank you for being so patient".. August 30th I sent another photo of more damage and received no response..Sunday September 20th I text him again and asked what his ETA was and to date I have had no response from him.So to date [redacted] has yet to come back to my house after he finished and was paid in full $5,100.00 for his services.Desired SettlementI am asking that Hawk Paving fix my driveway and bring it up to par.. I feel I have been cheated and not received a fair product for the money I have paid. I want a driveway I can drive on without the asphalt tearing up. I have been very patient with Hawk Paving but I reached my end now I want resolution.Business Response /[redacted]/This is [redacted] Owner of Hawk Paving.Im not sure I understand why he is filing a complaint.When I wrote up the contract to extend the driveway into the backyard they did not tell me there were lech lines. I found out when I was prepping the back yard for asphalt. I stopped working and contacted Mrs [redacted] and told her that if I continue work in the back yard, I could not be responsible for the drive because of the lech lines. I explained to mrs [redacted] that the lech lines cause the drive to be soft and therefore not able to roll it properly to compact drive. After I told her she agreed to continue with the work. I even added extra stone to try and help tighten it up. I did tell him I will go back and fix it. even after I told him I will not be responsible for the drive. I could not go back and fix it right away because my work has already been backed up for taking so much extra time out on that drive. I have just caught back up with my work. but weather has been complicating things. Working the the construction business the weather has a lot to do with your work. as soon as I am able I will get out there and repair to the best of my ability. Even though I told theme I will not be responsible for drive. I'm going out there and fixing it for free. Thank you for giving me the opportunity to explain what happened. Consumer Response /[redacted] has part of the story correct. The week leading up to April 9th we had several inches of rain, there was no way any driveway could have been completed with the amount of rain we had the week leading up to the first week of April or thereafter. [redacted] laid down the gravel and worked the soil on April 13th. At that time we had even more rain, so it was was mutually agreed that he would wait until the ground was dry before he came out to pave the driveway. I kept him posted on the condition of the soil on a weekly basis. He returned to pave it on May 7th, ground was hard and not soft at all, or else I'm sure he would have not poured the asphalt. To say that the reason he got behind on his work was because he spent so much time on my driveway is a right out lie.. He spent an entire day laying down the dirt and gravel and then returned 18 working days later to lay the asphalt.. [redacted] has not returned to my house since, not even to look at the issue I have been having.. Yes he did lay more rock that he estimated and I paid him for it too, so I don't see what that has to do with any of this.. the issues with the asphalt are not even over an area where the leech lines cross so again he does not know this because he has not been to look at it.. I have gone as far as having another contractor look at the driveway and they told me that regardless the asphalt is softer that normal.. If I did not already have a driveway you could tell me that this was all normal and I would believe you out of plain stupidity, but I'm not buying it and know that something went wrong with this one. Final Business Response /[redacted]/I apologize for the misunderstanding I will be out there as soon as possible to make things right.
