I am rejecting this response because: I am attaching pictures of my master bath tub This was NOT a toujob from scratch or even scratches As you can see, both arm rests in the tub have been re-finished, the entire back of the tub has been re-finished, the bottom of the tub has been re-finished, around the faucet and ledge of tub has been re-finished This tub was basically re-finished NOT touched-up I am giving Hayden Homes the opportunity to make this right and REPLACE all of my bathtubs as each one has also been touched up (more like re-finished) in this same manner I invite any of Hayden Corporate to come and look at my tubs and tell me this is to THEIR standards they claim In addition, on 6/Kelly from Detail Difference looked at the tub and said she would fix it I asked her for written warranty or guarantees of her work and she could not provide, she simply stated she would fix if there were anymore issues with it Of which case I stated that is her word not a written guarantee and only if the company was in business or she owned it What happened if this company goes out of business or she sells her local franchise where is the protection for the consumer We discussed taking off this re-finish and restoring it to manufacturer conditions, she then called Dave, your local warranty guy, and he told her NO she could not do that and said he would be in touch with me I filed a warranty claim on this same issue almost weeks ago with no phone call from Dave in your warranty department as of today 6/ I bought a NEW home from Hayden, with the expectation I would have new bathtubs and NOT re-finished bathtubs Because of the carelessness on Hayden part of not protecting these tubs during the building process There was never a cover inside the tub to protect it nor a cover over the top like plywood to protect it during the building process I am under the impression, our entire tub was nicked, dinged, scratched etcfrom their subcontractors and HAD they been protected this damage may not have occurred I have a ton more pictures of the entire bathtub displaying it is peeling all over like this I do not even know how to clean this bathtub nor the other bathtubs due to this issue posing sanitary issues for my family

Complaint: ***I am rejecting this response because: It was never "agreed" upon the outcome of the treeI was always just told it was my problemThere were several inquiries made by me long before closing with the Hayden Homes rep Tiffany, these were not documentedThe fact that is not being addressed is that the tree is dying due to the excavation by Hayden Homes well in to the drip lineI purchased my home for over $300K and provided them with an estimate of tree removal for $I am willing to let go of the additional grading of the yard and retaining wallI feel this tree and the hazard it poses to my home were created by Hayden HomesAs far as the other service requests, I don't understand why a bulge in my ceiling/wall is being ignoredIt would seem to me something has shifted or buckled causing this affectIt needs diagnosed and repairedThe fact no one from Hayden Homes has even contacted me by phone or in person is concerningAll I get is an automated email response saying I will be contacted soonThe only reason the side yard (not back yard) of my home was filled in and re-barked is because I ran in to the warranty specialist at a neighbors home and expressed my concerns to himThe reason for that needed repair is because of a small ditch Hayden Homes created to drain my neighbors yard, then they moved the property linesIn that time they removed fences and relocated property lines putting that ditch on my propertyThis was not a "good faith" repair since once again it was something that Hayden Homes had created. Same with the drainage problemWhy do I have to wait? My back yard is a marsh landEven during the summer on degree days, if I watered for minutes in the morning my back yard was still soggy in the eveningThey ask me to wait until the final month of warranty when in fact I have not heard from a Hayden Homes rep in over monthsThis does not instill confidence in me that my concerns will be handled in a timely manner while still under warrantyIf Hayden Homes really cares about customer satisfaction I hope they will do the right thing and remove the tree and take care of my additional warranty concerns.

Hayden Homes has received a service request. An initial assessment of the reported concerns has been completed. At this time Hayden Homes is working to schedule service for the reported items as applicable to the warranty. In addition Hayden Homes has agreed to hire an
independent Certified Floor Covering Inspector to determine what action may be required concerning the laminate flooring. Hayden Homes will continue to work directly with the customer to address each of the items listed as concern as applicable under the warranty

I am rejecting this response because: CARPET is stil an issue with paint stains and black stains where a chemical was used to try to remove paint stains prior to close On 9/*** *** came out and I paid personally out of my pocket $to have the carpets cleaned, I asked Doug *** and Dave H*** if they would like to see copy of invoice with stated no *** *** is unable to remove the paint stains and/or smears In addition, black stains are unable to be removed where Goof Off was used to try to remove stains prior to close We waked house and looked at stains I had marked with blue tapeI stated this was just a sample of the stains….Doug *** directly stated he did not need to look at all the stains and asked what exactly I wanted and as stated I said if they cannot remove the stains with another method (I already paid for cleaning) then carpet needs to be replaced As of today 9/we are waiting to hear back on this issue ROOF: The roof is now fixed as I personally called the company myself as we were scared with the rain coming we could get a roof leak I emailed the owner and Stephanie pictures of what the independent inspector was speaking about They were prompt at getting this fixed for us and professional to deal with *** *** replaced vents covers that were installed wrong nd calked over exposed nail heads The vent covers were originally installed over the shingles and nailed down exposing us to leaks (this could have been done after City Inspection) They peeled back the roof, replaced vent covers and fixed properly with new shingles tar and or caulking Inspected the rest of the roof and were confident in their work and repairs that we should have no leaks While here the company representative Brian confirmed roof vents were installed wrong and was disappointed he had to tear apart his won roof he played to repair for us In addition he stated their company would no longer roof any houses until all work was completed by HVAC and they were the last ones on the roof so this did not happen again to another homeowner SHOWER LEAK: I went to Cost less Carpet and bought the shower caulk after Hayden Homes tried to send the shower door people to the house (which I explained this was not a shower door issues and emailed ics to Hayden Homes on 8/explains where it was leaking) After week of not being able to use my shower I personally caulked all around the shower myself and had the damaged trim replaced and painted I was trying to get ready for surgery and needed that shower to sanitize down and avoid risk of infection as I was preparing for surgery in my chest cavity where I had a prior infection and risked this getting into my organs This is the only shower in the house with a shower hose we personally installed to prepare me for this surgery I have waited for a year to have The seriousness of this surgery was not taken into consideration Hayden Homes was fully informed of this upcoming surgery GARAGE: We had garage inspected my an independent inspector He notated where tape was peeling and notated safety concerns on firewall and minute barrier Hayden Homes was prompt at getting this fixed for us We would like nothing more but to have a professional working relationship with Hayden Homes over the henry months as our home is still under warranty Processes and procedures on their part need to be addressed As new homeowners we fulfilled out contractual obligation and paid them for our house on time, all we want is to be able to enjoy our new home and build our new life with out issue after issue popping up with this house To date on this claim pending is the carpet We will wait from Hayden Homes on a reply at to what they have decided to do with the carpet since we paid for new carpet in a new house

Old "touch up" is to be removed off all bathtubs so that the manufacturer can determine what needs to be done to restore to "manufacturer conditions" Original bathtub warranty to remain intact In addition, Hayden Homes was to check on and advise when all of our NHO and warranty items would be completed as we have bene in this house now for almost weeks with minimal items being done on our NHO as well as their warranty department has made no attempts to contact me with warranty claims filed

Hayden Homes had an unfortunate technical error occurwith the phone systems over the weekend of 4/26/Monday morning the errorwas identified and immediately resolved through our IT departmentAt thattime, Monday morning at 8:30am, *** *** was able to contact our emergencyon call technician
who took his information and immediately sent the message toour warranty representative in the correct regionOur warranty technician madean attempt to contact our homeowner and left a voice message letting him knowhe would be receiving a phone call from the HVAC company and they would bescheduling to come to his home as soon as they couldThey made contact withour homeowner that same afternoon on Monday, April 27th and resolved theconcern

Discussed with homeowner that the manufacturer’s repair representative can make the proper repairs to the affected areas that are chipped and flaking on her tub/showers This repair would keep the manufacturer’ warranty intact. Homeowner is agreeable to have us coordinate this effort but is unavailable the week of July 16-20. Any other time is fine. I explained we would contact the repair representative and acquire and provide some times to present to her to accommodate her schedule

Mr*** is referring to a statement that he had received from the Management Company while in communication about a construction vehicle parking issue. The Management Company was incorrect in their statement. I, the HOA Manager, contacted the Management Company to discuss why she said

Mr***,Thank you for letting us know about the truckWe will contact Hayden.The CC&Rs will be enforced after the multiple building sites are completedThings change daily when there is construction going on in so many areas ofthe communityHope you can understand things will even out after theconstruction period
The Management Company apologized and said she “meant that once construction is over, the amount of construction vehicles will be gone and the parking violations will be easier to uphold”. I, the HOA Manager of Hayden Homes, contacted Mr*** to explain the miscommunication and that by no means would we not intend to abide or uphold the CCR’s. While on the phone, he explained a few other frustrations that I confirmed I would address with appropriate parties. Mr*** asked me to write an outline as to what our expectations are of the Management Company in contract. Within the same afternoon, I wrote Mr*** an email with his request as well as a recap of our previous phone conversation and the other items I planned to discuss with appropriate people
I have satisfied Mr***'s request with the Revdex.com that someone from Hayden Homes of authority (HOA Manager) contact him. Secondly, I have satisfied his additional request of the Management Company expectations outline. Thirdly, I have satisfied his request with the names of who are on the Board of Directors, which is public knowledge and listed on the Secretary of State. Fourthly, I offered to speak with the project manager that oversees the sub-contractors and the parking issue. Finally, I spoke with him on the phone in regards to the miscommunication he had received that ultimately led to this Revdex.com complaint.

Complaint: ***I am rejecting this response because: Hayden Homes did not build the roof according to *** Building Code R905. There are places where no underlayment was used at all and the asphalt shingles are attached directly to the roof decking. *** is a high snow cold area and this area by code requires ice shielding, which was not done. Even if ice dams occur, the weather proofing was not completed and this led to the resulting damage. The roof needs to be removed and the correct weatherproofing process needs to be completed before a new roof is installed. Hayden Homes is responsible for not following the *** Building Code.Sincerely,*** ***

The *** purchased their home at *** * *** *** *** in March of Hayden Homes final grades and landscapes the front of every home we sell but our homeowners have the option to purchase additional landscaping that also covers the sides and back of the homesIn the spring,
Hayden homes went out to the property to complete the rough final grade which is standardRough final grade simply means that the land slopes away from the home on all four sides and no large rocks remainSince spring we have responded to Mr*** on three other occasions to complete additional work to assist them which went beyond which would be customaryWe have explained to our home owner that the final finish grade and topsoil would traditionally be brought in by the landscaper, they hire, to work and ready the back yard for sod and not Hayden HomesIt is for the reasons stated above that we have not returned to the home to complete the requested activity. This letter is in reference to the above noted complaint by [redacted] of [redacted]. We recently completed warranty work for Mrs. [redacted] to Include a new driveway, Front door and addressed the erosion submittal. When the concrete crew demolished...

the old driveway there was some curb damage done. Although this is normal due to the nature of the repair Hayden Homes does intend to patch the curb. We had already contacted the concrete contractor to instigate those repairs. The second issue noted was in regards to the front door. We agreed to replace the front door due to warpage. The actual cause of the issue was not due to any faults of the manufacturer or the installer. A glass storm door was installed later by the [redacted]s which causes that air to heat way above the ambient temperatures outside and in effect warped the window trim. Although the door manufacturer denied their warranty Hayden Homes agreed to replace the door. When the [redacted]s made all of their choices on the home a start sheet was created. On their start sheet they have the upgraded door and paint package. This means that the door has a window and that the door paint is the same on both sides. This was an upgrade chosen by the homeowner. Originally when the door was installed the painter did not pick up on the upgrade so the door was not painted correctly. When Hayden Homes ordered the new door we referenced the [redacted]s start sheet to ensure everything was completed correctly and we emailed an excerpt of the start sheet to Mrs. [redacted]. In this case the door color chosen was [redacted] “Black Fox” so we made sure the door and colors were correct prior to the installation.  The last item addressed was some erosion next to the corner of the back patio. Although the area is very small, we understand the [redacted]s concerns, however Hayden Homes has no control over the weather and amount of rain and snowmelt received and for that reason we took no action on this part of the service request. All other items have already completed at this time and the concrete company will be out to patch the curb. I am rejecting this response because:The concrete was re-poured, but the problem was not fixed.  The concrete may be at the proper angle, but the problem is large dips in the concrete that hold water.  During the winter the water in those areas freeze, causing ice patches that can be dangerous.  In addition only one of the slabs was re-poured, leaving the other slab with the original problem.  The dips were measured, but when done so, the supervisor literally had to push a bunch of water out of the dip to measure.  The slab that was not re-poured was also cut to try to solve the problem in the first place.  It did not solve the problem, but leaves us with a slab with a cut that can now have water catch in it, freeze and cause breakage.As to the "slight" color variation.  One slab is beige, the other is gray.  I do not consider that a "slight" variation, but instead makes the front entry way look like a concrete patchwork quilt.  Visually unpleasing and unprofessional looking.

This letter is in reference to the above mentioned complaint from [redacted] of [redacted], [redacted]. Hayden Homes has responded to all concerns as they are brought up by the [redacted]’s to date and will continue to do so as we are notified. At this time we have responded and have...

been working to resolve the latest request which involved exposed roof nails, fire taping in the garage and the carpet.   We met Mrs. [redacted] at their residence on 9/12/17 to discuss these request. The first was the paint stains in the carpet. Initially when we had a drywall person on site we set up [redacted]  to attempt to clean. Although there was some success there were a few spots that did not come out and we have every intention of addressing the situation with the [redacted]’s but we wanted to make an attempt to clean first. As to the fire taping in the garage we inspected and there were only a few areas of concern. We immediately contacted the drywall team and the fire tape repairs have been made. The last request was regarding some un-caulked roof nails and vents. The vents are installed the same on every home and we confirmed with the city inspector that there is no code requiring a full perimeter nailing pattern. The [redacted]’s contacted the original roofer to come out which is exactly what we would normally do. They did come to the home and caulked over any exposed nail heads and we confirmed with Mrs. [redacted] that there was no charge. Your home was constructed in accordance with all building codes and requirements that applied on the date of construction.  The construction included the underlayment required under the governing building codes.  Records show the home passed all required inspections, including the “Final Inspection” and obtained the required “Certificate of Occupancy.”  As explained in our earlier response, it is critical that you maintain and clear ice and snow from the eaves and roof throughout a severe winter such as this one. Failure to do the necessary maintenance work can result in an ice dam.   Neither the City of [redacted] nor [redacted] required the installation of an ice barrier when your home was constructed in 2013.  Moreover, the code provision referenced in your response does not apply in this instance.   R905.2.7.1 requires the installation of an ice barrier only in areas where the average daily temperature in January is 25°F (-4°C) or less.  In [redacted], the average daily temperature for January is 31.1°F and this provision does not apply by its terms.  Please feel free to contact our customer service department who can provide you with additional recommendations for conducting necessary winter maintenance.
