Client was notified these charges were pending and agreed to pay them after certificate of occupancy was obtained.After final inspections were made, client refused to pay the amount of $4500, so I informed client that I would not complete driveway until I received payment.Client threaten a lawsuit, and I informed him I'd no longer respond to email correspondence until overages were received.I have not received payment to this point and decided to leave the remaining contract amount of $12,240 so client can use funds to complete driveway himself.I consider the matter closed and will not return.Consumer Response Dear Sir1 Mr. [redacted]'s response does not resolve my complaint of breach of contract. Mr.[redacted] does not present any evidence or verification to his claims.2 Mr [redacted] refuses to arbitration for all claims and disputes arising out of the contractors breach of contract3Mr.[redacted] has not accounted for the $25000 dollar down payment for the construction of the building.4Mr.[redacted] received four schedule A payments,as the construction of the building progressed total payments $89,760 dollars.Mr.[redacted] was paid $3,500 dollars in extra overcharges, items had been paid in schedule A payments, double billing. Mr. [redacted] received $118,200 dollars of the $127,000 dollar LUMP SUM contract.5 Mr. [redacted] had [redacted] G [redacted] a professional structural engineer draw the framing plans,Mr.[redacted] constructed the framing and material to those specifications.The approved plans were never an issue. Mr. [redacted]'s false claims are the issue.6 Mr. [redacted] has not delivered counters and countertops which were paid for in schedule A payments.7 Mr.[redacted] walked away for the contract owing the owner$28,500 dollars in construction improvements. Thank You for your consideration. [redacted]Final Business Response 1. I do not care if my response resolves Mr. [redacted]'s complaint(s)2. I have engaged it resolving the dispute. I've given my requirements and been refused by client to abide by them. Therefore, I've decided to walk away from the job and remaining contract.3. The $25,000 was the down payment. The remaining amount was paid through monthly draws as the corresponding work was completed.4. The overages occurred as a result of extras Mr. [redacted] wanted to add, or they were required by City of Raleigh Inspections dept. Therefore not included in original contract price.5. Architectural plans were presented by client. They were inadequate for construction and/or supplier material take-offs etc. Mr. [redacted] was informed in the onset that additional costs could be forthcoming.6 & 7. IncorrectMore Info Received From The ConsumerMr. [redacted] has not offered any supporting evidence to any of his allegations, Mr [redacted] has not accounted for the 25,000 dollar down payment, in the cost of the construction.The contract is a set price bid. Mr [redacted] submitted [redacted] structural addendum drawings by structural engineer [redacted] J [redacted] including changes to the foundation, replacing the floor truss system and reducing the roof rafter for 12 inch to 10" and 8" rafters. Mr. [redacted] specified in his description of material contract framing: per plan/ engineering plans supplied by Professional Builders supply (PBS) Mr. [redacted] was to incur the cost of his revised plans and the building permits. These revision were to reduce the cost of construction for Mr. [redacted]'s total contract price.Mr. [redacted] will not arbitrate these disputes and claims,which is a violation in his construction contract with the owner. How is it possible to have overages, when Mr. [redacted] is holding the 25,000 dollar down payment which has not been accounted for in the construction. Mr. [redacted] walk away from the completion of this contract owing the owner 28,500 dollars in construction material and labor. I have taken this breach of contract to the Attorney General Office. I have signed & supporting documentations.Where is Mr. [redacted]'s verifications to any of his allegations? Thank You [redacted]

We have a 10 year builder warranty on the home they built and he will not return our calls. The floor by our backdoor is rotting out I almost stepped thru the floor. We need it fixed but he will not call me back.Desired SettlementI would like our floor fixed
