I am rejecting this response because: Shugart called me on 11/01/16 and again on 11/03/16. To let me know they were aware of my complaint filed with the Revdex.com. I was told I was a squeaky wheel and that my yard received extra attention due to the squeaky wheel receives the oil. How inappropriate is that? Ken said he would come out to look at the yard. I invited him out in (my first reply back to him) the afternoon, so that I could be there. He came out with Darrell in the morning and met with my male neighbor. They walked my yard and his. I hear one thing from Ken and a totally different thing from my neighbor. My neighbor says he has in writing everything that Ken said would be done to his yard to fix all of the issues that are going on. Which are the same exact issues going on in my yard other than I have a major bank in my backyard. I was told there is nothing wrong with my yard. That he was pleasantly surprised of how good my yard looked. All you can basically see straw. Shugart has pictures of the drainage issues, all of the gravel and rock that are in the yard. They have pictures of the soil prior to the landscaping taking place. There were little to no rock and the soil had good rich color. All of that soil was hauled off. I am left with rock, gravel, sand and construction debris. When they overseeded and aerated yard they covered up all of the issues that are in the pictures with the straw. Ken looked at the bank which is supposed to be a continuation of my backyard. He said it looks fine and he has no idea what I would want done to it. The bank is supposed to be part of my yard not a plowed field. The debris from a silk pond was dumped on the bank and it was hydro seeded prior to closing. Even the superintendent said before closing that the bank was not safe to walk on much less mow. I was told during preconstruction the bank would not be touched. I asked for something in writing in regards to protecting me from this exact issue but I never received it. Lots of things were said during prior to closing but not followed through on. Hindsight proves that Shugart said whatever they needed to make sure I went to closing. After the money is in their hands my issues do not seem to matter.

Shugart Enterprises is simply following the guidelines of not only the
NC Real Estate Commission but also the terms of the contract that the buyer
signed. We are currently working with [redacted] in order to resolve
this matter. Once we receive a denial letter from [redacted],...
we can
sign the termination of contract and return the earnest money. In good
faith that the buyer was going to close on the home, Shugart went ahead and
followed through on their part of the contract by adding additional items that
the buyer had requested.
We would like to rectify this unfortunate situation. I will be contacting our customer to hopefully meet in person and go over her issues together. Tell us why here...

I am rejecting this response because:Until the work completed(correctly) I will not accept the response. They were made aware that there were problems a prior to all of the rain coming but failed to address the issues. I sent them emails 3 times that week. My first email was sent out Sat. (April 15th) to make sure it would be in Darrell’s hands first thing Monday morning. The first reply I received was from customer care around 11:30 on April 21 wanting to know if Ken or Darrell had contacted me which I had not. I received a response from Ken around 7:00 p.m. the same day (April 21). The matting was not put under the downspout in the front of the house. This is most likely why the front yard had areas to wash out. The low areas in the back where water stood previously were not corrected. The area where my property buts up next to my neighbor’s property washed out before the landscaper came out and it is still washing under the matting they put down. The water still sits under my driveway. I was told prior to closing the silk pond would be closed. There is still water pooling in the area. It is not safe to have standing, stagnant water or an area that holds that much moisture. Being outside in the evenings is virtually impossible due to the mosquitoes breeding in the area of the silk pond. Information in regards to things of this magnitude would have definitely made me reevaluate where I built my home. Knowing it was supposed to be closed and there should not be any water back there after construction on the street was completed was in the equation as to where to build the house. Not sure how they can tell me that it’s not going to be back there then renege on their word once I am in the house.

Tell us why here...Ms. [redacted] will not let us on her property to make repairs. She admits this in her complaint. She also admits we have already corrected many punch-list-type items since closing.Ms. [redacted] has verbally abused the contractors trying to make the repairs. She threatens a TV and social...
media blitz if we don’t do everything she demands, no matter how unreasonable. She has tried to enlist neighbors in her smear campaign, but they have refused because they are happy with their Shugart-built houses. At one point, we told Ms. [redacted] that, since she was apparently unhappy with the house, we would buy it back from her at its purchase price plus $10,000.00, but she refused. We remain willing to work with Ms. [redacted] to make any needed repairs, but only under an agreement with guidelines and a neutral third-party arbiter who decides whether a repair has been made.
