I have reviewed the response offer made by the business in reference to complaint ID ***, and have determined that this proposed action would not resolve my complaint. For your reference, details of the offer I reviewed appear below
I have sent proof of ownership record filled out by the VA State Trooper regarding vehicle #involved in the accident. Whether Hugh's owns a snowplow or just has a contract to "push snow" as according to VDOT Supervisory is immaterial. They took my car without saying that it would be impounded at cost. I clearly told Mr*** that I did not have insurance of this type and that I probably should have my own Road Side Assistance come and tow it to my house to which he replied that it should be gotten off the road and it would be no problem that insurance would cover the tow. I said that I hope his insurance won't go up as a result of my claim and asked him if he knew if that would happen to which he said he did not know leading me to clearly believe that the tow truck was either his or it was under his employ (as the driver indicated when he called Mr*** and said he was his "boss". They both said to me that they were under contract to do snow removal by VDOT which is confirmed by VDOT Buchanan supervisors *** *** and *** *** ** *** who said that "*** *** has a snow removal contract with VDOT". This party saw an opportunity to take a car and misrepresent that it was being taken care of to help at the scene of an accident, the cause of which was the snow plow which I was told was being opporated under contract for VDOT by the driver and his boss who he indicated was MR***. There was never a discussion of cost or impound fee except that it will be covered by the insurance, according to Mr*** *** who's business card indicates his company is Hugh's Transport. I have sent a copy of this card also to the Revdex.com. This is dishonest business practice in more ways than one.

For your reference, details of the offer I reviewed appear below.The business statement includes several untruths. The transport tow vehicle was called by the snow removal operator (who caused the accident due to being broken down temporarily due to diesel engine issues in the cold weather and parked blocking all but a few feet of the snow and ice covered roadway on a blind curve with no hazard markers set up). This operator, named *** *** *** said he was calling his "boss". The name of the owner of the vehicle on the police accident report, of which I have a copy, is *** *** ***. Whether the driver was under contract to Hugh's or VDOT, as they both told me, I do not know. Mr*** did not however, state that he would drop all storage fees when I contacted him by phone in February (and never had told me that there would be any such fees at any time, until I contacted him by phone in February, when Mr*** told me that the fees were almost three thousand dollars, the first I ever heard that there were any impound fees involved). I did become quite upset because I had been under the impression that he was doing the right thing by towing the car off the dangerous road and keeping it safe while the insurance company came and looked it over, especially since I had just lost my daughter's new car due to them blocking the roadway unsafely. The car was obviously very badly damaged as even the emergency personell believed who responded to check my neck injury sustained in the impact. I never used and profanity whatsoever on the phone to Mr***. What he did say that day, was that I could take the car after I paid him eight hundred dollars. I asked him if he thought I should call the Better Buisiness Bureau to help resolve this to which he replied, yeah call, go ahead. The next day or two later I got a bill in the mail for $2,for towing and storage fees of dollars per day. I called him today after reading this Revdex.com business response which makes it seem as though they were willing to drop all fees and I could come for my car. The owner, Mr***, today, instead, became very irate on the phone and accused me of slander stating now that they did not own the plow or employ any. This is in contradiction to what he said previously that the plow was operated by his employee, (and their insurance company was interacting with mine about this- I have record of their insurance company National Indemnity who told me that *** *** was the owner and insured). The claim number was #*** and the agent was *** *** ** *** *** *** ** *** ** telephone number ***. Their company denied my claim sayinig that in Virginia if a party can be said to be even 1% responsible for an accident then they have a right to deny the claim. Mr*** tried now saying, today, that they would file a lible suit against me and that I would have to pay "the whole thing" relating to the ongoing mounting storage fees, even when I told him that all I want to do is come get my daughter's car. He continued to berate me saying they would file suit against me in court for slander. If he had in fact said they wold drop all fees when I first talked to hin, this would not be happening since that is what I begged him to do (asking politely, and saying "please" multiple times) that first day I sopke with him in February. It is now nearly the end of March and this is still not resolved due to the unfair and unethical business practices of the owner of Hugh's Transport services.

I am writing in regards to complaint # [redacted].In response to a claim that has been made on Hugh's Transport Inc. on January 17, 2018. The claimant reported that he was in an accident involving a Hugh's Transport snow plow. Hugh's does not have or do any contracting with snow removal or have any...

snow plows. As far as the aftermath of the accident an Hugh's Transport tow truck was on the scene. The complainant at that time advised he did not know and was unsure if he had insurance on the vehicle. He was advised that we could remove the vehicle for him and have it taken to our lot for storage since the vehicle was sitting non operable in the roadway and that most likely the state would not let the vehicle sit there until a tow truck from another area could get to the accident scene due to the road conditions. The customer agreed and the vehicle was loaded out of the roadway and hauled back to Hugh's lot after waiting for the police to issue him a failure to maintain control summons and giving the complainant a ride back to his house. The following day the complainants insurance called and advised they were coming to look at the vehicle and do an assessment this making us believe that he had insurance and they would be covering the bill. After not hearing anything an attempt to contact the complainant was made but unsuccessful.  On or about February 28, 2018 The complainant called and advised that he didn't have insurance nor the other vehicle that he hit would cover his losses. When advised he would be responsible for the towing and storage bill he became irate and unreasonable on the phone. After a second call he was advised that we would drop all the storage fees on the vehicle if he would have it removed from our lot. At that time he became irate again and started using fowl language and advised he was not paying anything and he was not responsible.
