Business states that they have spoken directly to customerShe picked up her vehicle on the 27thThere is a mile radius from business location not mile driving timeConsumer spoke with the General manager and charges were modifiedOnly the original towing fees were charged
Unfortunately the situation took a step in the wrong direction and could have been handled differently on both sides

Consumer states: The HOA has contacted me and told me that this was an illegal tow. It is a 2013 Scion XB.

I am rejecting this response because: They were informed by a property owner that I was in the correct driveway and they should not tow. They towed anyway. They also are required to confirm the caller belongs to that driveway. They did NOT do this. I know they did not do this because the HOA has verified that the parties that called the tow do not belong near that driveway, nor did they have authorization to tow. I've also read up on California laws regarding towing and they are required to show authorization or it can be assumed they did not have authorization. They refuse to give the authorizing information. They towed my vehicle illegally and they are very aware of this.

Company states: We can only look up by the make and model of the vehicle.

Review: A Tow Truck Representative was attempting to tow my car around 1:30am. I ran outside to show him my placecard, I forgot it in my glove compartment in my vehicle. I had mistaken my son's picture hanging up when I looked out the window prior to the event. While I'm trying to have a civilized conversation with this individual he instantly began screaming at me to give $90.00 to drop the vehilce right now and started walking all in my face waking up neighbors, etc. I started shaking, trying to calm myself still trying to talk to him in a respectful manner. He started to attempt towing my car yelling and screaming. So I tried to grab the medal object from under my car so he wouldn't tow it, they were heavy I put it down..I have lived at my residence for 5 years and never experience something like this I had my card...I got tired of the yelling so I said fine I'll pay the money just don't take my car, just let me go get it. He got in my face again and yelled No! [redacted]! I said look I'm a mother,I have a son, I go to school and work..He yelled over me [redacted] and your [redacted]! At that point I wanted to hit me but I can't fight a man and I dint want to lose my son. I told him if you hit me I will report you to the police and press charges you better not hit me. Because he kept coming towards me..Finally I started yelling help and knocking on my neighbors window. So he started walking off and getting on the phone. Not to mention there was another person in the passenger watching the whole thing saying nothing..The police came and the men said that I had a pocket knife and tried to cut the man.I don't own a pocket knife and I was not trying to avoid confrontation the entire time. Worst experience in life. I couldn't sleep. woke up crying. The police said that I had to pay $90.00 or he could take my car because it was just words and because he claimed I cut him, and he was bleeding. I ask them to check ours cameras and me and my car. They didn't. And he messed up my tire rim.Desired Settlement: $190.00

Review: HB Towing towed my vehicle from my personal driveway, stating they received a complaint that my vehicle was blocking a shared driveway. When I informed them that they, in essence, stole my vehicle, because it was legitimately parked in my driveway, they responded with, "We took pictures! Maybe you should call the sheriff if we stole your vehicle." (I received a copy of the pictures taken and it shows that I was, in fact, parked in my driveway.) Speaking to the neighbor that I share the driveway with, they stated that they informed the tow truck driver that I live there and that was, in fact, my driveway and I had every right to park there. They towed it anyway. They also refused to tell me who authorized the tow, stating they aren't allowed to give that information and that I would need to fight my HOA for that. My vehicle received several dings in the process. I ended up having to pay $330 to get my vehicle back that was "illegally" towed from my driveway.Desired Settlement: I would like a refund for my $330. If they feel they need to recoup their costs, they can direct that request to the party that "authorized" the tow.

Review: well it starts off by getting my car "unlawful towing". I asked my neighbor if I could park my car in her spot for a while. I just had recently got a new car. so I needed time to get rid of it. where I live there is never any free parking spaces. there car was there for 4 months. one morning my car was missing. I asked my manger of the apartment but she had no idea what happen. so they didn't call on me. then I started to call tow yards till I found my car. Hb towing [redacted]. they told me that the neighbor who owns the spot called and complained to get my car towed. I had her call the tow yard. they told her the same thing. she said she never called the tow yard to get my car. they admitted to her that "[redacted]" called on my car. so there's the first lie there caught in. the security company works for Hb no wonder my car got towed. so they said I owed them 250$ for the car getting towed. I refused to pay. two weeks went by and got a call saying I owed 2000$ I told them I cant afford such a bill. we made a deal that if I gave over my car for 0$ that I wouldn't have to pay the bill. so I did, this happen in march of 2015. I got a bill of sale and a letter I signed saying I wont be fined the 2,000$. I went in person to sort this out but what a waste of time. they told me they had to copies of me signing anything about my car. wow what lairs. it was the day before thanksgiving when I went in to complain. they told me it would take a while to look up the info. he would call back that day or first thing Monday morning. but of course I got no call from any body. I call them back they said the person I spoke to was on lunch and he would call me back of course they didn't. im not going to pay when the deal was to take my car for the 2,000. I only have the bill of sale. but still u should have records of me signing.Desired Settlement: that the bill be dropped or will have to take this to court

Review: Called HB Towing a total of 5 times between 4:14 pm to 8:57 pm 12/20 and was quoted $440-480. By 8 am 12/21 was told would be $600.

On December 18, 2013 I came home at 7 p.m. and noticed my pick-up truck was not parked where I left it. Given that the registration had expired in August, I assumed it had been towed. However, having been "tagged" by the apartment complex before, I was confused. I had gone into my car Dec. 14, 2013 and never saw any form of notification. I proceeded to call the towing company and they informed me that it had been towed on Tuesday, December 17th. I have been living at Hasting Park Apartments for almost a year and they have my license plate, but failed to receive a notification regarding my car potentially being towed. When I spoke to the man on Dec. 18th, he also informed me that each day they charge $50 and I could only pick my car between their business hours of 8 am- 5 pm. I soon called my parents to informed them what happened, given that they would have to financially assist me to gain my car back. On December 19th I went to the DMV and they informed me that I had to pay late registration of $179 to take to the impound. Later in the afternoon of Dec. 19th I started to call Transportation companies to get a quote to transport my car from Sacramento, CA to Rialto, CA. Friday, Dec. 20th, I worked from 8:30 am to 5pm, so I researched HB Towing to get rates and hours for the weekend in order to calculate how much would need to be paid. When I failed to get any information I needed, at 3:52 p.m. I called to get a quote on how much I will owe on Saturday, Dec 21st. The man who answered told me that I will owe $440. I then called my Apartment Complex and spoke to [redacted], Assistant Manager,at 4:08 pm. She then told me that they have pictures of all the cars they "tag". I then asked her to send me the pictures because I needed to present all the evidence to my parents. She told me that she would have to look for them, but to call the towing company because they too had pictures of when the car was towed and picked up. I informed her that I still wanted the pictures that Hastings Park had taken. However, she did not call me back. I called HB Towing and asked what I would have to pay the following day and they told me $440. I then asked the man to email me the pictures when they had tagged my car. The man sent me the pictures taken the day my car was towed. The first set of pictures had no time stamp. I called HB Towing at 4:45 pm and spoke to the same guy. I asked him to send me the pictures of the day the car had been tagged. The second set of pictures had a time stamp dating 12/10/13. From what I had researched, there is a tower for each region. Therefore, the pictures should have been consistent with each having a time stamp, given that the same person tagged and towed my car. After coming home from work, I began calling transport companies. At 6:31 pm I called HB Towing company again and talked to a different guy (He had a nasally voice). He told me that if I picked my car up before 1 pm on Dec. 21st it would be $480 , after 1 pm it would go up $50 dollars. I had informed him that I had been told it would be $440 at 4 when I had first called. He told me that I had been misquoted. After talking to [redacted], owner of California Transport in Sacramento, and guaranteeing a space for my car for Dec. 21st. I then called HB towing at 7:34 pm to ask how much towing would be to tow my car from their facility to CAL Transport in Sacramento, He told me that the starting rate was $100. After calling my parents and [redacted], I called HB Towing one final to time to confirm that it would be $480 dollars. He said it would. The following morning I woke up and called HB Towing at 8:23 am to confirm $480 once again. [redacted], the employee who answer told me that the two men that told me that the price would be $440/$480 where incorrect that my total would be $600. He then asked me if they had been in front of the computer and I said yes because they emailed me pictures. He then said that it would be $600 and I needed an appointment. I went at 10 am to pay.Desired Settlement: I would like compensation and a refund from the company. From Dec. 18th to Dec. 21st, they caused me and my family financial loss, anxiety, loss of sleep, lose my focus of school and work, and most importantly, the loss of my Christmas. Due to the financial impact that HB Towing has caused, my mom informed me that she had to use her savings to help me pay the $600 to get my car. She is now unable to pay for herself and my sister to spend the holidays with me. The importance of this specific Christmas is due to the fact that my maternal grandmother passed away last year on Dec. 15. 2012 and was buried Dec. 26, 2012. I wanted to spend this Christmas as a family, but will be unable to. I am a full-time student and work for the County of Sacramento. I had finals the week this occurred and was unable to get my car during their business hours other than Saturday, Dec. 21st. I was never told the hidden fees, the fee I would be endure picking the car on a weekend, the Lien fee when having the car more than 3 days, and the fact that I needed to make a appointment to pick my car up. There was inconsistency, aggressiveness, and poor customer service between every employee that I spoke with. I plan to file a complain through California Highway Patrol and First Point Management.

Review: On Sunday, April 26, 2015 at 5:30 p.m. my daughter, her fiance and myself arrived at HB towing to recover her vehicle a 2012 [redacted] Civic of which I purchased in cash for her graduation in 2012. The vehicle was towed from [redacted] complex [redacted] via [redacted], which is outside of the 10-mile zone that tow truck companies are to operate within. At approximately 4:00 p.m. my daughter came to my house to get me because I was the registered owner of the vehicle and the towing company stated that the registered owner must be present in order to pick up the vehicle. When we got to HB towing we were met by a male named [redacted], he asked for the Drivers License of the registered owner and the car keys. Due to the dramatization of all that happened my daughter inadvertently forgot the car keys to the vehicle. While my daughter and her fiance were outside in the car looking for the car keys for the car I approached the window where [redacted] was and said to him I am sick since you have seen my ID can they just come back and get the car without me because I was having a sinus attack and my allergies were flared up. [redacted] began to get irate, nasty and flat out rude with me. He said, nope Im leaving I have something else to do and you will just have to come back tomorrow. I asked him nicely not to get snazzy with me and an argument between he and I ensued. He then threw my drivers license at me while I was still present in front of the bulletproof glass via a small slit. It was then that I became irate and used profanity because I was being totally disrespected, abused and disregarded in a place of business as a consumer. After the heating argument I walked outside and tried to call the phone number on the window, which then rolled over to [redacted], and it was then that I told him that I was calling the police on him. I then called the Sacramento Police department and asked for an officer to come to the scene. At approximately 5:54 p.m. I received a telephone call from a coworker from inside of the towing company and I told him that I was not going to speak to him because the police were pulling up.. I have done some research and it does appear that both HB Towing and [redacted] are working together to tow vehicles. This is a violation of 22658 of the California Vehicle Code section (E)(1), which states that general authorization (meaning authorizing itself to tow cars) cannot be given to a tow company. A member of the HOA or private property owner must give authorization (as stated in (l)(1)(A) of the same vehicle code) to tow a vehicle. The only exception for this is if you are parked with 15 feet of a fire hydrant (at which time a picture must be taken as evidence of such infraction). It is against the law to not make available someones car after towing it. It is illegal to tow a car outside of 10 miles from a private property without prior authorization from jurisdictional police department. I called Elk Grove Police Department and they stated to me that they have no written agreement with HB towing and the average towing fees in the city of Elk Grove is $170and HB towing told us verbally at 1:46 p.m. that the fees to pick up my vehicle the SAME day that they towed it would cost $330 which almost double the fees charged in Elk Grove where they towed my vehicle from. It is also illegal to charge more then a tow and 24hr stow that will also be against California Vehicle Code Section 22658. In which it states of a owner or legal representative contacts towing company within 24hrs to resolve issue, pays fine, proves they have rights to the property they will only be charged for the tow and at max 24hr stowing. He refused to meet with us at that time and stated that we could make an appointment at 5:30 p.m. to pick up the vehicle. Those actions above violate Assembly Bill 2210 (Goldberg, Chapter 609, Statutes of 2006) protects consumers against the worst of illegal towing.1.Ten-Mile Limit A tower cannot take your vehicle to a storage lot that is more than ten miles from where it was parked.2.Clearly Posted Warning A tower must have written consent from the property owner or his agent, who must have waited one hour before calling for the tow. Also, a sign not less than 17 inches by 22 inches in size should be displayed in plain view at all entrances to the property. It should prohibit public parking and indicate that vehicles will be removed at the owners expense, and post the telephone number of the local traffic law enforcement agency and the name and telephone number of each towing company that is a party to a written general towing authorization agreement with the property owner.3.Reasonable Gate Fee The gate fee, or maximum hourly charge for releasing a vehicle after normal business hours, shall be one half the hourly tow rate charged for initially towing the vehicle, or less.4.Penalty for Excessive Charges A person who charges a vehicle owner a towing service or storage charge at an excessive rate is liable to the vehicle owner for four times the amount charged. It is well known in the community that [redacted]'s HB Towing Company behaves and conducts and performs egregious business. That tow company is just another old school shake down. For years now, [redacted] has been under investigation for countless acts of Fraud-State and Federal, Grand Theft, Tax Evasion and numerous other charges, His clients (Mainly apartment complexes that Paladin set him up with for the kick backs). It is my hope that the Sacramento Police Department will take a look into this company because they are not honest people at all. There are numerous complaints all over the world wide web as well as the ripoff report and the Revdex.com. Everyone cant be lying about this company!Desired Settlement: I would like to retrieve my vehicle and have the appropriate charges applied.

Response:

Business states that they have spoken directly to customer. She picked up her vehicle on the 27th. There is a 10 mile radius from business location not 10 mile driving time. Consumer spoke with the General manager and charges were modified. Only the original towing fees were charged. Unfortunately the situation took a step in the wrong direction and could have been handled differently on both sides.
