I contacted a contractor about replacing the carpet in my living room, the laminate flooring in my dining room and foyer in early November. The contractor, H-D Electrical Services is someone who’s a close family member. He replaced the floor in my family members kitchen a little over 2 years ago and he did a job on her floor that they were pleased with. The contractor came out and measured my floor and we agreed on pricing and on a date to start the work which was November 14-17, 2017.Several years back I had a different contractor replace the vinyl flooring in my kitchen, dining room, and bathrooms with laminate flooring and tile in the bathrooms. I was pleased with his work. I wanted to give the business to replace my floor this time to H-D Electrical because he was a trusted friend of a family member. Contractor started work removing the floor on Nov. 14. He started in the foyer and dining room area. I completely trusted in his ability to do a quality job on my floor, so I did not stand over his shoulder questioning the work he was doing while was in progress. When he was about 97% finished with my floor, he called me over to look at a specific area that he had just finished. This area is where my entertainment center was sitting. The floor was leaning (sort of sinking in appearance) at the end of the entertainment center. He explained to me that there were imperfections in the floor that caused the issue. I asked if there was something he could do to fix that area. He responded that in order to fix the area he would have to rip up the entire floor he had just put down and said that a subfloor would need to be put down under the entire area just completed. To summarize, the contractor did not finish my floor. Because he removed subfloor and didn't put a subfloor in the living room area, my floor seems weak,is uneven and it squeaks when walked on. Transition strips/trim wasn't complete. Before resolving the issue between the 2 of us, he refused to communicate with me anymore.

Company HD was hired to install new LV flooring. We were to remove old carpet in living room and back hall, remove laminate flooring in the small dining area and at front door. Because of the size of space and the amount of furniture demo and installation was done each day. With about 1/4 of new flooring going down each day. For three days customer walked on new floor and had no issues with work. At end of day 3 HD found a high spot in old floor. Advised customer that we could possibly level it out to make it better. Customer agreed with solution. HD would remedy on day 4. Customer was short on materials so HD purchased remaining flooring and other materials. Day 4 HD made high spot less noticeable and finish laying floor and locked in flooring with corner rounds. Once flooring was down minus transition strips Customer mentioned floor was squeaking in one spot that was not before. I advised her that the only remedy is to pull up new locking flooring and to put down underlayment and reinstall flooring to fix. Because underlayment was not on our original contract and HD is not responsible for unforeseen issues, we need to negotiate a new deal on re doing the floor. So HD made several offers and all were refused by customer.( Please see attachment for offers) So since HD and *** were unable to come to a reasonable agreement. HD suggested that we part ways. HD has not received any money for labor; has purchased additional material that reimbursement has not been issued; and performed additional labor that was not paid for. As floor sits complete floor is down minus 3 or 4 transition strips.

I feel that the contractor should accept responsibility for his oversight in taking up underlayment that was already down in my floor and for not installing new underlayment before proceeding to install new wood on a floor that needed support.
Before this job I had no experience with wood floors and was not even familiar with the term "subfloor or underlayment" . I totally trusted H-D Electrical to do what was appropriate to deliver a quality finished floor when done. When I had laminate floors installed in my kitchen, dining room and foyer area, several years back, it is apparent now that the contractor at that time installed a subfloor under the laminate and it was never mentioned to me in conversation. He did what was needed to ensure my new floor was strong and a quality floor. In fact, I was not aware that there was a subfloor there until this job with H-D Electrical.

On 11/29/18 I prepared and submitted an itemized line by
line list of the cost to the contractor to ensure we both had the same
understanding. I asked the contractor to
review and let me know if he agreed with my itemized outline of the cost that
he stated to me in his last text. He did not respond to my question. On 11/30/18, I asked contractor
to accept responsibility for the labor involved in installing new underlayment
in the floor where he removed the good underlayment that was already there before
he took it up. I estimated the labor for
the new underlayment for the dining room and foyer to be approximately $150.00 since the contractor did not know
the exact measurement of that area when I asked him for it. Once I
submitted the question to the contractor on 11/30/18 he responded that he
could no longer help me and that he wanted to call it even. I responded to him stating that I did not consider
it an even break and asked that we continue trying to work out the details so
we could resolve the issue. I texted him
twice after I received his response stating that he wanted to call it quits asking
for him to communicate with me. He never
responded. With no response received from
contractor and after he refused to continue trying to resolve the issue, no
offer remained on the table. We were at
a standstill since he would not communicate with me any further. Thereafter, I started
seeking out help from other sources (the Revdex.com) to resolve the
issue.
I am more than willing to submit a counter offer
to the contractor when appropriate to proceed in this manner. Please advise if I should do that now.
