***, It was a pleasure talking to you on the phone. As for the response to the letter and complaint that we have received here is what I have. We did receive 3 phone calls from the complainant on some trees that she said... were dying in her yard and she said it was due to the salt bin on our lot. I returned a phone call and left a message. I heard back once after that and she left a threatening message saying she was going to get a lawyer involved. That afternoon I went to their house to see her issues and there was no answer on the door. I left a card in the door and have not heard from them since. The codes dept from the city showed up and took some pictures of the bin and surrounding areas. I had an Arborist come out and check out the trees and he reported that their pine trees were dying due to a blight disease and a beetle issue was detected on the shade trees causing them to stress and die. I let the city know this and they said not to contact her anymore and they would take care of it. (Be the mediator as you will.) Three city guys and a conservation agent returned 2 days later and did a soil sample and some further investigation. The city guys included a codes guy, the erosion control guy, and a stream containment guy. They brought out the surrounding topical graphical maps and made the decision that runoff from our lot does not even flow in that direction of their yard. Our salt bin is located less than 15 feet from another joining businesses salt bin to the north and 150' away from another businesses salt bin to the south. Our bin is built with large concrete blocks, poured concrete, and any crack or crevice is filled with a expanded foam material that holds all the material in the bin to prevent such an issue. There is also a berm that is behind the bin to keep any runoff on our property for the safety factor. As for the complaint of the 3 neighbors I am not what sure what she speaks of and how the finger is pointed to us when I am the one in the middle of the 3 business here I am not sure. She says that their trees are dying because of the salt but their grass is still alive and growing around the trees. The grass would have died first out of anything. They also spray their fence line with a weed killer that is 5 foot away from the trees that also may be part of their problem. As for the city Codes Administration Tracy "the supervisor" concluded that the runoff is NOT an issue that needs to be resolved.
