Initial Business Response / [redacted] (1000, 9, 2017/05/18) */ Contact Name and Title: DeeDee [redacted] Contact Phone: [redacted] Contact Email: [redacted] first came into Sports West Athletic Club 01/05/and was issued a free day pass to try out the gym and classesDuring this day free trial she used the club a few times even taking a spinning class and telling Cathie, our membership director, that she loved it [redacted] continued to talk to Cathie and came in to join the club on 02/07/ [redacted] met with Cathie and explained to Cathie that she lived in lakegrigde and owned her own business as a private chief [redacted] said she had to travel to Truckee occasionaly for work so asked if we had any type of a discounted programCathie extended to her our neighborhood business discount which reduces her rate by $a month [redacted] was very happy with that and decided to purchase months because by purchasing six months you get the seventh month free which reduces the price even moreOn March 20th [redacted] requested my personal e-mail address from Cathie and she sent me an e-mail explaining that she was working as a Ski Instructor and would not have time to use the gym so could she have a refundI did not see this e-mail as it was sent to my personal email and not Sports West e-mailOn March 23rd [redacted] did send and e mail to Cathie at our membership office and Cathie responded to her letting her know that we could freeze her membership until she would be able to use it again after ski SeasonThis made [redacted] unhappy so she told Cathie She would take this matter up wit me, DeeDee [redacted] , the owner [redacted] emailed me and Cathie on April 3rd saying this was her final attempt to cancel her membership for a refund or she would go to the Revdex.comShe added that the club smelt like a dirty wrestling room and that other people said the same thingCathie called me to let me know I should check my personal email because [redacted] was very madI was out of the club from March 25th to April 20th to support one of my kids in their collegiate competitions from Northern CA to SO CAI asked Cathie to reach out to [redacted] and let her know that When I returned to the Club I would address her requestI also sent [redacted] and email from my phone explaining that I was traveling and would look at her request when I returned to RenoI sent an email on April 24th from from our club software system letting [redacted] know that a freeze was put on her membership and she would have months to use upon her returnIn Sports West Athletic Club's membership agreement it states that no refunds will be given to 3, or month prepaid memberships unless the members principle residence is changed to be farther than miles from the club and a forwarding address is provided to send the refund [redacted] s principle address in Lakridge which is less than miles from Sports West Athletic ClubThis email was sent to an incorrect address and it was not until May 17th( because I thought she received my e-mail about putting her membership on freeze I thought this matter was resolved) when I happen to go on to Sport West yelp reviews and saw that [redacted] had posted untrue,cruel,derogatory comments about Sports West Smelling bad and about me as a common practice keeping peoples money even if they are unhappyThe truth is people love Sports West and she is the only one who has ever complained about it smelling like bacteriaWe have hour cleaningI have a big janitorial staff that is always wiping down machines scrubbing shower,vacuuming,mopping and disinfecting 24/ [redacted] has resorted to bulling and degrading me and my staff because she did not get what she wantedThat is wrong and cruel.I did send her another email on May 17th explaining why her emails that she sent to my personal email were not read until yesterday and that I hoped we could work this out amicable [redacted] respond with, If I, DeeDee, was a business owner I would have handled this differently and it can not be resolved amicable [redacted] signed an agreement and received a discounted rate because her primary residence, that she said was where she worked as a private chief, was located in LakerigdeIt states in the membership agreement that no refunds will be given to pre paid membershipsMyself and my staff tried to offer [redacted] different solutions and options but she has resorted to bulling and untruths Initial Consumer Rebuttal / [redacted] (3000, 11, 2017/05/24) */ (The consumer indicated he/she DID NOT accept the response from the business.) The owner of Sports West, DeeDee, has misrepresented all of the facts above I submitted a receipt to the Revdex.com that I paid for a months membership totaling DeeDee is claiming that I'm paying dollars a month for a membershipThis is not the truthMultiply x 6, and the answer is dollars, not And there is a refund clause in the membership agreement, although it's vagueRegardless, DeeDeee needs to get her facts straight Cathie, who is referred to in the owner's response above is the one who gave me the club owner's email and suggested that I contact herI tried to contact her on the club email and by phone and received no response Further, DeeDee refused to respond to my numerous requests for a refundShe refused to answer the Revdex.com complaint She finally responded only the day after she saw my Yelp review, on May 17th directly to me, offering a litany of excuses why she hadn't responded to my numerous requests for a refund Her answer to me, in addition to a rant accusing me of "making her staff unhappy"(how this is possible, I have no idea, since I used the club since the two times in the first week, and the only person I've had any contact with has been her sales manager) was an offer to "freeze my membership"This offer is completely useless as I will never use the club, and is a non-response to my complaint How a business owner can completely disregard a customer's request for a refund after they paid for a membership that they used twice(and no, clearly I was not happy or I would have used the club more than twice) is beyond me I am still requesting a refund, not a membership freeze, as I've told the sales manager and the owner many times Again, my address is in Kings Beach, CaliforniaI work in TruckeeAnd I'm a chef, not a chiefAnd several people that I've spoken to have also had negative experiences with this club owner, and although DeeDee claims that she is a wonderful business owner, she has done absolutely nothing to try to resolve my request for a refund She has repeatedly ignored me until the day after my Yelp review was posted, which clearly was the only action that got her attentionI have been patient and asked politely for a refundShe's been rude, dismissive and belligerent in answer to me It's unfortunate that she couldn't have tried to resolve this amicably, as she claims she's doneI am happy to submit all communication back and forth to date if this is helpful I have no idea what DeeDee is speaking about with her numerous references to "bullying" and "cruelty"It appears that her actions are inflammatory rather than amicable Final Consumer Response / [redacted] (3000, 15, 2017/06/05) */ To DeeDee, Owner Sports West DeeDee, I'm requesting one last time a refund of plus tax, for a full refund of the month membership that I used twice in the first two days of my membership that I paid in full at the time I joined I have not visited the club since that first week because of the smell in the club I will take direct action to recoup this loss through small claims court as my next step and I'm giving you the opportunity to correct this situation; an opportunity that you've had for months but have chosen to disregard Please advise at your earliest convenience what you plan to do so that I can proceed accordingly [redacted]
