I am rejecting this response because: I ordered the hearing aids on May 21, I received them on May 31, On June 21, 2016 which was three weeks after I first received them, I complained to P***, the sales agent that they didn't seem to be working for me in that I still had the same problem with hearing on phone calls and also understanding conversation in movies and tvP*** told me that it was going to take longer for the hearing aids to help because I had the hearing problem for a long time and that I couldn't expect results this quickI kept using them for the next few months with no improvementMy next appointment was in January of I cancelled the appointment and went to see a hearing specialist at the Sky West Medical CenterAt the Doctor's suggestion I tried to return the hearing aidsI first wrote to P***, then to O***, Then to Miracle Ear and was refused by all of themThis in spite of their brochure which plainly states "100% Satisfaction Guarantee" and also their mailed advertisement which very plainly states "100% Satisfaction Guarantee" You"ll love your new hearing aid, or we'll take it back.I appears to me that they simply tell customers to use the aids for a longer period of time and then quote the Consumer Rescission Rights contract which allows a thirty day period to returnThis same document says "I have been advised by the undersigned dispenser that the Food and Drug administration has determined that my best health interest would be served if I had a medical evaluation by a licensed physician who specializes in diseases of the ear before purchasing a hearing instrumentI do not wish a medical evaluation before purchasing a hearing instrument. I am years of age or olderSignature___________________" I did not sign this waiver. The Doctor doubted the contract validity in that P*** did not enter his license number on the contract

Ms*** *** purchased hearing aids from us on 11/10/2016, they were delivered on 11/15/2016, and we provided her a day return period as is custom to all of our patients. Since her delivery date, Ms*** has scheduled five visits, three of which she attended. At no point was
there any indication that Ms*** was "not capable of understanding purchasing, [and] comparing and [sic] the consequences of signing contracts" or that she had a guardianship, conservatorship, or anyone else with a power of attorney to make her decisions for her.Mr*** came to the store almost three months after his mother purchased the hearing aids to ask for a refund, asserting his mother was "not capable of understanding purchasing, [and] comparing and [sic] the consequences of signing contracts." This was long after the return period, and past the point at which the manufacturer would accept a refund. Our consultant had nothing to go off of except Mr***' word; to verify Ms*** was incapacitated, the consultant simply requested proof of her incapacity. A doctor's note or some other form of verification such as a power of attorney over Ms*** at the time of purchase.Mr*** has not provided anything to-date

I am rejecting this response because: This is their typical responseThey do not take any responsibility for the fact their product does not work well for all peopleThey simply tell a person that it takes longer to show results until the satisfaction guarantee is no longer valid if in fact it was ever validAs far as I'm concerned miracle ear is just a rip offPossibly the FDA might be a better place to complain about their practices

In response to customer [redacted], there will be no refund because it is well pass the 30 day return privilege. We are sorry to hear that he is not happy with his aids, but it doesn’t mean the hearing aids are not working for him.  After speaking with the consultant, the customer was...

happy during his trial period. Here are notes from his chart during that period:    6/10/16  Called and spoke with patient, very happy with adjustments,, said maybe call him Monday to check in,, as of now no reason to go in next Tuesday-BW   6/8/16  called to see how he is doing and said that he needs more time to tell,,, said I will call Friday-BW   6/01/16  Called patient to see how he was doing with aids.  Said everything seems to be good but needs some minor adjustments.  Set apt for Tuesday, June 7th-BW   Our number one goal is to help people hear with our hearing aids. Everything shows that the performance of the aids are working properly as well.  We recommend strongly to continue to wear the hearing aids every day, all day to get maximum benefit. Partial compliance to this will make it tougher to rehabilitate the hearing process, which wouldn’t be the fault of the aids, but the user.   We implore that Mr. [redacted] continues to wear his aids and to continue with our free lifetime service to protect his investment.   Sincerely,   Zach B[redacted]
