Customer’s Statement of the Problem:In
and 2011, I was involved in three car accidentsI received care from Healthwise Care Center and Physical TherapyI found out last week that in and Healthwise Care Center and Physical Therapy put three liens on my home in and I was never notified that they would be putting liens on my homeI was never given a choice of paying the bills until the insurance companies settled or having a lien put on my homeMy three claims were paid by the responsible parties' insurance companies within months, months, and months of my initial appointments for treatmentsCan businesses put liens on people's homes without any kind of notification? After a lien is placed and payment has been made, does the business have any responsibility for releasing the lien?
Desired Settlement:I would like the liens against my home removed. I would like to know if it is legal for a business to put a lien on a person's home without any kind of notificationI feel the public needs to know that if they seek treatment for car accidents at Healthwise, a lien may be placed against their homeDo businesses have any responsibility for removing liens once the debt has been satisfied?
An employee received notification from Mr*** on Friday, April 17, that he needed someone to contact him immediately regarding liens that were filed from our office against himHe was in the process of refinancing his house and needed to show the lender that the balances relating to his and automobile accidents incurred at our office had been settledThe employee notified Mr*** that the business owners, Stacy and Rich Y***, were out of town and would not return until the early part of the following week. Mr*** was informed that Rich Y*** would be the one that would be helpful in filing an ACKNOWLEDGMENT OF SATISFACTION OF LIEN FOR MEDICAL SERVICES FROM HEALTHWISE BACK, NECK & EXTREMITY CARE CENTER, P.C
On Monday April 20, *** *** contacted the main office and spoke to Billing & Patient Accounts Manager Gina H*** regarding the matterGina explained that our office files the liens for settlement proceeds ONLY, not liens against any personal property of *** ***, with the Recording Districts Office. She also explained to Mr*** that our legal counsel has told our office that the liens will fall off once the account has been paid in full. Gina ensured Mr*** that when the business owners return to the office that she would assist the owner in expediting an acknowledgment in the Recording District to show that the liens have been satisfied as per his request. Mr*** also requested that a letter be drafted and sent to him to show that he does not have an outstanding balance for the two liens that were filed and in question. Gina drafted a letter and attached the ledgers for the corresponding cases to show there were $balances on the day of his request, 04-20-15. The letter and ledgers were scanned and emailed to Mr*** at ***.***@***.gov with the body of the email message as follows:
Hi ***,
Attached is the letter and a copy of the ledgers for the accounts associated with your motor vehicle accidents from and
Let me know if you require anything further!! I will get the form all ready for Rich to take in when he returns to the office that shows you have a settlement of lien for both of those accidents

The Attachment document was the following letter:
Dear Mr***,
As per our conversation, I looked into your previous accounts from your two past motor vehicle accidents dating back to and Our office had filed liens at the Alaska Recording District’s Office for both of these accidents to ensure that when you reached a settlement, the third party was aware that you had incurred medical costs that would need to be taken into account
I have attached both the ledgers for both accidents showing that you have a $balance on each of these accounts
Please find this letter satisfactory to any third parties inquiring whether you still have a balance at our office due to these listed accidents

The Acknowledgment of Satisfaction of lien for the two liens we discussed were filed at the Recording District’s Office on April 22, and Gina spoke to Mr*** that day to inform him that this had been done
Healthwise Care Center’s office policy for cases that are related 3rd party payment due to an automobile accident states that every patient that wishes to bill their personal automobile insurance or a third party automobile insurance must sign and have notarized a LIEN OF SETTLEMENT PROCEEDS TO HEALTHWISE BACK, NECK & EXTREMITY CARE CENTER, P.CAND/OR HEALTHWISE PHYSICAL THERAPY, INC. The lien has been written by our legal counsel and specifically indicates that the lien is for settlement proceeds to pay outstanding balances due at Healthwise Care Center and / or Healthwise Physical Therapy for services rendered at our clinics. The lien is not a lien against a home or other assets owned by Mr***. The filing of the lien is designed to facilitate proper payment of the claim when a Healthwise Clinic has offered to extend credit to a patient as a courtesy while the patient waits for the settlement payment from the insurance company.
The version used for liens filed for Mr*** *** is worded as such:
Healthwise Back, Neck, & Extremity Care Center, P.Cand/or Healthwise Physical Therapy, Incis providing professional medical services to me, ______________________________(full name). Healthwise Back, Neck, & Extremity Care Center, P.Cand/or Healthwise Physical Therapy, Inchave agreed to wait until my case against the third party is resolved in order to be paid in full. In consideration of Healthwise Back, Neck & Extremity Care Center, P.Cand/or Healthwise Physical Therapy Inc.’s providing me medical services and receiving payment at a later date from settlement or litigation proceeds,
I HEREBY GRANT A VALID ASSIGNMENT of the settlement proceeds, damages or compensation to Healthwise Back, Neck & Extremity Care Center, P.Cand/or Healthwise Physical Therapy, Incto the extent of the billings for medical services provided, interest accrued and other reasonable costs
I HEREBY IRREVOCABLY ASSIGN TO HEALTHWISE BACK, NECK, & EXTREMITY CARE CENTER, P.CAND/OR HEALTHWISE PHYSICAL THERAPY, INCall settlement or litigation proceeds received to the extent of my unpaid bill to Healthwise Back, Neck, & Extremity Care Center, P.Cand/or Healthwise Physical Therapy, Inc. This valid assignment binds myself, my heirs, my beneficiaries and my legal representatives. This Valid Assignment shall have priority over all other assignments not entitled by law to priority
This Valid Assignment shall remain in full force and effect until Healthwise Back, Neck, & Extremity Care Center, P.Cand/or Healthwise Physical Therapy, Incis paid in full for all services provided to me
It is our office policy and standard through the chiropractic and medical professions to obtain and file a lien of settlement proceeds for 3rd Party PI cases or cases where payment is not collected at the time of service as is often the case with motor vehicle accidents. The courtesy offered by these clinics ensures that patients may access care without the up-front financial burden.
The lien filed by Healthwise Care Center was not a lien on Mr***’s house as he claimsMr*** was also aware that liens had been completed for medical proceeds as both liens needed to be signed and notarized by Mr***. The forms then needed to be returned to our office in order for them to be filed at the Recording District. The lien, as seen above, clearly states that it is a lien of settlement proceeds. This is certainly not a lien on any other of Mr***’s assets and / or his house.
Unfortunately, this patient did not fully understand the reason for the liensOur office will certainly spend more time educating patients about the importance of our lien policy in the future as we strive to have open and clear communication with our patients every day.
We hope that the Revdex.com will find after a review of this case that Healthwise has upheld its policies of medical billing and that our practices are sound. Healthwise staff and owners communicated in a timely manner with this patients requests. Mr***s initial lien concern presented on Friday, April 17th at 7:40pm to our providers, DrM***, emergency care text message
Our billing specialist, Gina, was able to speak with Mr*** on Monday and provide him a document stating that all bills had been paid along with ledgers to document. Settlement of lien was filed by Rich Y*** on April 22.
Our office has done our very best to provide a favorable and timely outcome to the requests of Mr***Upon our last communication with Mr***, there was no reason to suspect further dissatisfactionHealthwise Care Center & Healthwise Physical Therapy strives for excellence in patient care and in our billing practices and we do not feel that this complaint is justified
DrY*** did make contact with Mr*** Thursday June 4, around 4:30pm via phoneThey were able to determine that Mr***’s concerns were due to a misunderstandingHe verbalized that he will be making contact with the Revdex.com to retract his complaint both through email and phone as the issue has been resolved
