I was offered a free trial I was billed $109. A little over two weeks later. I was then billed $336 over the next 3 mo. W/o receiving product
On May 9 2020 after completing a survey I was offered a free trial of L'Ancee perfector cream. On May 21 without knowing I was debited $109. On June 22 I was debited $111.90 again on July 22 for $111.90 and lastly on August 22 another $111.90. I have never received any additional product besides the "free" trial in May. Once I became aware of these charges I contacted the number on my bank account statement.
On September 1 2020 I spoke with two women the second being a supervisor... and both refused to refund me for the months I received nothing. I was made aware I had entered a subscription when I claimed the trial offer. I never read ANYTHING regarding a subscription or needing to cancel or even how long I had before cancelling. They said the first $109 charge In May was to cover the cost of the trial jar...
After refusing to let them ship me the three months worth of product I had paid for I was told "all sales are final".
I stayed this wasn't a sale! They just took my money and never even shipped me anything... she refused to answer or acknowledge the fact that I wasn't sent anything but was charged repeatedly. After getting nowhere she informed me her supervisor doesn't take calls... and she gave me an email address only. I repeated that do not want the product and to not send it to me.
I know it's completely illegal to take money repeatedly without sending the purchased product. It's theft. Plain and simple.. I did receive emails after stating my subscription was cancelled. Three emails actually cancelling three different supposed orders... that I never approved and that I never received anything for.

Desired Outcome

I am requesting the $335.70 that was debited from my account be fully refunded. Even though I was swindled into the first month.. I acknowledged that I didn't cancel the subscription (I wasn't aware I had made) in the time allowed. I stated I understood the first charge in May 21 of $109 was to cover that jar of cream. But the three consecutive months of charges that I received no product for needed to refunded immediately. I was denied that blatantly.

The date it was actually sent was 7/21/2020. I took the survey in May. I was charged May 21 also June 22 and then July 22 and also August 21.
The company claims I had 12 days to cancel their fake subscription as of May 9. And they charged me for the sample and enrolled me in a monthly subscription. But they didn't send The sample until July 21!! This is outright theft.

To whom it may concern,

After reviewing Ms. complaint we want to apologize for any confusion. The package you received is a full thirty day supply, we do not offer sample sizes. We sent you a full size bottle and allow you to try it for the 14 day trial period to see if you like it, for just the cost of shipping and handling. If you like the product after your trial, you are billed for the actual cost of the product and enrolled in a monthly subscription. The reason we send you a full 30 day supply to try is because of the overwhelming response and feedback from customers who love the product, and want to continue seeing their results.

Unfortunately since a dispute with filed with the bank we are unable to issue any refunds on the account at this point to avoid consumer fraud. In addition, her account with us is inactive; therefore, she will not receive any further shipments. We hope she is satisfied with our business and we want to apologize for any inconveniences this may have caused.

I understand their statements about "trial" and what seems to be the policy included, however, I was billed shipping and handling On May 9 and then charged the rest of the full monthly amount on May 21. I was charged again on June 22 for $111.90 and again June 22 for $111.90. I received the first and ONLY shipment on July 24! This is clearly not in the 12 day period I was supposed to cancel the subscription. Let's also keep in mind I wasn't ever informed that I Was entering a subscription. I was billed 335.70 before I ever received that shipment! When I talked to Candace agent 284 on October 1 she acknowledged the shipment was sent July 21 and refused to refund me. She wouldn't explain why I was billed for three months before receiving the trial.
The response provided by the company and the explanation of why they charged me for products not received wasn't at all answered. They also didn't address the fact I wasn't given the product in sufficient time to make the decision myself.
There is absolutely NOTHING legal about these transactions. I was denied any refund and denied explanation of their fraudulent practices.
