Thank you for bringing this to my attention. I am so sorry for any misunderstanding. We have been very happy to have you as a member since 2010. We felt during your membership with us that we did all we could to keep you motivated and help you through your stressful life situations....

In reviewing your file and the documentation of your visits and our conversations with you I found some discrepancies.
In your complaint you stated: I noticed that they did not stop my membership but kept deducting money from my account.
We took note that at your last visit with us on June 27, that you were going to have foot surgery the coming Monday and stated that you would let us know when you were able to get back in. As with all medical freezes we request a Doctor's note for our records. We never received a doctor's note from you but we put your account on medical freeze for one month.
On July 7, we sent you a Get Well email
On July 17 we spoke with you and you said you were going to Physical Therapy and that it would be 2 more weeks.
On July 28 we left a voice message to set a daily visit with us and invited you to one of our events.
On August 20 we emailed information about the Ladies Bazaar in our Atascadero center
On Sept 19 we emailed an inspirational quote to encourage you to come in.
On Oct 2 we left a voice message asking how your foot was, that we're here to help re-motivate you, give you recipes, and to set an appointment with us.
In your complaint you stated: When I contacted them on October 8, 204, I specifically told them I wanted to cancel my account. They sent back a reply but I assumed the matter was over.
Our records confirm that on October 8 one of our employees had a conversation with you at which time it was discussed that we would credit you another month (even though we still had not received a doctor's note) and that we would put your membership on freeze for 2 months (with no charge) due to the fact that you were overwhelmed with work, taking care of your mother and the coming holidays.  The conversation also went on to clarify that If you wanted to continue with us that you would need to let us know by January 5th, 2015. An email (below) was sent directly after this conversation confirming the agreed upon status of your membership.

On February 25 a voice message was left for you to call our employee who handles your account. You called while she was meeting with a client, she called you back 30 minutes later but no one answered.
On March 2nd I left a voice message that I was wanting to check on you and encouraged you to take time for yourself.
   Our staff received an email from you in February 24 & 25th that you had contacted us and let us know you wanted to quit and that you were canceling your bank account.

It is our normal policy to receive a 30 advance written notice, which we did not require from you. You sent another email on March 26 stating you wanted your membership cancelled. Our employee called you immediately to assure you that your membership was cancelled on March 7, 2015, but you hung up the phone on her.
Below shows the free months you received from us (4 months total) and again we feel we did everything we could to communicate with you and assist you with your health & weight loss goals.

I want to cancel my gym membership.  
I was looking at my credit card charges for the past few months and didn't see the reduction for when I had my surgery in June.

Sorry [redacted] Our mistake! Usually when your doctor's note is brought in we freeze your month with no charge. I would be happy to offer you a free month. If you are still wanting to end your membership please let us know.

My Doctor said they would notify them that I would be unable to walk or stand after surgery.  I will check with my doctor to find out if and when they notified them.  I did not contact Healthy Inspirations again because I thought the matter was closed on October 8th, 2014.  I thought the calls they made after this date were an attempt to get me to rejoin the club. Apparently this was to continue to deduct money from my account.

Review: I had surgery on my foot in June 2014 and asked Healthy Inspirations to stop my membership while I recovered which they advised. I could not stand after surgery let alone walk. I noticed they did not stop my membership but kept deducting money from my account. During my recovery I did not anticipate that I would have to keep in contact with them to stop charging me. In October 2014 I noticed they had not stopped taking money from my account. When I contacted them on October 8th 2014, I specifically told them I wanted to cancel my account. They sent back a reply but I assumed the matter was over. They are still debiting my account and my bank says to close my account and open a new one. This is an inconvience since I have other automatic deductions. I was hoping to solve this matter without all the trouble they have been determined to cause. I did not want to file a complaint or take them to court but I can't seem to get through to them.I see this as an unethical business practice and will let others know not to do business with them.Desired Settlement: I have been charged $59 per month for over 9 months in which time I have not used any of their servces. I think I should at least get a refund from my date of cancellation on October 8th 2014.
