Complaint: [redacted] I am rejecting this response because: I disagree with [redacted] on a couple of counts: The statement that my hot water baseboard heating system is old and therefore prone to breaking is insubstantial at best My parents home has the same hot water base board system Their place is over years old and has never suffered any leaks If the radiator piping was considered an obstacle to the performance of work needing to be performed, the Healthy Way foreman should have notified me As it was, when I pointed out the radiator piping going back into the concrete and asked him to be careful around it, he told me it would be no problem, that they deal with these types of situations all the time Since [redacted] does not seem inclined to take responsibility for repairing the damage his crew inflicted on my home, I am inclined to just let the complaint stand, as is Regards, [redacted]

The customer states in his response that the baseboard heating system hasn't had a problem in more than yearsHow about "old age"? I have been around many of these systems in my years of experience and a lot of them needed to be repaired or replaced much sooner than plus yearsTherefore, I respectfully disagree with *** *** that he could be 100% sure that Healthy Way caused this problem.
In addition, number of the "Terms and Conditions" states that, "...Contractor shall not be responsible for damage to or repairs of paneling, tile, carpet, or other obstructions, or property on walls, floor, or otherwiseThe baseboard heating system is considered an obstruction since it was against a wall that we had worked onAlso, it clearly states that we are not responsible for damage to or repair of carpet
As stated in my previous response I will reimburse *** *** for the plumbing bill that he forwarded to usI will not agree to pay for the replacement of his carpet

Let me address the comments from Health Way one at a time:

I am not seeking redress for damages caused due to seepage or water leaks. I am looking for Healthy Way to pay for the damage caused by their construction team to the radiator pipe and subsequent water damage caused when said pipe started leaking after the heating system was turned on in mid-November

I can be quite sure that Healthy Way caused the problem. I have been in this home for more than 30 years. During all that time we have never had any problems with the hot water base-board heating system leaking. The damaged pipe sits in a corner behind a large “L” shaped sofa. No one has performed any work in that corner of the family room until Healthy Way came to install the French drain at which time Healthy way broke into the concrete flooring around that water pipe. Healthy Way did perform the work in July of 2013 and the leak was not manifest until November because there was no water being pumped through that radiator system until the heat was turned on in November.

The leak was pumping about two quarts of water into the family room each day. Given the slow response by Healthy Way to my concerns, I felt I could not afford to permit this leak to continue. I telephoned their office and informed them that I needed to have the repairs completed and would FAX them a copy of the plumbers bill. I am not surprised by the foreman’s remark considering the need for allegiance to his employer.

If the radiator piping was considered an obstacle to the performance of work needing to be performed, the Healthy Way foreman should
have notified me.  As it was, when I pointed out the radiator piping going back into the concrete and asked him to be careful around
it, he told me it would be no problem, that they deal with these types of situations all the time.

Review: Last Summer, Healthy Way installed a French drain in my family room that required breaking into the concrete floor up to the return piping for the radiator that heats the family room. I expressly requested that [redacted] and his crew be careful around that heating pipe. I waited for about two months before I had carpeting replaced and put the furniture back to make sure the French drain was working and there were no longer any leaks. The work seemed to be done well and we had no leaks during heavy rains in August and September.

Near the end of November, after the heat had been turned on and water started flowing through the radiators, I noticed that the carpeting in front of the couch that sits in that same corner was wet. When I pulled the couch away and pulled back the carpet, I found that the pipe just before the bend into the concrete that had been broken into to install the French drain, was leaking.

I called Healthy Way and they dispatched a crew the following evening to examine the problem. After looking at the leaking/damaged pipe, [redacted] told me that we would need a plumber and that he would inform the office of the problem (this was on a Friday evening) the following morning.

I phoned Healthy Way the following morning and left a message, since the office is not staffed on weekends. I phoned again the following Monday and described the problem to [redacted]. I was told by [redacted] that I needed to get an estimate of the cost of repairs and informed her that I would get estimates from a plumber and follow up later with estimates from a rug installer. [redacted] responded the following day to look at the problem. The leak was producing about two quarts of water a day and I was trying to shunt it into the drain hole that [redacted]’s team installed near that corner of the basement. Healthy Way requested that I send the estimate to them before the plumber performed any work, but at two quarts of water a day, I couldn't afford to wait.Desired Settlement: I have requested that Healthy Way reimburse me for the cost of the plumbing repairs ($538.31) and for the cost of replacing the damaged carpeting in the family room($2,384.76). I fax'd a copy of the plumbing bill to Healthy Way on December 17, 2013, which has been ignored. I also sent a detailed letter of explanation to Healthy Way on January 10, 2014 that included the estimate to replace the damaged carpeting, which has also been ignored. I agreed to use this company largely on the strength of their web page that indicates they are fully insured.

Therefore, I respectfully disagree with [redacted] that he could be 100% sure that Healthy Way caused this problem.

In addition, number 5 of the "Terms and Conditions" states that, "...Contractor shall not be responsible for damage to or repairs of paneling, tile, carpet, or other obstructions, or property on walls, floor, or otherwise. The baseboard heating system is considered an obstruction since it was against a wall that we had worked on. Also, it clearly states that we are not responsible for damage to or repair of carpet.

As stated in my previous response I will reimburse [redacted] for the plumbing bill that he forwarded to us. I will not agree to pay for the replacement of his carpet.
