Here are the facts: [redacted] came to HTA on July 1, 2016 on the recommendation of her ENT physician.  She seen for audiometric testing and a hearing aid evaluation. The results clearly indicated she had a very significant hearing loss and would benefit from amplification.  [redacted]...

ordered a pair of hearing aids at the time of her visit with a sale price of $3,950. As noted in the attached Purchase Agreement, a deposit of "1/2 the purchase price is due at the time the order is placed".   However, due to her stated financial constraints, she could only afford to put down a deposit of $100 and agreed to obtain financing from [redacted] - HTA's financing company. ( We offer a special program where financing is at no cost to the consumer). HTA made the application and she was approved. She returned on July 14th and was fitted with her Hearing devices. We set the prescription and reviewed use and care.   She returned for the first follow-up on July 20th.  She returned the Hearing Aids on July 28th for credit.  As noted on the Purchase Agreement, State Law allows the provider to retain a Cancellation fee of "10% or $300 per pair, whichever is less if the hearing aids are returned within 30 days".  The contract had been reviewed with [redacted] and she signed the contract.  The contract is attached to a separate email. Since [redacted] only made a deposit of $100, she is not entitled to "refund".  We are a professional audiology practice.  In addition, to amplification, there were other professional services provided to assist this patient and her hearing/work issues, all at no charge to her.   Please contact me should you need any more information on this matter.       Gail *.
