Please be advised that [redacted] has consulted with our law offices regarding yourrequest for a refund.Enclosed are copies of the Consulting and Design Agreement (signed by you on December 28,2014) (hereafter, the “Agreement”), the Branding and Messaging Enhancement... Proposal (signed by you on December 30, 2014) (hereafter, the “Proposal”), and numerous related emails.Your claim for breach of contract is entirely without merit. Contrary to your claim, Ms. [redacted] at all times acted in good faith and fully complied with the terms of Agreement and your instructions. The Proposal clearly indicates under the second bullet point under Phase I that the branding services would incorporate your “ logo and business name ” Again, you signed off on this. Additionally, there are numerous email communications from you and your “mentor” in which satisfaction was expressed regarding the progress of the services provided to you underthe Agreement. It is clear from your communications that you simply changed your mind about the creative direction of the branding project. That is not a valid basis for a refund.Had you not changed the creative direction, Ms. [redacted] would have continued to work with you to complete revisions to the draft designs as established in the contract, ultimately delivering something you approved and could work with.Nevertheless, though the Agreement does not provide for a refund, Ms. [redacted] offered a partial refund of $400.00 as a good faith gesture. The partial refund offer is contingent on your signature of the settlement agreement that Ms. [redacted] sent to you on February 17, 2015. That offer is still in place, but it will expire 10 business days from the date of this letter. Please send the signed settlement agreement to the undersigned referencing our file number (3580729). Upon timely receipt of the signed settlement agreement, we will arrange for Ms. [redacted] to send you the $400.00 partial refund.Nothing in this letter should be construed as a waiver of any of Ms. [redacted] ’s rights or remedies, all of which she expressly reserves. Please be advised that this letter is written pursuant to California Evidence Code §1152, and any and all information and documentation submitted herein is for the purposes of settlement only, and nothing contained herein may be utilized in the subject proceeding.Thank you for your anticipated cooperation.Very truly yours, [redacted] · [redacted] LLP

Greetings ***,
Thanks for your messageMeanwhile, I've checked for your previous message with the details about the complaint itself, and I don't have itThe March spam folder was deleted at the end of the month, so I can't go back and look therePlease resend whatever you sent me on the *** *** complaintI need to provide it to my attorney at ***-*** ASAP.
Meanwhile, below is the latest letter that was sent to her from my attorneyIt clearly spells out our perspective on the situation with Ms*** and indicates that we've trying to work with her to resolve this since February, when we sent our initial Settlement offerAlthough not legally warranted, I even offered her a partial refundExcept to reject my original offer back in February, she has not responded.
I am awaiting a callback from my attorney on how we'll handle the Revdex.com complaint she has lodgedIn the meantime, I hope this suffices to put this matter to rest at the Revdex.comI am wholeheartedly, and at additional expense to my company, doing everything I can to resolve Ms***'s issueI cannot compel her to engage, and for her to ignore my attempts to make her whole, while unfairly and inaccurately characterizing the dynamics of the situation, is inappropriate at the least.
Please let me know if you require additional information from me.
Blessings,***

Dear [redacted],
Firstly, the address? [redacted] found on the internet is almost 5 years old. She never bothered to ask for my mailing address and what she has?
for me is not up-to-date, therefore I never received the correspondence from ?her?
lawyer last month. Regardless of the legal side of this, the Revdex.com is here to make sure that both parties understand the issues of said disagreement, and I don’t believe that [redacted] does entirely understand the disagreement. Although the offer for a $400 “refund” is a good step, that portion of the payment made to ?her?
is not the portion in question, because that is the unused portion of the funds ?she?
?was?
allotted to work with. The portion in question is the bulk amount that ?she?
quoted as being tied up in the creation of a design that? lacked quality, creativity, or connection to my business and me. There was confusion about branding my name verses my business name. I was lead to believe that [redacted] was doing a mock up of both and we would move forward from there. This did not happen. She produced a very unprofessional, low quality, mock-up of my business name that was a huge disappointment. My professional business mentors were shocked by the low quality and everyone agreed it was unusable. When we agreed to move forward and brand my name she then wanted to charge me even more money. It?
?did?
not meet the qualitative level that? she?
led me to believe would be achieved through ?her?
work. This is the source issue that I would like for you to understand. This is about the quality of the work and the integrity of ?her?
business.
From the perspectives of personal and business integrity, I firmly believe in fair exchange of value: if I have not provided value to the client, I have not earned my fees, and to claim fees without providing value is tantamount to theft. These are strong words, and I mean them to be so. My faith in these principles of client service and satisfaction are steadfast and inviolable. I sincerely hope that [redacted] will also come to recognize these values, if she doesn't already, and that she will do the right thing by me as her client. To put a very fine point on it, I received nothing of value from our engagement. My implicit understanding of any business-service agreement is that I will gladly pay fair and reasonable fees in exchange for equivalent value received. As the process unfolded, I steadily lost faith in ?[redacted]'s?
ability hear and address - much less to dissolve - my concerns. In the end, the proposals did not ?meet any standard of professionalism?
, and I received nothing that I could use. While our contract said nothing regarding satisfaction guarantees or criteria for work-product acceptance, neither did it state that I was retaining you on a strict time & materials basis regardless of outcome. Thus, herr refusal to offer a full refund feels to me like theft, and nothing will dissuade me from feeling anything short of ill-will at the injustice done.?My request is for a full refund of the $1750 I gave [redacted].  She charged $1350 for the unusable, unprofessional, kindergarten-like mock-up she created.  I'm open to negotiating but the unused $400 is already due to me.  Using this as a negotiation tool is yet another sign of her lack of integrity and poor business sense.
Regards,
[redacted]

Review: I am extremely dissatisfied as a consumer with the work that was provided to me by Heart of Living Vibrantly and [redacted]. I was told and led to believe that my satisfaction and the integrity of her work are important. [redacted] of Heart of Living Vibrantly clearly expressed her commitment to producing high-quality work with integrity to me, the customer. However, my experience is that her words were incongruous to the work that she produced and the price at which the work was valued. I consulted with several business coaches and colleagues regarding the work that was produced for me, and it was unanimously clear that none of the material was useable by me. They agreed that the look and feel of the product looked unprofessional, homemade, and immature. I was promised high-quality, professional branding, yet the initial production did not even have the quality necessary to perform a revision. [redacted] strongly defended her position, and my needs were ignored. I received no value for what I paid for. As a consumer, I feel that the bottom-line for the Heart of Living Vibrantly is purely monetary gain with disregard to customer satisfaction and delivery of a high-quality useable product.I received nothing of value from my engagement with [redacted]. The contract itself was unclear, as it states that Heart of Living Vibrantly would brand my name and also brand my business, although only one of these was actually branded my business. I wanted to brand only my name, and asked [redacted] to do this verbally during one of our conversations. While our contract said nothing regarding satisfaction guarantees or criteria for work-product acceptance, neither did it state that I was retaining her on a strict time & materials basis regardless of outcome. Thus, her refusal to offer a full refund feels to me like theft. Finally, she presented a grossly inadequate legal settlement agreement for me to sign, absent any hint that I had agreed to such terms. I refused to sign.Desired Settlement: I desire a full refund of $1750.00 from Heart of Living Vibrantly.
