[redacted], married to a sister of [redacted], engaged our company to provide services and he had [redacted] sign the agreement and sign for the first payment made, see the attached copy of check. Subsequent payments were made via telephone and using [redacted]’s credit card and authorized by [redacted]. I was certain at all times since I would go to the home of [redacted] and was personally aware that she had him take care of her bills as she mentioned to me as well. There was never a question about this arrangement as many elderly clients have family members conduct business for them.  Credit card payments were approved by [redacted] over the phone as so many other clients do, there was nothing out of order in my view. [redacted] was the financial person managing the payments for [redacted]. He contacted me via telephone calls and text. Although he provided me an email address he never used it, he said. I sent him invoices to his home address in Waldorf: [redacted], Waldorf MD, 20603, with a home number ###-###-####; mobile; ###-###-#### and email address; [redacted]@[redacted].com.     [redacted] never questioned the payments he made or the invoices he got at all during the time we provided services. He never asked any questions, I suspected that HE being an accountant by profession, would  figure out the number of hours provided daily and multiply be the hourly fee and that was that and once service has been provided, we have earned the payment with or without invoice. The client was bed ridden and needed for the most part during the duration of our services, 24 hours of daily care until the very end when she began to get better, our employees were at the home one at a time, and the family members came to the home to visit frequently and called daily. [redacted] came to the home to visit, the sister of the client came from New Jersey to stay with [redacted] during the time we provided services. There was never a question that we were charging fees and not providing the services. [redacted] would call the home of the client and [redacted] would call the office if she had any questions. I would go the home and perform Quality assurance visits. The charges are legitimate and the client had in the home copy of the schedules for her to see who was coming and going. [redacted] requested that all invoices be sent to his home and it seems that he never bothered to open the correspondence we sent at all times.[redacted] called a couple of months ago requesting invoices because he wanted to bring them to the accountant and I replied that we had sent them. Invoices were sent via email and via [redacted] to his home, and he knew it, it was not news that we had sent invoices. He called a second time a few days later and I asked for him to be patient that we would get to it. I did not hear back from him and I thought that he had just looked for the correspondence and that he got it.    [redacted] was always aware of the charges, he approved them, I would get on the phone with him and tell him what we would charge to the credit card and at the beginning of the next month. He would get the invoice for the prior month. [redacted] was pleased with our services. [redacted] would check credit card balances and would say, “Go ahead charge it”. It is surprising then to be involved now in this sort of dispute after the service has been provided and without questions.  Our company will engage in the services of an attorney if the documents that we are providing is not enough proof only because a client says so.P.S. Please note that [redacted] is questioning 3 payments according to the correspondence I received from BOA, the merchant we use. There is reference to them in the August invoice.  [redacted]President/Owner
