To whom it may concern, I checked our records, and according to that, our customer *** *** had signed personal training contract which clearly indicated in section “ If applicable, and otherwise indicated, all fitness service sessions will expire at the rate of months for every sessions “
Her first contract was signed on 12***.2015, for sessions which accordingly expired in 04.***(sessions are valid for months)In 07.**she renewed her contract for another sessions plus complimentary as a courtesy, and we unfroze the expired sessionsShe already used session out of All our PT sessions are not refundable or transferableThe client understood that from a beginning, when she signed her contract

Our Client "*** ***" joined Synergy Fitness, *** *** ** on March ***, As rightly mentioned by him, along with his membership, for $31.34/month, he purchased PT Sessions for $His membership included One month free vizaviz Groupon and Two Months Complimentary Membership
from the gymThus, after joining in March, he started getting billed for his membership in June From the month of June, up until October,he did not make any payments or even question the gym why he wasn't charged for his membershipWhen the credit pending on a client's membership reaches over $100.00, they are automatically sent to CollectionsAs a courtesy, Kunal along with other members with a balance due are called on various occasions before sending them to collectionsUnfortunately his phone number on file was incorrect and all attempts to reach him were in vainSince he stopped using the club or using his sessions, he was sent to collections thereof.The regular price for PT sessions is $Plus the membership fee per month is If we calculate the period of time Kunal was a member, he merely paid $(including his membership fee for months plus his PT sessions) instead of $(x months plus PT Sessions @ 110/session), thus earning a discount of $for our services. Apart from this, when Kunal came back to the gym when he received a call from collections, he requested the Manager to pardon the collection fee and just pay the balance due on his accountSince he was a client, we again helped him out and removed the collection fee and just took the amount he owed to the gym (for March - October2016). Post the settling of his payments he insisted he finish the remaining PT sessions with another trainerSince his contract expired, the manager suggested that he purchase more training sessions and we can add the remaining two sessions as complimentary sessionsSince his sessions had already expired as per the gym rules which were signed by Kunal, the manager explained to him how this was the most he could help himKunal agreed to the arrangement, via email, and showed up to finish his prior training sessionsHe could, however, train with his original trainer on *** ***, but insisted on using another trainer on Lexington AvelocationOn the day of his training he changed his mind and decided to only finish his sessions and not purchase any further sessionsThe manager then showed and explained the following rule mentioned in his contract. Rule If applicable, and unless otherwise indicated, all fitness service sessions will expire at the rate of months for every ten sessions..Rule Fitness service sessions must be used prior to expiration date.Rule Bonus fitness service sessions will be honored only with written documentation, and will expire two weeks from date of issue.Rule Bonus has no cash value and is non-refundable and non-transferable.All Fitness Service Sessions are Non-Refundavble and Non - Transferable.Kunal's PT Sessions expired latest on August All sessions are non-refundable if not used by the clientIf he wishes to purchase more sessions we can still offer him complimentary sessions but other than that since he has cancelled his membership in November 2016, all his sessions have expired and cannot be honored anymore or be refunded

Even after all the complaints, we still stand by offer that she can complete her sessions.Her trainer *** *** is no longer an employee of the GymAlso, based on her contract she has only two sessions left which she can finish with any trainer who is available. Degrading our employees WILL NOT be accepted, since we take the benefit of our employees very seriously, if we find any misconduct the management holds the right to admission.Our Client "*** ***" joined Synergy Fitness, Lexington Avenue, NY on December ***, As rightly mentioned by her, she received a discounted package of Personal Training Sessions for $The regular price for PT sessions is $Plus the membership fee $enrollment fee and per month minimum membership feeIf we calculate the period of time Miss Fang was a member from December - July 2016, she merely paid $(including her membership plus his PT sessions) instead of $2,(x months plus PT Sessions @ 87.50/session), thus earning a discount of $1,for all our servicesPost July she renewed her PT contract for 10+complimentary sessions for $Again the face value of these sessions would be $(Pt Sessions @ 110/ session Plus X months) and she earned another discount of $During her time From July till present Miss Fang has abused and bad mouth many trainers and been racist and t agged them as "***" and "*** ***." She has used up almost all her sessions that she paid a discounted rate forShe is now fighting for the remaining sessions and complimentary sessions, which have technically expired and because of her unprofessional and uncouth behavior no trainer wants to train her or work with herWe still ignore her misconduct and offer her to avail her sessions and complimentary sessionsWe just request her to come speak to a trainer and find someone who can work according to her schedule. Revdex.com:I spoke with Synergy on four occasions, two of which were in person. Synergy concluded that the issue was a result of an error on their part. They attributed the swiby an active member, who happens to have the same initials as me, with my account.
After review, they concluded that my account has been cancelled since October (November 2015). I received a statement saying that the status of my account remains cancelled as of October and there are zero balances outstanding

I never received a check in the mailI spoke with Synergy on the phone on 3/* at 10:a.mand told them I still had not received a check from themThe woman on the phone said that they had send the check out Friday and I should receive it in a few daysShe then encouraged me to cancel my complaint even though I told her I had not received any moneyNow she is saying they sent the check on 2/** which means she lied on the phone about what day the check was sent outThey can check with their bank and see that the check has not cleared because I never received it and cashed itI can give them my address again if that is the issueI just want my money back.

The trainer James who I have been trained with for the last sessions refused to fulfill all my sessions He insisted many times he can only train me for sessions 1) In my first session with him, he called me in office to talk for more than minutes about the above issue and trained me only for minutes So I paid for this full session but only get half of service;2) He often cut my time short for each session we trained Once he cut short minutes! So he could get back to sit in the office and play on his laptop; 3) He never once stretched me at the end of our any training session 4) Last Friday, we scheduled a training, it's bad weather like our first session, I walked more than minutes to the gym to attend my session James called me in office again when I arrived on time He told me he doesn't want to train me any more because I filed a Revdex.com report So I had to leave I wasted so much time with this trainer. 5) He tried to sell me bigger package of more trainings with him.6) James carries a cold and rude customer service attitude the whole time It's very difficult to schedule my session time with him. Now what? I must receive all my sessions I paid for with another trainer Also apology from James for wasting a lot of my time and bad customer service attitude He stressed me out Also for all the time he slacked not to train me I ask for a refund

It's in their habits all lies and make up stories.  But the gym customers actually are victims.  The gym is a notorious scammer.  It was sued by city court in 2016 and fined $60K for scamming it's customers.     I paid for training sessions but the manager refused to fulfill all my contractual sessions.  He purposefully wasted me a lot time to talk to him many times in the gym and completely went crazy harassing me which shows zero professional manner.  He also made it impossible for me to train with anyone.  The dispute will continue until we reach agreement for a refund for the service they did not provide.

Regarding this issue, I personally talked to her, and mailed her a refund check on 02.**.2017, check number [redacted], amount $52.24.If needed, I can send you copy of the check.This was resolved, so I don't know why she started the complaint at the first place. Regards,Sanja
