Doing doing work they get paid for. Landskaping hasnt beent done since winter. Excuses for not doing the work needed.The house in question has always had a bone dry basement. Heathcote hired a company to do the landskaping two years back, after which the basement started flooding with every rainfall. The following spring everyone in the ajoining condos was getting flooded and heathcote decided to do blueskinning on all of the basements. The evens following this process caused the house to catch fire, so it had to be rebuild. Now that everything is put back together in thw house, we have not had a back yard to use at all. It hasnt been landskaped after it was all dug up so its a big mud pit, we have no stairs at the back and our paving stones are out on the grass beyond the fence. We have rebuild the wet wall from last year, since we now have blueskinning on, we thought we could do it. Back yard has still not been landskaped, our basement flooded again this year (most recently today). We keep calling and emailing the company to come deal with this. They said they hired someone but noone has been here yet to fix it. We still have to keep paying condo fees every month. With them not doing any of the things we pay for and having to pay to rebuild ourselves, the costs are adding up fast. Desired SettlementWe need the landskaping finished properly/proffecionally so we can stop replacing the same wall over and over. We would like a refund for the last three years or so of condo feea (from when they finished paving over the only drain/manhole in the front up until the landskaping is done, 150/month). Since they paved over the drain they stopped the regular street sweeping and snow/ice removal. Business Response On behalf of the [redacted] Board of Directors, this is in response to the complaint received.Firstly, the parties complaint is directed towards Heathcote Management Inc., which is incorrect as the party that should be referred to is the [redacted] c/o Heathcote Management Inc. Heathcote Management Inc., is engaged by [redacted] as the "manager" for the property but only carries out instructions by the Board of Directors for the [redacted].Secondly, the complainant is unknown to us and is not registered as an occupant or an owner of the unit mentioned. Notice went out to all units in 2013 to determine the extent of leaking/seepage in basements so that a course of action could be determined to stop the seepage. This was after grading of units was done prior to 2011 to address drainage issues, and prior to management by Heathcote Management Inc. While grading done prior to 2011 did address some seepage, seepage continued in other units. This unit did advise that they had seepage and was therefore added to the list of units to have "blue-skinning" done. "Blue-skinning" was not done to any units that did report any leaking. This unit would not have been "blue-skinned" if there were no leaks reported. Thirdly, The fire to the unit was not caused by the work being done to install the "blue-skinning". What caused the fire was a sword that fell off an inside wall, that was not secured properly, that landed on an electrical power bar breaking the power bar and causing an electrical short. The resulting fire however happened from a condition created by the contractor, when excavating for "blue-skinning", that was unknown at the time. Had the sword not fell off the wall there would have been no fire. There reference to flooding is exaggerated as the caretaker observed the "flood" which was less than a cup of water. There has been no flooding of units, only seepage.The complainant is correct about the yard not being completed, which was also further delayed by the fire. No work could be done to the landscaping until the rebuilding of the fire damaged unit was complete. The restoration of the yard is to commence this year and will be completed before the winter months. There are a number of units that require finish landscaping not just this one. Further, all fences are being replaced and yard work could not be done until scheduled fence replacements are complete. Now that scheduled fences for replacement have been completed the back yards are now being put back together. My understanding from the contractor is that backyard grading work commenced this week and will continue until all yards are completed this year and before winter. Given the extent of work that has been done at the property this year completion of the yards could only be done once fence work was done which is now underway. A date cannot be established as to when the yard for this unit will be done.The comment concerning paving over a drain/manhole we have no idea what this is about as no drain/manholes were paved over that we know of. Road sweeping and snow clearing has been done.A refund for condo fees is not being considered as the Condominium Property Act, 1993 under clause 54 (3) states: "An owner is not exempt from the obligation to contribute to the common expenses or reserve fund expenses even if: (b) the owner is making a claim against the corporation".I trust this explains the position of the corporation.Consumer Response (The consumer indicated he/she DID NOT accept the response from the business.)Completely wrong. This has nothing about actually fixing the back yard being finished. Yesterday someone brought a wheelbarrow with tools, it sat in the yard for 30 mins and they took it away without doing any work. Bottom line of the report is noone going to fix the problem or refund the money paid to get the work done. [redacted]
