September 9, 2014 Dear [redacted] ***:We are responding to the complaint lodged against our business regarding a request for refund. The facts are as follows: [redacted] was identified as a co-borrower with a person who was designated as the primary borrower per the records of the ***... Motor Credit Company (***). Our firm is the Administrator of a settlement between a class of borrowers and the ***. Our duty is to distribute funds to the proper party entitled to receive a refund according to the records of ***. An original check was issued to the primary borrower’s address with both the primary borrower and [redacted] ’s name on the check. The check was forwarded by the USPS to [redacted] 's address since the primary borrower no longer lived at the original address we were given as the residence of record. [redacted] contacted us several months ago asking for the check to be reissued in only his name since he could no longer locate the primary borrower (he claims she was his ex-girlfriend). I explained that we would need to verify with counsel. In doing so, counsel eventually requested that [redacted] submit a signed affidavit stating that he made payments towards the deficiency balance after the car was repossessed. [redacted] submitted the affidavit which was promptly forwarded to counsel. One of the attorneys in this matter explained that [redacted] Motor Credit's records indicated [redacted] did not make any payments towards the deficiency balance. The Settlement Agreement provides that if there are co-borrowers on the account, the check shall be mailed to the primary borrower, which it was. If there is a dispute about the proper recipient, Class counsel and [redacted] Credit’s counsel are supposed to meet and confer about the proper recipient. The Settlement Administrator has the authority to resolve the dispute if counsel cannot agree. Our research noted that [redacted] Credit’s concern is that issuing the payment solely to [redacted] creates the risk that the primary buyer would later make a claim that she was entitled to the refund. The Settlement Agreement is designed to eliminate disputes about whether the buyer or co-buyer is entitled to the refund by requiring the check to be issued in both parties’ names. This risk of an adverse claim is heightened here because [redacted] Credit’s records reflect that [redacted] did not in fact make all the deficiency payments on the account. Under the Settlement Agreement, [redacted] Credit’s records are [redacted] , PA ***. [redacted] . Fax [redacted]

Greetings,
I am the named plaintiff in a class action lawsuit which was settled, funds deposited, and the case was sent to Heffler administration of claims. The representatives are completely unreliable and dismissive.
Emails sent requesting status through their website are totally ignored. I have sent at least five this way with no response whatsoever.
Telephone calls are rarely returned. And when one was, the representative knew nothing. I was told to call the court which I did. The court staff ultimately said to call the lawyers.
Class members are calling me for information because they are fed up with Heffler. This is unacceptable.
I will request that the Judge limit the amount they are paid due to their incompetence and unresponsivesness to reasonable requests for information..

These people are horrible. I never received my check. Each time I called I was given a run around and told to look out for the check in the mail. Finally their representative got so belligerent and unprofessional with my legitimate request that she simply said "there's nothing you can do about it" really? I'm in the process of contacting legal help in this matter. It seems this Heffler, radetich, sattiaa (however it's spelled) have many complaints. There's another one on the ripoff report website that a certain Vicki reported. There are over 100 people who reported (imagine how many more that didn't report their utter dissatisfaction) that they haven't gotten a penny in disbursements, and that's for just one class action law suit they handled the funds for. These are unprofessional people bordering on outright cookery. By the way no former employee of theirs says anything but horrible things about these seeming thieves. You can check the glassdoors website to see detailed testimonials from their past employees regarding this so called company. The company revenue is very high at around 25 million dollars per year. If we band together perhaps we can have the power in numbers to sew them. If anyone is interested just email me at [email protected] with full name and contact info. I have already contacted a class action attorney, but it takes time.

Checking to see if my reply posted.

Review: Heffler was in charge of the [redacted] settlement and I am a claimant (ID [redacted]). They sent out a settlement check of $945 to me back in May 2013 to my old address, so I never got it. Per their requirement, I sent them two written letters in summer 2013 and provided my updated new address and requested reissue of my check to my new address. Never got a response. In between the two letters, I called the contact person ([redacted] @###-###-####) and her supervisor ([redacted]) at least 10 times, but always voice mail, and never got a response to my voice mails either. I have also sent countless emails via their website contact link, but always got auto-replies. The only live person I was able to reach was their operator who told me to wait patiently since they have many cases. It has been almost a year, and here I am still waiting, no follow-up and no progress.Desired Settlement: Reissue my check of $945 and mail it to my current address.

Review: I received a refund check for $2,548.00, check no. [redacted]. It was for a refund from [redacted] Motor Credit. The check that was sent to my address had [redacted] above my name. I tried to cash the check but the bank would not allow it. In order for me to be able to cash it, I need the check in just my name [redacted], or a slash or an "or" between both of our name. This was a matter from over 8 years ago and [redacted] can not be found. I sent a letter along with the check to Heffler Claims Group about 6 months ago stating the same thing. It has now been 4 months, countless emails, and phone calls. I have done everything you have asked me to do including paying $50 to get a notarized declaration and send it by certified mailing it to your office. Whom do I need to speak with to finish this process because its becoming ridiculous.Desired Settlement: I would like the check in my name like they told me would happen.

I am rejecting this response because: I have emails and phone call of them saying they will send me the check because it has been over 7 months and the still have not found her. As for motor credit, they say that they have no information on my paying but the can't tell me who paid.

Regards,

Review: I submitted my claim and my father's claim to this claim administrator because we were eligible for the class action settlement. I called to check the status because I saw online that checks were mailed out but we have not received ours. I was in communication with [redacted] in November 2013. He told me to wait and finally got back to me in late February 2014 that he researched their database and could not find me in their class member database. That was pure disgusting! I don't know how their database is set up but believe there is a customer service issue and I believe he should have requested supporting documentation from me. We are eligible!Desired Settlement: I want these guys to review our files again in a more timely manner than simply playing with someone's time. They already got a F from me for their service rendered. Hope this time is different!

Regards,

Review: All I want to know, if this business is legitimate about the [redacted] settlement and if I was included or not? The Claim number is [redacted]. Last year 2013, I received a post card in late May or early June stated there was a Class Action Lawsuit against [redacted]. First, I thought a joke and ignored the Postcard. Now, I received an email within couple days after receiving the Postcard, thus, I went to the website and fill out the form, which included the initial tax information need to file every year. About mid July, I received a second Postcard that had return along address for a chance to opted out of the lawsuit, which I never signed. Now, I contacted this company as well [redacted] or intuit earlier this year but no response. I can remember who referred me to the [redacted] website to file a complaint in May of this year. However, I have not heard anything at all. Could you please help?Desired Settlement: First, I want know if the [redacted] Class Action Law Suit is real or not? All I want to know if I was included or excluded from [redacted] Class Acton Settlement? Here is the Claim Number : [redacted]. I was ruined financially by my ex-wife year ago; thus I am only concerned about not hearing from anyone.Thank you
