We, Duane and Deana [redacted] , in response to Dan and Valerie [redacted] ’s complaint against Maxhaven Kennels LLC disclose the following information as proof? that no agreement has been breached as we have been falsely accused of On November 13,we entered into a “Pup Trade Contract” At this time no health guarantee was included in the trade.? Even if one were included our Health guarantee states? “Seller will give a (5) year genetic health guarantee against the following only: Thyroid, epilepsy, hips and juvenile cataract disorders only.” In? addition our health guarantee states “This guarantee does not cover any of the following: Contagious diseases, fleas, lice, any kind of parasites, coccidian and giardia (caused by stress), bacterial infection, protozoan, allergies, or allergic reactions, any autoimmune disorders, an undescended testicle, or accidental death of said puppy.”? When a health guarantee is provided to a buyer this document is read in its entirety and signed by the buyer and seller at the time the puppy is taken home.? This being said, had a health guarantee been provided the condition that Indi is said to have would not have been covered under our health guarantee Our refusal to settle with Dan and Valerie [redacted] was based on many factors.? When they brought the complaint of Indi’s health to us on 7/30/we requested all vet records from the time of placement to the current dateRecords that were provided appeared to be altered, including a change in the birthdate, a micro-chip ID that did not match the one placed by us before shipping the puppy and missing contact information of the owner and the vet office where the documents were sent fromWe responded by requesting hard copies of the vet records to be sent to our vets officeIn email correspondence they then wrote the following: “After we received Indi, when our vet scanned her, a microchip didn't show, so he put a microchip in Indi? We just assumed one hadn't been put in her or that it just hadn't taken? We didn't think anything of it and just had one put in - never even thought we would have to tell you about the new chip #? The new chip # is the microchip # that is on the papers? Vet office inadvertently put incorrect day of birth on paperwork, so it was corrected on paper, til they can correct it on their system? As soon as they get it corrected on their system, we will get that paperwork sent to your vet, so there is no mismatch btw DOB's.If you remember, ? this pup was sick before you shipped her to us? She couldn't even have her week shot til she was weeks old, due to running a fever? That should have been a red flag to us then? But we trusted that the pup would be a healthy dog.” ? From the time the [redacted] ’s received the dog on 2/4/until the 7/30/ correspondence they made no indication that Indi had been sick or was showing signs of sicknessOn 8/17/we received an E-mail and phone message from a breeder in [redacted] who informed us that they had purchased Indi from Dan and Valerie [redacted] on 6/16/In this correspondence we learned that the new [redacted] of Indi had taken her into the vet and discovered the entropion and kidney infection that was suspected to be renal dysplasia ? The [redacted] ’s neglected to inform us that Indi was sold to a breeder in [redacted] on June 16, for $“As is” with no health warrantyTherefore when they requested records from our vet on August 10, by sending in a Registration Certificate as proof of [redacted] hip ? they are in direct violation of the Wisconsin state statute ? “Access to health care recordsThe owner of any animal patient of a veterinarian, or any other person who submits to the veterinarian a statement of written informed consent signed by the owner, may, upon request to the veterinarian: (1) Receive a copy of the animal patient’s health care records upon payment of reasonable costs” Furthermore we had no access to the records that were sent to the [redacted] ’s and we requested a copy only after they claimed “it specifically states that this pup should not be used for breeding.” After review of the records it says “would not recommend pup for breeding.” It does not claim the pup cannot be used for breeding based on health issues as the [redacted] ’s have claimed both in the complaint to the Revdex.com and the letter of Intent to pursue legal remedy that was dated on 8/16/ Another reason we refused to settle with the [redacted] ’s regardless of them selling Indi was when our vet sent the following letter, they refused to get the recommended testing : Hi Dan and Valerie, ? My name is Samantha [redacted] , I am the vet that works with Maxhaven kennelsThank you for sending the information about Indi, it was very helpful.? ? Renal Dysplasia is a possibility for her increased kidney values, however there are a few other disease processes I would consider before committing to that diagnosis - especially without a kidney biopsy, which is the only definitive way to diagnose renal dysplasiaIt is recommended to test for Lyme disease and LeptospirosisThose tests are much less invasive than a kidney biopsy and you can get answers back relatively quickly.? ? The other thing to consider is that with her history of a fever when very young, an infectious agent would be able to cause permanent renal damage at that time - resulting in similar blood values and kidney appearances on ultrasoundHer blood work done at the time of her fever as a puppy showed no evidence of renal diseaseThere is no way to test for an infection that has come and gone already, however a biopsy would be able to differentiate between damage and dysplasiaUnfortunately, without the kidney biopsy we may never have a definitive diagnosis.? ? Furthermore the altered records we received from Dan and Valerie [redacted] states the following: ? “the appearance of the kidneys appears consistent with either congenital renal dysplasia, interstitial nephritis, or previous renal insult such as due to an infectious disease or toxic insult Treatment and testing for leptospirosis is recommendedA urine culture with urine protein: creatinine ratio is recommendedTesting for Lymes disease if not previously performed is recommended.” At the time we were not aware she was with another breeder and we refused to take Indi back until she was tested for Leptospirosis because of fear of infecting our entire kennelWhen we refused to settle they began to harass us, threaten us with legal action, sent a letter of intent to pursue legal remedy, and then filed the complaint with the Revdex.com With all the above information we do not feel that we have breached any contract or failed to honor our health guarantee that is given to buyersDan and Valerie [redacted] altered documents, lied about being the [redacted] of Indi to obtain vet records, refused further testing, sold Indi for $but claimed to be at a loss from her medical conditions, and even offered to send her back to us writing “when you ship blackheart to us, we will ship Indi back to you.” That being said blackheart would have been returned and Indi would have never been sent to us because the current owner in [redacted] never planned to return Indi to the [redacted] ’s? It is unfortunate that Indi is sick but we feel that her current [redacted] will care for her well Unfortunately we do not agree with Dan and Valerie [redacted] ’s attempt for resolution as we are not at fault as they have claimed Sincerely, Duane and Deana [redacted]

The fact of the matter is we never received the vet records on Indi until the ***’s informed us that they showed she was sick as pup and “not recommended for breeding.” At that time we contacted our vet and obtained a copy to reviewDuring Indi’s time in our possession we were informed that she had heavy parasitism and possible failure to thriveOur vet advised us to watch her closelyAn antibiotic was started empiricallyIndi rapidly showed signs of improvement and when informing the vet they said that was great news and they would do a health certificate at her next appointmentWe did in fact tell the ***’s the puppy had a fever and this is why she did not get her shots at the first check-upThe vet did not tell us they “would not recommend using for breeding.” In fact on 01-14-the vet writes “Dog is doing well and has gained weight” and a health certificate was given at a later appointmentThere was absolutely no deception on our part, had we known what the vet wrote we would have done further investigation. In addition, ***’s continue to leave out pertinent information when addressing the vet records on Indi from when she resided with usThe following are directly from the vet records: On 12-22-15: At the time of her vet appointment she weighed 4.5# and had a temperature of 104.2F Blood work : TP g/dL (5.0-8.3) Albumin g/dL (2.6-4.0) GGT u/L (3-19) likely not significant RBC 4.01xuL (4.48-8.53) HGB g/dL (10.5-20.1) MCV (63-78.3) HCT 22.4% (33.0-58.7) DDX heavy parasitismSpoke with *** of female puppy-they highly suspect liver issue- run fasting bile acids in AM when in for appointment and treat empirically for liver issues vsother infections (immunoblasts, anemia (non-regenerative), panhypoprotinemia)Urine: Glucose: - Ph: Bilirubin:- protein: trace Ketone: - Urobilinogen: - Specific gravity: 1.018 Nitrates: - Blood: - Leukocytes 2+ WBC: + RBC: - Casts: - Crystals: - Bacteria: present (typically will be coming off the floor) 12-23-15: UA off floor- WBC in urine- will do recon based off serum bile acids-likely will start amoxicillin for 10-14d for UTI/ suspected liver abnNo HE noted after feeding-improved energy T today CB in AM w/results12-24-15: SBA results: Pre- 1.0umol/L (0-12.0) WNL (within limits)-not a congenital portosystemic shunt Post-umol/L (5-25) DDX: Failure to thrive puppy: R/O (rule out) congenital heart defect/ glycogen storage disorder/ congenital hypo T4/ pituitary dwarfismCan do radiographs to check heart size-may not be visible-recommend EKG/Echo 9:55am Spoke with owner-scheduled rads-Could do more research and come up with other differentials for “runt” 1-6-16: *** cancelled xray aptOwner reports dog is eating great and has doubled in sizeUnsure if x-ray is neededPuppy does have home & 1st Vax needed 1-14-wks 11.3# (doubled in size) T-P-160bpm R-Dog is doing well & has gained weightInserted micro-chipOwner said will come back for health certificate, has been too cold to have dog fly So with the above information either the ***’s are attempting to mislead the reader or are completely misunderstanding the vet recordsThe vet did not suspect liver issues, we did due to a pup (not from the same Sire or Dam) that had a liver shunt from another litter (that was also a runt)In addition, the ***’s took the above lab values and googled what they “could be caused by” and only added things related to the liver and kidneyNowhere on the vet records does it say any of the lab values are related to kidney diseaseFor example, if you look up the lab values on google for Total Protein “being low is a common cause in younger dogs if a heavy worm infection is present (Heavy Parasitism) “It is hard for us to find a resolution to this matter when the ***’s refuse to produce their vet records while Indi was in their careAgain she forged records she did produce by whiting out /removing the Vets location and the current *** name in attempts to make us believe Indi was still in their careIt is only AFTER the *** *** contacted us that we found out she sold her for $As Is with no health certificate for crossing the state lines and she was overdue for rabies We ask for their vet records because how are we to know if she truly was not sick while in their care? She claims there were no signs of sickness but refuses to produce vet records that support the claimThe ***’s statement “the ***’s are trying to turn the pointed finger on us to shift the attention of themselves” is simply NOT trueWe are defending the attacks and untrue statements that the ***’s continue to throw at usThe ***’s state “they should be made to compensate us for their deception” contradicts their statement “we never made claims to Max Haven about being at a financial loss from her medical condition.” So why are the ***’s looking to be “compensated” when they received $for Indi when selling herThe ***’s only paid for shipping for Indi, they did not purchase her from usIf anyone deserves compensation it would be the current *** of IndiThat is who we will be settling this matter with as the ***’s are no longer the owner of IndiIf the ***’s wish to pursue this further they can contact my Lawyer

She claims there were no signs of sickness but refuses to produce vet records that support the claimThe ***’s statement “the ***’s are trying to turn the pointed finger on us to shift the attention of themselves” is simply NOT trueWe are defending the attacks and untrue statements that the ***’s continue to throw at usThe ***’s state “they should be made to compensate us for their deception” contradicts their statement “we never made claims to Max Haven about being at a financial loss from her medical condition.” So why are the ***’s looking to be “compensated” when they received $for Indi when selling herThe ***’s only paid for shipping for Indi, they did not purchase her from usIf anyone deserves compensation it would be the current *** of IndiThat is who we will be settling this matter with as the ***’s are no longer the owner of IndiIf the ***’s wish to pursue this further they can contact my Lawyer.
