Regarding: ID# [redacted] 6/17/To Whom it May Concern, On Saturday June, 13th I received your notice that a complaint was filed against me, Heidi B Photography, The client signed a contract in January for his June weddingThe contract very clearly stated that there is a nonrefundable deposit due at signing equal to 1/of the total costThis amount is fully applied to the total (is not in excess)His contract included an engagement session which took place in March, They chose the location and we agreed on the timeI drove approximately miles round trip to their location of choice and I paid a fee to enterI spent approximately hours with themThere was no indication of either being unhappyDue to the harsh light, the crowds and such I did take several imagesI always over shoot, especially with couples and groups as there are often times I end up with blinks, mid blinks, strange facial expressions, a person talking, looking away at the last second ect I over shoot the same poses to ensure I get something that is useableI am not certain anyone would necessarily need images (or more) of an engagement sessionThe couple did not have a change of outfits, so there was not a lot of variety to offer themI posted a few sneak peeks that same eveningI received a message from the client that states: "Thank you for the amazing session todayI look forward to seeing all of the pixLove seeing the ones up alreadyThe ring picture on the tulip turned out amazing." They had never communicated that they were displeased with the sessionOn April3rd he sent a message stating they love the few that were up and looked forward to the restThe images were shared with them via a private online gallery from which they are able to download all images at high resolution to their own computer/hard drives at no costPrints are also available for ordering at no marked up cost to the clientAs far as the CD goes, I will send them a CD with the imagesI do not normally rush with this aspect as the images are available to them without it and I usually burn.& send CD's in batches every few monthsAfter sending the link his reply was: "Awesome!! Thank you very much" The client sent me a message on May 21st stating that his mentor has offered to shoot their wedding as a free gift and they no longer need my servicesThis was a breach of the contract but I respected his wishes to utilize his friend's offerOn May 28th the client sent a rather harsh message, telling me that his research has shown that nonrefundable deposits are a myth and wants his full deposit backThe client chose to breach the contract in which he signedI replied to his request in a professional manner, explaining that performance on the contract had started, product had been providedServices had begun; including communication with him, the engagement session, which is $If purchased ala carte; mileage and time to and from the [redacted] for their session and the fee to enter the farm etc, The work and time I have committed to this client up to date exceeds the amount of his depositI have, however, offered to issue a check in the amount of $along with the CD to the clientHe has accepted this offer as of this date, June 17, His message stated he would close the complaint with Revdex.com upon receipt

deposit due at signing equal to 1/3 of the total cost. This amount is fully applied to the total (is not in excess). His contract included an engagement session which took place in March, They chose the location and we agreed on the time. I drove approximately 58 miles round trip to their location of choice and I paid a fee to enter. I spent approximately 2 hours with them. There was no indication of either being unhappy. Due to the harsh light, the crowds and such I did take several images. I always over shoot, especially with couples and groups as there are often times I end up with blinks, mid blinks, strange facial expressions, a person talking, looking away at the last second ect.  I over shoot the same poses to ensure I get something that is useable. I am not certain anyone would necessarily need 80 images (or more) of an engagement session. The couple did not have a change of outfits, so there was not a lot of variety to offer them. The client chose to breach the contract in which he signed. I replied to his request in a professional manner, explaining that performance on the contract had started, product had been provided. Services had begun; including communication with him, the engagement session, which is $250 If purchased ala carte; mileage and time to and from the [redacted] for their session and the fee to enter the farm etc, The work and time I have committed to this client up to date exceeds the amount of his deposit. I have, however, offered to issue a check in the amount of $100 along with the CD to the client. He has accepted this offer as of this date, June 17, 2015. His message stated he would close the complaint with Revdex.com upon receipt.
