HEIGHTS AUTO SALES, LLC WEST VETERANS MEMORIAL BLVD HARKER HEIGHTS, TX 953- This is in answer to the complaint filed by [redacted] ***: Complaint Every vehicle sold by Heights Auto Sales is sold on an 'as is' basisThe customer is required to sign a two part document explaining that the vehicle is being sold 'as is' with no warrantyI have enclosed a copy of the 'as is' statement signed by Mr*** Mr [redacted] states that he brought the vehicle here for repairs and was turned awayI am not familiar with that scenarioIf he spoke with the mechanic, he might have been told he needed to schedule a time for his repair At this point, Mr [redacted] is in default of his contract, and his account is in repossession status We feel that instead of repair problems, Mr [redacted] is having financial problems, and is unable to meet his obligation to Heights Auto Sales, LLCAfter repeated attempts to contact him on the telephone, I visited with a female at the address Mr [redacted] provided to usAt the beginning of the conversation she advised me that Mr [redacted] did not, in fact, live at that addressLater, she amended that statement to say that he stayed there sometimesI spoke with Mr [redacted] and asked him to come in to the office to discuss the situation and a possible remedyHe agreed to come in later that dayWe did not see him that day, and have been unable to make contact with him since that time.Sincerely, [redacted] Heights Auto Sales, LLC

Ms [redacted] , like every other customer, signed an "AS WARRANTY" statement when she purchased her car.Any funds that a customer uses for a down payment is non-refundable.Ms [redacted] drove away from the lot in the vehicle, signifying that the purchase was complete.She made an informed decision to purchase the carShe also signed all documents stating Heights Auto Sales LLCpolicy on honoring anywarranty on the carThere is also a document that every customer, including Ms [redacted] , signs stating that there are "no known defects".At this point in the document signing the customer has the choice to write in any issues that exist with the carMs [redacted] 's document has a blank space for these commentsBasically, we do not refund money paid to usWhen the customer drives away from the lot the car then belongs to them

The customer is [redacted] and [redacted] and yes they did purchase a Dodge Durango from meThey purchase the vehicle knowing of the issues and were told we would help in any way we could however after they turned in the vehicle I started finding them a transmission and had one but it didn't work when I got it in and they were told thatThen [redacted] the husband called and said he had lost his job and could not make their deferred down payment anywayI informed him no problem I would voluntarily repo the vehicle and not report on their creditAt that point I put the repair on holdI needed to find a transmission and had other things I was fixing at the timeSince the conversation with him approximately a month later the wife called and was checking the statusI told her of her husbands and my conversation of him not having a job and couldn't make the rest of their down which was not tied to any repairs by the wayShe got belligerent with me and I did hang up the phoneThe customer was given a deferred down payment because that is all they could affordThey bought the vehicle with issues but didn't follow through with their financial obligationsMrs [redacted] obviously didn't know about Mr [redacted] calling and telling me that he no longer had his job and could not pay Mrs [redacted] is not accurate with her statementThey did sign their agreement as do all purchasersThe vehicle is still here and in need of the same transmissionIf they so choose they may find a tranny and get it put inThey must catch up on their note thoughIt is severely past due

First I appreciate the time and effort that Ms [redacted] put in to bringing this matter to our attentionThe facts involved are a little different that what I read hereMs [redacted] did indeed purchase the car on August 9, The arrangement made with her at the time of purchase was for her to pay a $down paymentBecause she was short $on her down payment we agreed to wait until Wednesday August 10, 2016, for the additional $ Ms [redacted] came back to the car lot with some issues to be repaired on the AleroWe fixed everything that she asked us to addressThe following Saturday she called wanting to put the remaining (and now delinquent) $off until the next weekShe was advised that we do not make payment arrangements on deferred down paymentsMs [redacted] became verbally abusive at that pointSince the original sale date each telephone interaction with Ms [redacted] became more verbally abusive, culminating with one on August 25, 2016, in which she made several extremely obscene and sexually explicit suggestions to Mr***At one point earlier in this week Ms [redacted] called and told Mr [redacted] that she had been acting badly and asked if she could still pay the $and come get the carShe was told yesShe never showed up, but began making the obscene telephone callsAgain, I apologize that this customer relationship has ended like this

Mr*** was in the office and was told about his complaint filing and he swore he was going to withdraw itHe has his tagsThe only reason he didn't get them on time was because he didn't get his vehicle inspected! He also bought a vehicle which means all repairs are his responsibility!
He acknowledged his responsibility while he was in my office

I am rejecting this response because: I came up there tried to get them to fix it and the reply I got was they don't pay for my repairs. The tire rod end is broken and could have flew off with my kids in there. I'm boy havin finical problem I have a whole other car but I'm not paying for something that was falling apart not even 30days of me having. I even said I would take half of my money and they said no. I have witnesses also and I always talked to a female I never talked to a [redacted] do they are lying again. The pics are of a major oil leak I asked what was it and they said power steering leak which was not the case

I am rejecting this response because: [redacted] the car salesman told me that trepairs were being made on the car and it would be in running conditions.  I was verbally told what was going to be to be fixed on the car from [redacted].  When the car broke down minutes after driving off the lot, I called [redacted] to tell him what happened and had to wait over an hour for him and [redacted] to come to my broke down location to see what the problem was.  I immediately asked [redacted] if I could be placed in a different RELIABLE vehicle for the $1,000 I paid and I was told no.  [redacted] the secretary told me straight to my face that I should have never been sold the car n the first place and that it isn't right that I'm being mistreated by [redacted].  The 1994 Buick Century has been on Heights Aito Car Lot since May 2016 and the business has my money.  How is that right????  It's not and I've been more than patient with [redacted] in resolving this issue.  I told [redacted] that I don't need a car now because I got a New car through [redacted] at the beggining of this month.

Because she was short $100.00 on her down payment we agreed to wait until Wednesday August 10, 2016, for the additional $100.00.  Ms. [redacted] came back to the car lot with some issues to be repaired on the Alero. We fixed everything that she asked us to address. The following Saturday she called wanting to put the remaining (and now delinquent) $100.00 off until the next week. She was advised that we do not make  payment arrangements on deferred down payments.
