Initial Business Response /* (1000, 7, 2015/07/13) */
*** came in my shop and asked me to customize a veil for her, she drew a design that she wanted for her wedding and brought materials as wellShe also offered to introduced a non-profit organization director to meOn the day that she came
to pick her veil up, she was satisfied with the final product, she tried it on at the shop for a whileMy shop video and my employees can approve the reaction from her
Until it was time for the payment, *** was shocked about the price of $She mentioned that since she introduced the friend to me for more business, she wants a discount, I did take $off and *** paid the price of $However, on Thursday night I received an email from *** to ask for $refund because she didn't believe it was worth the money, she warned me that she will post the negative comment to her social media account with 13,followers
Quoted from ***'s email
"I have posted a negative review on Yelp and plan to do so on my social media accounts as well (I have a large following of almost 13,pageant girls in the St Louis area on Twitter) unless this can be resolved."
I replied her email and explained how the work was done, and recommended her to get a quote from other custom design shop, I declined ***'s refund request
On Friday, *** posted twits on her twitter account about her horrible experience with ***'s Bridal, which was fine, that's why we have Twitter or YelpBut one of her posts was to encourage everyone to call ***'s Bridal and ask me for a refund, she also included the shop business phone number
On the same day, I received a numerous phone calls from ***'s friends and they asked "Do you know who she is? You should do it for free for ***"
I felt that the phone calls interfered with the business operations and I don't know when it would stopI then contacted kirkwood Police department and asked for helpThe policeman stopped at the shop and asked what happened, he then determined that this should be considered as Harassment and called ***
On Friday night, *** posted an update on Facebook to appreciate people who called the ***'s Bridal and asked for refundSome friends admitted that they did call
Finally, I talked to my attorney and as a former federal prosecutor, he determined that this behavior has engaged in harassmentHere is the letter from my atterney
Ms*** am an attorney with the StLouis law firm and represent *** and her company, ***' s BridalMy client has told me that you have been engaged in a malicious campaign of harassment on both Twitter and FacebookI have personally examined your statements on these social media outlets and have concluded that my client is collect in her assessment
You have a remedy if you wish to pursue your claim for a refundStLouis County Circuit Court has a Small Claims Division wherein a claim such as yours can be pursued for a minimal fee and without an attorneyI note that in one of your entries on social media you admit that the Kirkwood Police, after they discussed with you a possible criminal charge of harassment, told you that Small Claims Court was a proper and legal remedy you should pursueThey are absolutely correct
What is not a proper remedy is enlisting friends and acquaintances, who only have your own uncorroborated assertions to establish that ***'s work was subpar, to continually call ***'s Bridal shop and demand that she give you a refundThat is improper conduct which illicitly interrupts my client's and proper daily transaction of businessFrankly I am shocked that a person with your credentials who has received the accolades you assert, has resorted to such unseemly tacticsYou have a legal remedy available to youIf what you allege is true, a judge should support youBut you must cease and desist your actions which constitute harassment of my clientAs a former Federal prosecutor, I am an expert in assessing legal versus illegal conduct
If you do not halt your present course of action, I will advise my client to undertake all of her available (but legal and proper) remedies against youThis would include a referral to the Federal prosecutor in StLouisyou may be unaware but the conduct of unlawful behavior by use of the internet is a Federal crimeI would not think you would want to deal with such serious issues as you near your upcoming weddingYou surely have much better and happier ways to spend your time at this point in your life
By the way, I would be remiss if I failed to congratulate you on your upcoming weddingI hope you and your husband live happily for many yearsIn the meantime, I urge you to put this matter behind you and move on with your lifeThank you***
If *** told me that she wasn't satisfied with the veil when she was at the shop for pickup, I could work on the veil more and change it to the way that she likes itThis is what I always do for my customersHowever, she did not do so, I will not give her a refund due to reasons that I completed what she asked me to do, and she did not mention anything about the quality when she picked it up, and her improper behaviors
