August 3, 2015Dear *** ***,This letter is in reference to the above referenced complaint filed on August 25, by *** *** *** *** opened an account with our shop on June 18, at which time we accepted pieces of clothing on consignmentI have attached a copy of her
signed contract and her signed receipt for these goods*** *** signed our contract and additionally initialed the clause that indicates the consignment time frameHer signed receipt lists the dates of her pick up windowBoth of these signed documents show her acknowledgement that items not retrieved within that time frame become the property of the storeThese clauses are highlightedI also enclosed her store inventory list, a list of items sold and a list of items donated.We were open until 6pm on August 24, and I personally was in the store until 6:pm that eveningWe answered every call that evening and our store is also equipped with a telephone answering machine as well as a backup voice mail system from *** that would allow a customer to leave a message if we were on the phone with another customer.Our first call from *** *** was on the morning of August 25, After 10-minutes of politely explaining to *** *** that her items were expired and no longer available for pickup, I did hang upShe would not accept my answerShe immediately called back and again we spent 10-minutes politely explaining, reminding her of our contract which she had signed, that she had missed her pick up window and the items were no longer available for pick up and had been donatedShe again would not accept our answer and we did hang up againShe immediately called a third time and we again politely explained and she again would not accept our responseHer third call bordered on harassment and we again hung up after 10-minutes.Our policies are clearly available on our website at www.hellogorgeousshopping.com as well as in store on a brochure, on our client contract and or our receipt*** *** chose to consign under those termsWe appreciate her circumstances however there is no compensation for expired and donated items.Sincerely,Donna UOwner
