There is a lengthy description attached as I am only allowed characters This is NOT a valid complaint that my client is claiming

I will paste a copy of the certified letter so the client can see that it was sentI will not be paying for the trash receptacle,as the need for one was previously discussed before the sale could commenceI am disgusted that my client asked a "friend" to come in and film the houseShe was extremely rude, and accused me of not seeing prices on merchandiseI asked her for specifics, and she showed me one room that had clothing in itI pointed out my printed and laminated signs that were hanging on the walls right by the clothingShe then complained that "they were hung too high" for her to noticeThey weren'tI had multiple signs hanging by books, showing the prices, dolls, showing the price, towels, showing the pricing, as well as signs stating to watch your step, Sorry, No Returns, etc I too have photos and staff to back this all upI had to affirm that I would not be charged for the dumpster before I mailed payment, so that I would not be out that amount after my check is cashed by the clientThe client's mother was a hoarder, and I had to clean quite a bit to hold the saleIn hindsight, I should have billed the client for the extensive garbage cleaning

I am rejecting this response because: I still have not received paymentThis issue can be resolved by paying what is owedI am not going to argue back and forth about this situation, I know that facts and truth of the matterThe comment that my mother was a hoarder shows her lack of professionalism and insensitivity to her clients and I will be glad to be done with this matter

Helping Hands helped us liquidate our mother's belongings Their contract stated we would be paid with in days of the sale We never received anything after weeks so started calling, texting, emailing to find out when we'd get our money We received lies, stalling tactics or no replies at all Even threats to report her resulted in no response After over a month of that we finally got a check They did very little recording of what sold so we had no idea if items were sold, stolen or what She did clean up afterwards, however, but never returned some personal items found after we left We had also heard from others that had used her service that she was very slow to pay

Helping Hands, LLC was hired to complete a living estate sale in Grand Forks, NDThe contract was signed Jan and the initial sale was to take place Feb/Mar due to weatherShe was given a check of $for her set up/cleaning fees/advertising and charged an additional 25% of final sales I had to contact her in Mar to find out when the sale was going to take place, she then said it would be better to have it the first week of May I again contacted her the first week of May and she said she could do it the end of the monthThe initial sale took place on 26-May 2017, which was a holiday weekendShe advertised in the paper, but not until the day of the sale online with no photos and sloppy set upAfter the sale, she felt another sale was needed, so she completed it on Jun 2017, again with poor advertising and set upWe have video and photos from the salesWe told her at that point we would like payment (which she stated was $3500), house key, and list

I was contacted by *** to pack, empty out the apartment that his family member previously occupiedIt was agreed that Helping Hands,LLC would not only pack and remove all items, store them until they could be combined with another sale
It was explained to the client that it would take some time to have a combined sale, as some clients are adamant about allowing another person's items sold during their own saleWe were able to hold a sale in November, and brought the majority of the *** possessions to this saleThe remaining items were combined into a sale in DecemberHelping Hands, LLC was responsible for the storage costs after the initial $per the contractIt was also ASSUMED by the client, Mr***, that Helping Hands, LLC would be responsible for the complete check out cleaning of the apartmentIt was demanded, and I, along with a staff member spent a total of hours cleaning the apartment for checkoutI had to pay my staff member to clean, and was not able to recoup the expenseNormally, this can be a negotiated add on, that I bill at minimum $I was being kind to the family and cleaned it in good faithMr*** refers to the agreement stating "...Helping Hands was supposed to clear the apartment, hold a sale...." Again, not at all referring to the demanded cleaningI was stunned to find this complaintThe client, Mr*** violated the contract, specifically, under

If any items (see below for definition) are removed from sale without agreement of both parties, Helping Hands, LLC will be compensated for up to 50% saleable value of such items

There was an antique table, with an estimated value of $removed from the sale and given to a family friendThis was not agreed to, and I am not understanding why this family friend did not clean the apartment for checkout for the *** familyI am not deducting the amount of $225, even though I am clearly entitled to itFurther, I sent the spreadsheet of sale total, and donation total, donation receipt, and check to *** *** Millwood NY Since this is a PO Box, I was unable to mail it certifiedIt was mailed via USPS Priority MailMr*** does not have a valid claimI fulfilled the contractI packed, removed and sold/donated the itemsI did extra cleaning labor and was not compensatedI did not charge the client for the table that was removed from the saleMy staff also have claimed there were other miscellaneous items removed from the apartment as well, however, I do not have specifics so I cannot estimate pricing and therefor will not pursue compensationIf Mr*** continues on with this or any other claim against my company, I will pursue with billing the estate for the cleaning cost, as well as the $which legally I am entitled to

We signed a Service Agreement with Helping Hands on March 3, for them to handle the Estate Sale on my mother's house in Fargo The primary date was 7-April, and the secondary was the following weekend I emphasized to the company owner, Kathleen, that I really needed to conduct the sale on the primary dates as I was from VA and had to get my mother's matters settled and get back After absolutely no contact from the company, and no actions were taken to start preparing the house for the sale, I finally was able to reach Kathleen who informed me that she might not be able to hold the sale on the primary dates I was shocked She said she would contact me the following day but never did After repeated calls, texts and voicemails, she sent me a short text that said, "I'm in a meeting." I replied to please call ASAP I heard nothing until around 9:PM that evening when I sent her a long text expressing my frustration and disappointment in her and her company She became defensive and informed me she would be contacting her lawyer I then terminated our agreement Totally UNPROFESSIONAL behavior and extremely poor communications throughout She left my mother and I scrambling to find another company to hold the sale

I am rejecting this response because:
 I cannot accept this response. The owner/manager ' Kathleen', has twisted parts of the contract. And used them to avoid the original terms of payment. I have served a small claims law suit against this Company and it's owner. I will let...
