Contract Signed, Materials paid for, work NEVER completed
On Feb. 25th, 2017 we entered into a contract with *** to:
-remove our kitchen countertops and replace them with granite
-replacement of kitchen sink
-remove our kitchen backsplash and replace with new backsplash
-remove our tile floor and replace it with laminate flooring
-remove our tile bathroom floors and replace with tile
-the above projects included demolition, removal, and plumbing reconnection
We signed a contract and we paid him $1,500 by check for materials.
Over the past 6 months, *** has given reason after reason of why our project has not proceeded. While we gave him benefit of the doubt for several months, we now believe these reasons were untrue.
After partnering with a local countertop company to provide materials for our project, *** has not responded to any communications from us or the countertop company.
The result is we ended up having to spend much more due to their pricing and installation fees rather than our contractually agreed to amount with Mr..
We are seeking a full refund of the $1,500 downpayment we gave for materials.

Due to medical issues, I cannot perform the work. I have been out of commision the last month and have not been able to contact *** do to medical conditions. I am now in recovery but still not able to work. Yes, there were unforseen events took place that I had no control over, I just wanted to get there countertops ordered & finished. I had every intension of finishing all the work, and the reason's were true. Yes, they did give me 1,500.00 down, and $1,000.00 of it went on countertops, here is a copy of the $1,000.00 I put down on countertops. The other $300.00 went towards the kitchen sink, the other 200.00 went towards plumbing parts, mortar for the floor. I spent the last 3-4 months on & off trying to take care of this and I did not ask for a dime for my time doing this. Yea it probable did cost more to do this, but I have no control over whats going to happen. I wish *** the best and hope he gets his kitchen together.

The claims made in ***'s response are blatantly false (outside of the $1,000 downpayment).
After contracting with Creative Countertops, neither they nor myself were able to make or received any contact from ***. Few, if anyone, are too sick to call, text, e-mail, or have someone do it on their behalf.
*** had stated from the beginning that the sink was free due to his contractor status at Lowe's.
The $200 for materials has never been utilized on our project.
The 3-4 months is inaccurate in every way:
-We signed a contract 7 months ago.
-The Off & On was due to ***'s workers he had selected (if those reasons were ever true).
He has not completed any of his contractual obligations for the countertops and flooring.
His mismanagement and theft of funds has crippled our project. He has shown no willingness or desire to make amends for his theft of our family's money.
We are unsatisfied with his response and still expect a full refund of our $1,500.
Any consumer should beware!

2nd response to case #*** Mr. ***

Yea from the beginning the sink was free of charge, but since I had to go with someone else I had to buy the sink.

Like I said before, I have no control over what happens, but I do know I went above & beyond what anyone else would of done to get your counter top ordered. And again I didn't ask anything for it. If I did add up all my time, it would well go over the 1,500.00 that you want refunded. (Mr., do you work for free). You, out of all people should not judge someone unless you know all the truth. I wasn't able to contact you or Creative Countertop, because of medical issues. I was concerned about my health more than any job. I am not going to argue over any amount of money, I don't have to steal from any body, because I work for a living. I still have repeat customers from 20 yrs. ago. And new one's come up weekly. You can whatever you want but I know who I am. What I will offer is to get you the 500.00 back, all the other 2 countertops & extra flooring was your decision. Nothing would of made me happier than to do all this work for you, but do to medical issues, I couldn't. We have to except the things we cannot change.

I'm contacting the Dayton Revdex.com in regards to a complaint I opened against *** (

As of the last communication he agree to pay back the $500 to satisfy the claim. I closed the case with that agreement. He has not fulfilled that agreement.

Can I reopen the case?
Is there a different step?
