meeting with the homeowners assoc. representative (Mr. JohnSmith), we were directed to provide a price to repair the roadway, which we did.We entered into a contract with the homeowners representative on May 8, 2017. Following the contractaward for the roadway, we were asked to attend a meeting with several of the homeowners regarding anyadditional work needed to tie in the driveways. This meeting was requested by the representative, becauseany work to tie in the driveways past the roadway, was to be each individual homeowners responsibility. Thecontract with the homeowners association representative was solely for the work on a portion of [redacted].The gentleman filing the complaint was present at that meeting, along with several other residents and thehomeowners representative. Two of the other homeowners requested a quote for additional tie in work ontheir driveways. We quoted both of those homeowners, [redacted]-306 [redacted] and [redacted]-309 [redacted]. Mr. [redacted] choose to have us do his work and signed a contract on July 30,2017; however Mr. [redacted] did not. The gentleman filing the complaint did not request any additional workfor tying in his driveway, therefore no quote was provided to him and no additional work was allotted in thecontract with the homeowners assoc. representative, as that would not be fair for the rest of the residents topay for.To satisfy the gentleman filing the complaint we offered to remove some of the material placed on theroadway in front of his driveway at no additional charge. He contacted us back stating he wanted the roadwayleft the way we constructed it, and asked that additional material be placed from the roadway further downhis driveway to decrease the incline on his driveway. I made a telephone appointment with the gentleman tolook at his driveway, and received the complaint letter the day after making that appointment, which Idiscussed with the gentleman when I met with him.When I met with the gentleman we offered to mobilize back to the job at no cost if he would pay for a load ofstone and spreading the stone. I received a response via email on Dec. 11th from him stating "he would let usknow”. I have attached "document 1" which depicts the work completed in front of his driveway, "document2" is the email just referenced, and "document 3” which is a copy of the agreement with the homeownersrepresentative for the roadway work.I would also like to answer the gentleman's complaint about communicating with us. During the time hedescribed the numerous phone calls to myself at my office and the job foreman on his cell phone, we were offon vacation for the Thanksgiving Holiday and the first several days of deer season. In conclusion we areattempting to resolve the gentleman's complaint in a reasonable manner, and are awaiting his response. Weanticipate having additional documentation from the owners representative to submit to you in the nearfuture, along with any additional correspondence we have with the gentleman filing the complaint.Sincerely,Todd *. Thanks for the response.  There is no longer any need to take any further action.  Because Hempt Bros refused to rectify their error, and I needed to have repairs made before snowfall, I resolved the situation at my own expense.  Because Mr. T[redacted]’s response to Revdex.com is, in my opinion, incorrect and misleading, I would like to make several points, that should be included in the record.If you note on the contract, it called for 3 inches of recycled asphalt millings to be placed on [redacted].  However, at the end of my driveway, an estimated 10-12 inches was placed.  Had the contract been adhered to, and 3 inches placed, the resulting problems with my driveway would not have existed.  Their failure to adhere to the terms of the contract caused the problem, so I felt it was their responsibility to correct the issue at their expense.  Unfortunately, their offer was to fix the problem for an additional fee that was more than $100 more than what I had a competitor charge to fix the problem.Mr. T[redacted] indicates in his response that I was present in the pre-work meeting and did not request additional work on my driveway.  I did not request any additional work at that time, because I assumed that the work would be completed according to the contract, as described above in #1.  Only after the work was completed did I realize the problem.Mr. T[redacted] indicates that he offered to remove some material from the edge of the road to eliminate the hump.  But that would have caused a drainage problem.  Mr. T[redacted] agreed when I met with him at my home that it would cause the drainage problem, and was probably not an acceptable option.Mr. T[redacted] indicates that neither he nor the foreman responded to my repeated phone calls because they were off for Thanksgiving and deer hunting.  However, I had made 15 calls, starting on November 3, well before Thanksgiving or hunting season- Nov 3, 8, 9, 14 (2 calls), 15, 16, 17 (2 calls), 21, 27, 30 (2 calls), Dec 4, and 6.  10 of those calls were prior to Thanksgiving and hunting season.  I did not leave messages with all of the calls, but with most of the early ones, and intermittently later on, and none were returned.  Calls on Nov 3, 14 (second call) and 17 were answered, but no return calls from messages left were made until Dec 3, after I filed the complaint with the Revdex.com.  The complaint seemed to result in a very rapid return call from Hempt Brothers.  That call was not from Mr. T[redacted].The profiles submitted by Mr. T[redacted] in Document 1 are not quite correct.  [redacted] sloped in the same direction before construction as after, but not as much.  The increased slope was accomplished by placing 3 inches (assumed) on the south (left) side and 10-12 inches on the north (right) side.When the recycled asphalt was applied to [redacted], they did apply some down the upper part of my driveway to attempt to make the grade better.  But it was insufficient, and I measured the slope of the end of my driveway at 19 degrees (steeper than the maximum turn banking in 11 of 22 [redacted] race tracks), prior to abruptly changing the slope to the opposite direction, as illustrated on Document 1.  It was difficult to exit the driveway without spinning tires and bottoming out.  We needed to resolve the situation before snowfall that might have prevented exiting the driveway, which is why I started calling on November 3. I might also point out that on my initial Nov 3 call, Mr. T[redacted] agreed to come out on the following Monday, Nov 6 to evaluate the situation.  I took the day off from work on Nov 6, but Mr., T[redacted] never showed, nor called to cancel.  It took 4 more phone calls after Nov 6 before I was able to get in touch again with Mr. T[redacted] on Nov 14 (still before Thanksgiving and deer hunting). I finally succeeded on Nov 14 when he answered when I tried calling from a different phone number. [redacted] [redacted]
