In response to the complaint from [redacted] and [redacted]. They had a bid to do a full replacement driveway in...

both asphalt with a concrete apron and parking pad and all concrete. We met several times and talked about bids. They first called because the driveway had sunk several inches in front of the garage.
When we discussed the parking pad I told [redacted] 12' wide would be best because they are on the downhill side from their neighbor and we can't get it to drain into the hill, I also told him that is where the swale comes out of his backyard for it to drain correctly. [redacted] said he wanted 13' wide for a camper they were purchasing. I told him if it was too far into the hill it would need a retaining wall for around $2000.00, he said he couldn't afford that. With that information he still made it 13' wide. Now the grass doesn't match the driveway edge because we are too far into the hill. He also added several feet to the front, the elevation drops off very fast to the street, so of course it would be higher than the existing driveway. To correct that problem you would tie into the driveway, but he didn't because he was going to do it next year. We also discussed the gate, they were sagging and below the fence line. [redacted] said they were never installed right and he would have them back to install them correctly. It looks like for some reason they can't remember this conversation so I included pictures of the Instant Message to them on Tuesday June 9th 2015 at 10:01 AM showing the elevation the concrete would be compared to the gate. They are pictures labeled #1 and #1 on the back.
I've done 4800 driveways in the last 30 years and this is the first time a homeowner hasn't removed the plants they want to save prior to construction. The hostas were dug out and placed to the side. I took them away after they sat there for 3 days because they were dead. The dirt was left for them to use as backfill after the forms were removed. As far as the dead hosta in the front of the house. I called [redacted] at 11:25 AM on 08.12.15 and he said there was a large rock placed on top of a hosta, and he saw that as a personal attack towards him, I said I didn't understand. He said I needed to talk to his wife and mother in law about our bad attitudes. I told him I would and that I would get back to him. I stopped by 7 times over the next few days to see if [redacted] or her mother were available. I talked to their mother in law at 8:04 AM on 08.17.2015. I asked if she felt offended or if we were any way rude to her or her family, she said we were not, very polite and professional. I was the one who replaced the downspout and placed it into the rocks to drain, at that time I saw no rock on the plant. I went back when [redacted] said it was there and found a 2 3/4" by 1/2" piece of concrete in the plant. You can see by picture labeled #3 it is green and alive.
When [redacted] said the texture was different between the two panels of concrete, I explained to him they were the same and no different tools were used. The new panel should have a little more texture because you were coming off a step and it was for traction. They always look a little heavy at first because it is newer and the sealer makes it shine. They have put a rug out front and I pulled it back a couple of times to check the look and texture. I have included pictures #4 and #5 showing the concrete as it cures, it is starting to blend together as it cures, not a problem.
They have said they don't hear from me, it is because they ignore my calls. [redacted] has now emailed me and said they would only communicate by mail because of the tone of my voice. I don't get it. I record all calls for collection and my voice is no different than any other time. I have included a copy of this email also.
I went to our lawyer as soon as [redacted] said he felt threatened by our crew. They are union trained finishers and 1 laborer, never before have I heard anything like this. On his advice I should just stay away from these two. They can have a discount if that is what it takes.
They can have $4000.00 in my office by 09.07.2015, doesn't have to be certified mail or check. A personal check and USPS is fine. I'll then send them a lien waiver, otherwise collections is fine.

All we wanted was the job done correctly and professionally - we feel we did not get that from this contactor.
The issue is not the 13 feet wide parking pad, a slope, the fence, a retaining wall, etc. It's the quality of work done. Randy and his company stated the job was complete; however we had the following issues:
1. Drain was not buried (2 feet above ground) in the front and back yard
2. Left a trench along the parking pad
3. Two large stains on concrete patio
4. Poor patch job connecting asphalt to new concrete - tripping hazard - looked unprofessional
5. Left unused dirt and removed our plants (still alive plants)
6. Put down grass seed on damaged yard - grass didn't match and a lot of weeds grew
7. Replaced a portion a defection patio they had previously installed that didn't match original job
8. Removed fence and did not reattach
The other bids we obtained made no issue of how wide we requested the parking pad; in fact they stated it would go 15 feet wide. The job was not done correctly and I feel Randy's rebuttable is an attempt to deflect from the fact his Company did an unsatisfactory job for us. In attempts to correct the mistakes, it made it worse. Note: the gate became an issue, because they did not slope the back of the parking pad going into the back yard - it's a step up. I would think a seasoned Company would provide a smooth transition. Also, they did not put the doors back on - we did. I would suggest if homeowners are to move plants, repair grass, gates, dirt, etc., it should stat that in the contract. I am not going to address all the comments Randy has made, because simply put, his Company did a poor job for the first time in doing "4800 driveways". We have no idea what pictures you are referring to as we have been the ones sending Randy pictures/communication of the work performed. We have the pictures and would be more than happy to share them solidifying the unsatisfactory work performed. We are also okay with someone looking at the work preformed and they most likely would agree the job should and could have been done better. We have since had another contractor come out to give a bid to correct the issues and he agreed the job could have been done better.
Randy wants to make it seems like he has done everything correctly, from communication, follow-up, work performed, etc., taking NO responsibility (not once has he taken ownership for the mistakes preformed at our home) by his Company. Had he done so, we would never have had to resolve this matter through the Revdex.com. We were prepared to take this to court, if it could not be resolved through the Revdex.com. We feel with the assistance provided by Revdex.com, we will close the case, however, we DO NOT agree with Randy's rebuttal. We would like to put this experience behind us and will send Randy a check for $3500 by September 7th.
