I rented a trencher in Indio, Ca. for a weekend rate, to be delivered to Palm Springs, Ca. where it is illegal to use on Sundays. I rented this trencher with the understanding that I could use it for 8 hours at ANY TIME over the weekend. Their defense is, we are in Indio, we don't know the laws in other cities. WELL IF YOU ARE GOING TO DO BUSINESS IN THE ENTIRE COACHELLA VALLEY, DON'T YOU THINK IT WOULD BE WISE TO KNOW WHAT CONSUMERS CANNOT DO LEGALLY? They simply do not care, just greedy, as most every other business here.
I received the attached letter in the mail today and I appreciate you reaching out to share the customers concern. At Herc Rentals it is our mission to ensure that end users of our equipment and services achieve optimal performance safely, efficiently and effectively.
Mr. placed an order on July 3rd, 2019 for equipment (a ride on trencher) to be delivered to his residence on Friday, July 12, 2019. When he placed the order he stated he only had a few hours of work but did not want to be charged for the whole weekend. As a courtesy we agreed not to charge him for the whole weekend as long as he did not exceed eight hours on the meter since that is all that's allowed on a one day rental and we are not open on the weekend. The equipment was delivered Friday morning the 12th and we started the contract on Sunday the 14th allowing for two more days of potential usage. We did not charge for any of the extra time he was given access to the equipment, he was only billed for the one day (July 14th). As it states on the agreement he signed, the "customer is liable for all violations of law arising out of customers use, possession or operation of the equipment". We cover over thirty cities/towns throughout 4 counties from our office alone, all have their own codes and many have different codes depending on the time of day, day of the week, what part of the city you are in and they change all the time. The fact is, unfortunately we cannot possibly know them all.
I have reached out to Mr. multiple times prior to receiving your letter to discuss his concern. I have left him messages to call me back and given him my direct cell number. I will be happy to discuss the situation with him personally, however, he has yet to respond. He has already spoken to a couple of representatives of our business with regard to his complaint and he never has requested any credit or discount except in this complaint and stated to our employees that he was upset and "just wanted us to know".

I am rejecting this response because:
I was NOT reached out to regarding any phone calls from this business, IN FACT, I HAVE NEVER EVEN RECEIVED AN INVOICE FOR MY PURCHASE, thats what we are dealing with here, irresponsibility at its best. I wanted it for a days work, and REGARDLESS of what the original intent was regarding time usage, I WANTED TO GET MY PROJECT COMPLETED, EVEN IF THAT MEANT AN EXTRA DAYS RENTAL! I was stopped by the sheriff because this machinery is NOT LEGAL to use in the City of Palm Springs ON SUNDAY. MY PROJECT WAS NEVER COMPLETED BECAUSE OF THEIR INCOMPETENCE. IF A COMPANY INTENDS TO BE IN BUSINESS, THEY NEED TO KNOW THE LAWS REGARDING THE USAGE OF THEIR EQUIPMENT, REGARDLESS.It shows no responsibility on their part to say," we don't know the laws in other cities, we are in Indio. WELL YOU HAD BETTER KNOW THE LAWS WHERE YOU DO BUSINESS, OR GO OUT OF BUSINESS, BECAUSE IT IS YOUR RESPONSIBILITY TO INFORM CUSTOMERS OF THEM.GREED WILL NOT PREVAIL ! You MUST know what you are doing, or get out of business, period !
As I stated before, I had left him messages to call me back and given him my direct cell number. I am still willing to discuss the situation with him personally. However, even after including my number in my response to you, he has yet to call me back. Also, I mentioned before and is standard for our industry, the "customer is liable for all violations of law arising out of customers use, possession or operation of the equipment" as stated in his rental agreement. Apparently at this point we are at an impasse and if the gentleman would like to discuss further he is welcome to call me direct at the mobile number listed in my signature below.
