February 29, TO: [redacted] , Revdex.com FROM: New-Cal Home Improvements & Repairs Rick Favreau Re: Complaint of [redacted] LDias, Complaint # [redacted] To start I would like to point out in the first statement from [redacted] , she says and I quote: “I disappeared with $1,($1,materials and $up front for labor); not returning phone calls and not returning money,” end quote NEVER does she say I worked there or any other money was given to me (no checks, nothing) Sounds to me like I got paid and never did any work OK With that said she sends in second statement (after I submitted mine with dates and amounts) with different amounts and this time says I worked days (not sure how she knows when I worked as she would only be there two days a week and not every day OK Day one started work Sept3rd, last day worked Nov17th Sixty-five working days during this time Monday-Saturday I worked days at her home, some days working only five hours and most were ten to hours Even had three days there were over hours As the month of Septwas opened for two and a half weeks and when she started adding things to do I made a new invoice and she would sign that As you see I have four and each one had add-ons So when I told her I had other customers already on my book she was not happy with me telling her I will have to fit you in between the other jobs There were times I would leave one job and go to her house and work until late at night so she is right saying sometimes I would not show up until three or four p.m I had other customers and would work her in--most people wouldn’t do what I did--but I was trying to help get the home done Those are the nights I was there from three or four p.mto whenever, a few times until midnight I do want to mention that her memory is not as good as she thinks As she says I moved from Virginia is not right It was Vermont And I told her I have a contractor’s license for Vermont and trying to get one for California I also told her I plan on getting an inspector’s license As to tell her how much money I make, I wouldn’t tell anyone that, PERIOD She also states I was there to help them but as she said in her statement she is there on her days off (two days) a week and she was not there every week So who was helping me the other days? The agreement was they ( [redacted] , [redacted] her husband and their daughter) would do half the work They did about 20% (that is being good) I could comment about other things she has said but I’m not here to get in an argument I do want to mention she said I left the whole house open to extreme cold with three small children That statement is not true I had put insulation in the bathroom and was waiting for them to finish with the walls as they told me they would do that so I can do other things they can’t do The basement was the only thing left open as that is what I was working on before she asked me to leave So she left it open, not me Now some good that I did-- that I never charged them for I cut out a stump that was in Picture # where the chain saw is It stood about eight feet tall I never charged for mileage on all those days traveling from other jobs like Roseville and Cool I even spent the night there one time because it was after midnight and they wanted to start around 7:a.mthe next day I even babysat the kids for almost ½ hrs while I was there working Ok so tell me why Iam such a bad person here not sure I see the picture, very sorry she feels this way They are nice people and I am still friends with there daughter that lives there and told her if she needs some help I will help HER I love her kids I even brought stake bones for her dog he is great Him and I ran off a bear one night there I helped dig a trench for a propane line with [redacted] (her husband) and never charged them I have Pictures 1-with comments on each of them Supporting documents are attached and are self-explanatoryI do want to mention that even if I did work the days she says witch is days (days is right) and charged them the $ She is asking for all $plus $more back so that would tell me my time working there is free and I have to pay them on top of it Not sure that’s how it works New-Cal Home Improvements & Repairs [redacted] [redacted] [redacted]

Re:  Complaint of [redacted] Complaint #[redacted]This is my rebuttal in regards to the complaint of [redacted].  Her complaint states that she paid me $1,000 in materials and $800 in labor which is partially correct.  The following are the transaction that have...

occurredbetween Mrs. [redacted] and myself with a breakdown of labor and materials:  9/15/15 - $500.00 cash to labor; 9/7/15 $500.00 cash to materials; 9/13/15 $500.00 Ck #5355 ($300 labor and $200 materials); 9/23/15 $920 Check #5384 to materials.  Total Paid $2,420.00 of which $887.01 is for materials.  I have receipts if you need them.  Leaving a balance of $1,532.99. The total labor charge for this job is $1,600.00.  Mrs. [redacted] had paid me $500.00 on 9/5/15 and $300.00 on 9/13/15 leaving a balance of $800.00 for labor.  On the day I left I had $732.99 of her money for materials.  I used that towards the $800 she owed me after I figured the total cost of labor on the day I left.  The remaining balance of $67.01 for labor that she owesme was not submitted because I thought she wouldn't pay me.  I feel I was more than fair to her as I worked there for approximately 32 days total and was quite shocked to have received this complaint.  It's obvious her calculations are incorrect.  I have given you my statement and will supply copies of checks and invoices for materials if you need to see them as well as pictures of before and after the start of the job.  Please contact me if you have any questions or need any other information that will help clear this matter up.  Thank you. [redacted] cellemail:  [redacted]

I am rejecting this response because:Regarding complaint #[redacted]nst New-Cal Home Improvement & Repairs Dear [redacted],                                  �...           2/19/15My two eighty year old uncles, [redacted], and DIY shows, had been instructing my daughter and I as we were doing all the work on a fixer upper in Colfax (have pics). *I met [redacted]. as he approached me at [redacted] just after checking out at the register on September 1st 2015 at 9:30pm. He was impressed with all the supplies and that we girls were doing all the work ourselves.  He said he ‘just moved to the area’ from Virginia 6 months prior.  He said he was a ‘licensed contractor’ and ‘worked as an inspector’ for Auburn area stating, ‘they love me over there for some reason’. He said he does it ‘as a hobby’ since he receives ‘$5000.00/mo for his military service’, I was quick to believe it.  He convinced me he was an honest guy and would ‘help’ us with our projects.He came to the house the next day to check things out give us prices for his help but would not work hourly stating, ‘believe me you’d be doing yourself a favor, I’m slow but steady’. Our agreement was he would ‘help’ us do the work.  He helped us for a total of 17 days, most of which were fragmented hours and almost always showing up after 1pm, many others not able to make it until 4pm and would often stay for dinner. But we  considered him a friend and didn’t know anyone else in the area yet. From invoice; He helped us put in 3 beams.  He said we should replace, rather than repair, the bathroom.  He left after it was gutted. He only helped us tear it out (including part of the floor, ceiling, and the wall..ALL left open to air, rain, and cold for over a month until we finally finished it ourselves!). He helped us tear down the deck (we had been fixing the deck but he convinced us it needed to be rebuilt so my husband also came to help us tear it down as well). He did not show up to help with rebuilding it. The hole on the floor near the washer and dryer is also still there. Nothing else was completed from the invoice/contracts so I would like an explanation as to his conclusion that we owed him $1600.00 for labor when labor for helping with rebuilding was $3000.00. Please see invoice # 115 (picture/attachment from original complaint):  *As stated in red, ‘customer paying for all materials’. I still have all the materials we bought for the deck totaling $2800.00. The deck, to date, was never started.[redacted] received a total of $1032.00 for additional deck materials that he didn’t originally anticipate (stated as #9 on invoice) so that we could be ‘ready to go’ on my next 2 days off work.  We have never received any of the additional materials he claims to have purchased and would love the receipts and materials he has! (He also said on the invoice that he previously ‘used $887.00’. Although not part of this claim, we never knew what those materials were either and he never produced the receipts then either, as he offered). [redacted]. wrote “BALANCE of $732.99 paid for materials as of 9/27/15”.  We did not see him again until 10/27/15 when I gave him a front of $500.00 cash and additional $300 for labor (so together for materials=$1032.99). Even though it was upsetting that he had delay after delay, multiple excuses for no-shows (and no return texts or phone calls) especially leaving when the whole house open to extreme cold with 3 small children (ages 3,4, and 8) in the winter! He apologized that day (10/27/15) and said he had been healing from a back injury that required him to be in the VA hospital. My daughter [redacted] is a professional massage therapist and gave him a free massage. We never saw him again until November 17th (after many promises and no-shows) when he arrived just as it was getting dark (and he didn’t bring a light).  As desperate as I have been to allow this to go on I said, “This is going to work out anymore and I would need my money back”. He became scary and used excess profanity in front of the kids and said he would write me a check and send it in the mail. I never received and we never heard from him again until writing our complaint to Revdex.com. He called my husband apologizing for not calling us back but that his daughter was hit by drunk driver and it took him out of state.  And he said he was pissed off at us for contacting your office and said he had talked to his lawyer and was going to sue us for $67.00. He also said his wife was killed by a drunk driver years ago so we feel bad for whatever he is going through but we cannot let him walk away with our money. My daughter and I could have fixed what we had but could not replace, on our own, the things we had tore out. We just want our money back so we can continue our work. On his rebuttal he forgot about the $800.00 additional cash given to him on 10/27/15, which he initialed at the bottom of the invoice (there was more cash given to him that we did not have in writing!). Please let me know what I need to do. I previously attached Rick's New Cal invoice [redacted] (I'm attaching it again for your reference) supporting all items that Rick agreed to help us with for a total of 3000.00.  In his rebuttal, he sent 3 versions of that same invoice. The 3rd one that he included is the same one I sent only his copy didn't have the ADDITIONAL $800.00 CASH that I gave him on 10/27/15 (I had him initial my copy on that evening).He provided all receipts that total about $880.00 and are not being disputed in this complaint!He was already paid for that as he included in his invoice #115 (he circled #4 at bottom of page).See bottom of invoice: It says USED $887.01 and with $732.99 remaining for materials. The last day he worked was on September 23rd.He continued to not show up or call, or text, or email until he came over the evening of 10/27 saying he was recovering from a back injury.I gave him the additional $800 up front since I had just cashed a check and trusted he was starting that same week.He never came back until November 17th. It was already getting dark when he arrived and I had already been working the whole day. This is when I said 'it didn't seem like he wanted to help with the project' and he used abusive profanity toward me and it was clear that it wasn't working out. He was very hostile and said he'd send me the money back in the mail.Not including all the cash we gave him (including the paint we were charged for twice and it was used from a previous job!)that we can't account for. . As stated on his invoice: He is not disputing that he had a balance of $732.99 'as of 9/27', and that we paid him $800.00 labor + the additional 800.00 he was given and initialed on 10/27. That is a total of $2,332.99.His contract (the last one on his rebuttal) shows all of the items he was going to help us with for a helping labor fee of $3000.00. This was including; helping tear down the deck and rebuilding the deck (not done), repair floor and support beams, replacing all of floor near washer (not done), taking out shower,sink, toilet, cabinets and all of bathroom floor, walls, and ceiling ALL GETTING replaced (not done), replacing 2x12x18ft under house beams (not done). 2nd ramp on deck w 3 stairs (not done). Replacing plywood on wall under back deck (not done).His invoice #114 ( items that are also listed in invoice #115 mentioned above ( with his supporting photos) repairing floor and support beams for a total of $350.00 in labor for helping (hole still unfinished behind washer and dryer)!He was supposed to help me on my days off which included most Tuesday'sand Wednesday's and/or every other weekend and yes, working around his preferences. However he stopped coming altogether. He came to help me (and sometimes me and my husband) on the following days:Weds September 2nd (just to look at house)Friday September 4th (picked up lumber for deck)Saturday September 5th helped with beamsSunday September 6th (a few hrs)Wednesday September 9th (about 5-6hrs)Saturday September 12 (about 9 hours)Sunday September 13th (about 4 hrs)Tuesday September 15th (about 5 hrs)Thursday September 17th (about 6 hrs)Friday September 18th (4 hrs)Tuesday September 22nd (7 hours) spent night in our motor home (he had wine/dinner w friends who also came from Santa Cruz to help us).Wednesday September 23rd (about 6 hrs)He said he came to work a few other times when I wasn't there but I did not see anything completed. He enjoyed spending time with our daughter and grandkids so perhaps he was distracted.He said he was a licensed contractor who liked doing projects to keep him busy. He refused to be paid hourly and gave us a contract for helping with work our whole family was doing on the house.  He quit helping but wants to keep the money before anything was completed on his contract. He denies stating he was a contractor and inspector but it is exactly what he said. He said it was 'Vermont' but still hasn't provided that contractor license either.It is our understanding that he would not be able to write a contract in California if he were not licensed.Please see photos. He helped us do projects but he also derailed a few of our plans and convinced us to do more than planned. Before he came to help we put in a beam and we jacked up the sagging deck (we were going to fix)with the help of our uncles.Thank you for your time in reviewing this complaint.
