I called Heritage Farm Estates to scheduled an appointment for that coming Saturday to view an apartment. Upon scheduling I had to complete their application form and was informed there would be $12.95 application processing fee. The apartment is located in Plover, Wisconsin and I live 3 hours away in Milwaukee, WI. I noticed a house for sale in Stevens Point and went up on Wednesday to look at it and am now in the process of purchasing the house. I cancelled all my appointment with Heritage Farm Estates as well as 5 other apartment showings that I had scheduled for the same weekend. I noticed in my bank statement from Landmark Credit Union, a withdrawal of $12.95 and $103.95 from Heritage Farms that I did not authorize. Upon contacting their main line I was informed by the front desk that this amount was not refundable. I informed her that I did not agree to this and she stated that the application department said this was earnest money that they do not refund stating I greed to taking the apartment and then cancelled. This is completely wrong, no where on anything I completed does it state this is a nonrefundable charge, no processing fee indicated anywhere for $12.95.
I contacted my bank to dispute this charge as well and sending at least 3 emails to Heritage Farm(with no reply) via their website about obtaining a refund. Landmark Credit Union fraud department contacted Heritage Farm and she was informed that they had a refund listed for $100.00 on their books. I have tried contacting them to find when I would be receiving my refund which should be $116.95 since I did not request nor sign this agreement showing a $103.95 fee. To date I have not received any refund. Attached are the forms I was able to obtain from Heritage Farm website, applicant portal.

Ms. Stoetzle has provided your office with only a portion of the documents she completed and electronically signed on January 22, 2020. At no time was Ms. Stoetzle required to submit a rental application. All fees and charges associated with the transaction were fully disclosed to Ms. Stoetzle when she applied and signed documents on January 22, 2020. It is unfortunate Ms. Stoetzle misunderstood that she would be charged fees and her earnest money deposit would be forfeited if she backed out of the transaction after her application was approved, as she clearly did.While we disagree with Ms. Stoetzel’s complaint as indicated, in order to maintain our reputation with the Wisconsin Revdex.com we are refunding the requested amount of $116.90 to the consumer. A copy of both of our checks is included with this response. The checI‹s will be mailed to Ms. Stoetzel on Monday, March 23, 2020.I hope that this response and action fully resolves this consumers complaint.
